Bigotry and violence against Asian Americans continues to occur on a regular basis, but it often does not receive the sustained national attention it deserves. A few years ago, as the rest of the country celebrated America's Independence Day, a 21-year-old college student, Benjamin Smith, went on a three-day shooting rampage in Illinois and Indiana, killing one African American man and one Korean American man, and injuring nine other Jews, Asian Americans, and African Americans. This cross-cultural carnage is an important reminder that hate crimes need be taken seriously by both the Asian American community and the American public at large. After September 11, 2001, Americans who made no distinction between the terrorists who attacked the World Trade Center and people who looked like them started shooting, harassing, and violating the civil rights of South Asians, Filipino Americans, Latinos, and others who looked "Middle Eastern," as well as Arab Americans and Muslim Americans This 1982 incident bore frightening similarities to the anti-Chinese hysteria of the 1880's, when a nationwide recession led to the Exclusion Act of 1882. This 1882 Act barred immigration of Chinese laborers, denied citizenship to all resident Chinese, and prompted angry mobs to attack and destroy Chinese American communities across the West.

She passed away 10 days ago at age 82, just before the 20th anniversary of his murder. Vincent Chin, a 27-year-old Chinese American, died on June 23, 1982, at the hands of two disgruntled Detroit autoworkers who mistook him for Japanese. One held him down. The other bashed his skull with a Louisville Slugger baseball bat, not once but four times. They were never punished, despite two federal civil rights trials. A subsequent civil suit won a $1 million judgment against Ronald Ebens, who wielded the bat, but he made good his boast that Chin's mother would never see the money. At the time, I was working for the old Herald-Examiner in Los Angeles and even on the diverse West Coast, I could see tensions ratcheting up over Japan's seemingly invincible prosperity and America's economic decline in the early 1980s. I remember feeling revulsion and fear at the killing. Had I crossed their paths in Detroit, maybe Ebens and his stepson, Michael Nitz, would have hunted me down instead of Chin. Wrong place. Wrong time. Wrong looks.

The Department is the largest state civil rights agency in the country, and is charged with protecting and safeguarding the civil rights of all Californians. It accepts, investigates and resolves complaints alleging unlawful discrimination based on race/color, national origin, ancestry, sex, age, religion, physical and mental disability, medical condition, and marital status in employment, housing and public accommodations. The Department also enforces the Ralph Civil Rights Act, which prohibits acts of hate violence, and the California Family Rights Act, which provides protection for families with children and individuals with disabilities. Prior to his present position, Mr. Hayashi worked for six years in the Administration of President Bill Clinton. From 1993-1997, he served as Director of the Office for Civil Rights (OCR) in the US Department of Health and Human Services.
