The main aim of this book is to discuss the state of unfair competition law in the European Union. In this respect, the various efforts that have been made in the past to come to harmonization of this area of law and the reasons that they were only partially successful are reviewed. In addition, the International and European regulations that refer to unfair competition, like, e.g., the Paris Convention, the TRIPs and the recent 2004 Unfair Commercial Practices Directive are discussed. Also an overview is given of the unfair competition laws in the United Kingdom, Germany and the Netherlands with respect to the ‘problem-areas’ of slavish imitation, misleading advertising, denigrating one’s competitor, trade secrets and finally, misappropriation of valuable trade assets.

Unfair competition law is traditionally considered part of intellectual property law. Not only the relation of unfair competition law to intellectual property laws are therefore part of the discussion but also the areas of consumer protection law (since unfair competition law is partly orientated towards consumer protection) and competition (as an economic concept) is the topic of thorough review. ... By focusing on the Japanese judiciary's interpretation of two statutes he Trademark Law and the Unfair Competition Prevention Act some important lessons are learned. First, the Japanese judiciary treats trademark owners (both foreign and domestic) paternalistically. Japanese courts go to great extremes to avoid harsh results that seem possible under a strict reading of these two statutes. Second, Japanese trademark owners are extremely rights conscious and pursue litigation to the fullest in order to drive up the cost of market access by competitors. Third, the Japanese trademark right operates more like a true property right than it does in America. Save your money.
As a banker in the US and EU credit card servces I was *really* just stupified at how *very* bad this book is.

This book having just been published as you will note, I was expecting some very insightful writing/commnetary along with the research (which was all based on mid-to-late 1990's - so nothing new.)I have written White Papers and Blue Papers that had more content and insight.

Should be required reading from Day 1 at Law Schools...
Superb resource.I would suggest reading this, probably twice, before showing up for first year.I wish I had, although I got hold of this in time to make a difference in what I produced.I mean it - if you want to suck all there is to get out of the Law School process, pick this up.
