Editorial Review

Product Description
The central idea animating environmental impact assessment (EIA) is that decisions affecting the environment should be made through a comprehensive evaluation of predicted impacts. Notwithstanding their evaluative mandate, EIA processes do not impose specific environmental standards, but rely on the creation of open, participatory and information rich decision-making settings to bring about environmentally benign outcomes. In light of this tension between process and substance, Neil Craik assesses whether EIA, as a method of implementing international environmental law, is a sound policy strategy, and how international EIA commitments structure transnational interactions in order to influence decisions affecting the international environment. Through a comprehensive description of international EIA commitments and their implementation with domestic and transnational governance structures, and drawing on specific examples of transnational EIA processes, the author examines how international EIA commitments can facilitate interest coordination, and provide opportunities for persuasion and for the internalisation of international environmental norms. ... 5-0 out of 5 stars Excellent Overview
The foreward by Michael Reisman is a very accurate description of the book. Recent book reviews by Frederik Pischke in Natural Resource Forum 31 (2007) echoes those sentiments, concluding that "The book presents practitioners in the field, as well as scholars from related disciplines, with an invaluable resource for clarifying concepts and providing orientation in the complex and constantly evolving field of international environmental law". Editorial Review

Product Description
In Global Democracy and Sustainable Jurisprudence, Walter Baber and Robert Bartlett explore the necessary characteristics of a meaningful global jurisprudence, a jurisprudence that would underpin international environmental law. Arguing that theories of political deliberation offer useful insights into the current "democratic deficit" in international law, and using this insight as a way to approach the problem of global environmental protection, they offer both a theoretical foundation and a realistic deliberative mechanism for creating effective transnational common law for the environment. Their argument links elements not typically associated: abstract democratic theory and a practical form of deliberative democracy; the legitimacy-imparting value of deliberative democracy and the possibility of legislating through adjudication; common law jurisprudence and the development of transnational environmental law; and conceptual thinking that draws on Deweyan pragmatism, Rawlsian contractarianism, Habermasian critical theory, and the full liberalism of Bohman, Gutmann, and Thompson.

Baber and Bartlett offer a democratic method for creating, interpreting, and implementing international environmental norms that involves citizens and bypasses states—an innovation that can be replicated and deployed across a range of policy areas. Transnational environmental consensus would develop through a novel model of juristic democracy that would generate legitimate international environmental law based on processes of hypothetical rule making by citizen juries. This method would translate global environmental norms into international law—law that, unlike all current international law, would be recognized as both fact and norm because of its inherent democratic legitimacy. ... Editorial Review

Product Description
Laws concerning environmental protection have a long history in the UK, but the last thirty years have seen unprecedented development in both the substantive body of environmental legislation and in thinking about underlying principles and institutional arrangements. The materials in this book, based on some of Richard Macrory's most significant writings, demonstrate how far environmental law has come in less than a generation, focussing in particular on the major themes of regulation, institutional arrangements, and enforcement which underlie the substantive detail of the law. Whilst acknowledging the growing importance of public international law relating to the environment, the book is largely concerned with UK and EC law, though many of the core themes have much wider relevance. Chapter 1 is concerned with major issues concerning regulatory reform, while chapter 2 considers challenges to current institutional arrangements, including the need for a specialised environmental court and tribunal, and the environmental implications of the major constitutional changes that have taken place in the United Kingdom in the last decade.Chapter 3 reflects on the shifting dynamics of environmental law, new environmental standards, new technologies and the need to develop new notions of responsibility. Chapter 4 is a selection of reports of leading cases over the last decade illustrating how the higher courts have grappled with the interpretation of environmental legislation and the development of legal principle. The final two chapters focus on European dimensions, such as the key principles of EC law and its enforcement through unique, but by no means perfect, mechanisms developed under the Treaty. ... 2-0 out of 5 stars Recycled literature
I know we're supposed to recycle paper, but it's not good scholarship simply to recycle past works and call it a book. In this case, it seems the author simply pulled together some old articles into a new collection. There are two problems with this. First, it doesn't provide a good overview of EU/English environmental law. For example, I had a question about legal standing for environmental NGOs under the European Court of Justice, but didn't see anything about that in the chapter on the ECJ or the index. Moreover, it seems some of the entries are dated. I saw one article reprinted from 1998 - over a decade before this volume was published. I'm sure here's been jurisprudence since then. There are other, better books on the subject, such as Enforcement of European Union Environmental Law. ... Read more

Product Description
Like other publications in this area, this book surveys, organizes, and explains the most important provisions of RCRA and CERCLA while providing relevant background. This publication goes beyond other publications by emphasizing the scientific, policy, and legal issues that make hazardous waste management a difficult and complex problem for Congress, EPA, and practicing lawyers. As with other areas of environmental law, the role of law is to pursue a number of distinct policies in the context of a technically challenging problem. This book explains the nature of the underlying problem that the law seeks to address, and the specific choices that the law makes in addressing it. ... Read more

I had to buy this for an Environmental Policy class I took at UCLA, and I only ended up reading a couple of the chapters. It was interesting and had excepts from several different sources about the environmental impact of humans, environmental policy, and environmental science. But goodness, there would be a spelling error on every single page! Usually it was decipherable, but sometimes it made understanding the text quite difficult. As someone who is an Environmental Science major and not a pre-law student, is this the norm for most law books?Because for people who put such high emphasis on communication and conveying ideas, I'd think they would really attempt to have fewer spelling errors in their textbooks. ...
