Extractions: Articles - Grandparents Rights - The state of Georgia recognizes that the relationship with a grandparent is important to a child, and gives the grandparents the right to seek visitation when it is otherwise unavailable to them. This might occur when one parent is deceased, or does not get visitation with the children. The grandparents may file a separate action against the custodial parent to seek visitation rights with their grandchildren. However, because of a recent Supreme Court of Georgia ruling, the legislature had to re-write the statute to eliminate the right of the grandparent to intervene where the grandchild is living with both biological parents in an intact family. The custody of a child cannot be given to someone who is not a biological parent unless it is determined, by clear and convincing evidence, that it would be in the child's best interest to live with a relative other than the biological parent. It is no longer necessary that the parent be found to be unfit. If fitness of a parent is an issue in deciding custody the Judge will sometimes ask for a Guardian Ad Litem to help investigate from the child's perspective and make a recommendation to the Court.

The loving and nurturing relationship between grandparents and a grandchild often provides the child with intangible benefits that cannot be derived from other relationships. Increasingly, however, grandchildren, often the product of broken homes, have been deprived of contact with their grandparents. The legislature and courts, cognizant of the importance of the grandparent-grandchild relationship, have implemented procedures by which grandparents can seek visitation with their grandchildren. These laws, however, do not give a grandparent an absolute or unqualified right to visitation. Instead, as in all cases involving child custody and visitation, the primary inquiry is "what is in the best interests of the children." It is the grandparent's burden to show that it is in the best interest of the child for the grandparent to have visitation. Before the court will even consider whether visitation is in the best interests of the child, the grandparent must show that he or she has "standing" to seek visitation. As written and interpreted in New York, for instance, only a natural grandparent or grandparent through adoption has standing to seek visitation with a grandchild. The statute is severely limited in scope and the New York courts have not been expansive in their construction of this law. For example, it has been held that other family members (e.g., uncles and even great grandparents) lack standing to seek visitation with children. In at least one case, a court held that a natural grandparent, who renounced her parental rights to her daughter, the mother of her grandchild, lacked standing to seek visitation with the grandchild.

GRANVILLE For many people, one of life's great joys is time spent with grandchildren. The traditional grandparent-grandchild relationship provides opportunities for fun and fellowship between the generations. Parents often appreciate relief from child care responsibilities. Grandmother and Grandfather can provide advice and guidance to the grandchildren from a wise and experienced perspective. But when the grandparent-grandchild relationship is disrupted, it often results in heartache for both. When a couple separates or divorces, the courts often play a major role in deciding custody of the children and visitation rights of the non-custodial parent. But a grandparent who has forged a bond with the children may be left out of a court order or a settlement agreement. When spouse dies and leaves small children, the remaining spouse may move far away and/or remarry. Again, the grandparents may be prevented from spending time with the grandchildren. Grandparents of children born out of wedlock may not always be welcome when they wish to visit the child. Disagreement between grandparents and their children may result in a family rift that isolates the grandchildren from their grandparents. Whatever the reason, the result may be tremendous disappointment for grandparents and grandchildren who are not allowed to spend time together.
