Product Description
The legal status, responsibilities and rights of men who are fathers - married or unmarried, cohabiting or separated, biological or social in nature - is a topic with a long and well-documented history. Yet recent developments in a number of countries suggest a growing politicisation of the relationship between law and fatherhood. In some countries, an increasingly vocal, visible and well-organised fathers' rights movement has been credited with influencing perceptions of the politics of family justice. Fathers, it is argued, have become the new victims of family law justice systems that have swung 'too far' in favour of mothers. Armed with such claims, fathers' rights activists have set out to achieve a range of legal reforms, most notably in the areas of child support law and contact and residence rights following separation. This book presents an attempt to understand these developments.Bringing together leading international commentators it provides a careful, critical and comparative analysis of the work of fathers' rights activists, the role law has played in their campaigning, their legal strategies, their success (or otherwise) in achieving legal reform, similarities and divergences with the women's movement, and the relationship between fathers' rights movements and the societies that frame them. In addition to Collier and Sheldon, contributors include: Susan B Boyd (University of British Columbia, Canada), Jocelyn Crowley (Rutgers University, USA), Maria Eriksson (Goteborg University, Sweden), Keith Pringle (Aalborg University, Denmark), Helen Rhoades (Melbourne University, Australia), and Carol Smart (Manchester University, UK). ... With changes in demographics, grandparents are living longer and want to spend as much time as they can with their grandchildren. There is no other book in the marketplace that so clearly addresses the rights of this growing population.

This timely revision explains the ramifications for all 50 statesrelating to the recent U.S. Supreme Court case of Troxellvs. Granville. While the case took several twists and turns throughthe Washington state legal system, the final outcome held that thejudge's version of the "child's best interest" is not the onlydetermination that is used. A court must take into account a fitparent's version as well.

Divorced and deceased parents also are topics addressed in relation to grandparents' rights. In addition, easy-to-use, blank tear-out forms are available for immediate use, if warranted. ... Read more

The author presents the basic legal process on obtaining visitation rights via petitioning the circuit court in your state. The steps here are only for those who cannot negotiate reasonable visitation directly with the custodial parent. The book includes brief suggestions on hiring an attorney. The book is fairly dry and basic, with little commentary. An alternative would be to purchase a how-to divorce guide an apply the process to a grandparent motion; you may receive more in-depth information from a "how to" divorce guide on the court process than from this book. ... Product Description

Children are increasingly a focus of international and national courts and truth commissions. Their participation, including through testimony that bears witness to their experiences, demonstrates their critical role in truth, justice, and reconciliation processes. If children are to engage, however, their rights must be respected.

This book includes analysis of the recent involvement of children in transitional justice processes in Liberia, Peru, Sierra Leone, and South Africa. It also explores key areas of current debates among legal scholars and child rights advocates, such as international criminal responsibility, traditional and restorative justice, reparations, psychosocial support for child witnesses, and links between education and reconciliation.

The book emphasizes how children must be engaged during post-conflict transition. If children are excluded, they may become vulnerable to a continuing cycle of violence, affecting future generations. In contrast, through active involvement in transitions, children and adolescents can be the catalysts for justice, reconciliation, and peace-building within their own families and communities.

Product Description

The United Nations Convention on the Rights of the Child 1989 is one of the most highly ratified human rights treaties in the world, with 192 states currently signed up to it. Article Twelve is fundamental to the Convention and states that all children capable of forming views have the right to express those views, and recognises that all children have the right to be heard in any judicial and administrative proceedings affecting them.

This book explores the historical and theoretical background to Article Twelve, and examines the various models of participation which have been created to facilitate a better understanding of this provision. Aisling Parkes analyzes the extent to which Article Twelve has been implemented under international law, and in domestic law, as well as setting-out recommendations for the most effective ways of implementing Article Twelve in all areas of children’s lives.

Product Description
All across America, angry fathers are demanding rights. These men claim that since the breakdown of their own families, they have been deprived of access to their children. Joining together to form fathers' rights groups, the mostly white, middle-class men meet in small venues to speak their minds about the state of the American family and, more specifically, to talk about the problems they personally face, for which they blame current child support and child custody policies. Dissatisfied with these systems, fathers' rights groups advocate on behalf of legal reforms that will lower their child support payments and help them obtain automatic joint custody of their children.

In Defiant Dads, Jocelyn Elise Crowley offers a superbly balanced examination of these groups in order to understand why they object to the current child support and child custody systems; what their political agenda, if enacted, would mean for their members' children or children's mothers; and how well they deal with their members' interpersonal issues concerning their ex-partners and their role as parents. Based on interviews with more than 150 fathers' rights group leaders and members, as well as close observation of group meetings and analysis of their rhetoric and advocacy literature, this important book is the first extensive, in-depth account of the emergence of fathers' rights groups in the United States. A nuanced and timely look at an emerging social movement, Defiant Dads is a revealing investigation into the changing dynamics of both the American family and gender relations in American society. ... 5-0 out of 5 stars To be read between the lines
It is important that all pro-family and pro-parent activists read this book closely -- not because it offers an accurate assement of the problems it discusses, but rather, because the book provides a blue-print for the anti-family strategy of (one camp of) the extremely influential social engineers who do so much to make sure children are raised bt the nanny state. The policy aims promuulgated by the author are directed at "domesticating" those pathers who are increasingly being pushed out of their children's lives.

In short, the ideal expressed in this book is to see fathers "helped" through supervision, intrusion, intervention into becoming obedient drones who allow themselves to be docile subjects, obedient to the control-freak priorities of bureaucrats who enforece the rule of big government. "Abolish the family!" said the Communist Manifesto in 1848.

The road to hell is paved by social engineers with therapeutic "solutions" used as paving stones.

5-0 out of 5 stars Invaluable addition to public policy collections
Dr. Crowley has provided an excellent addition to the scholarly literature on public interest groups. Crowley offers an unflinching analysis of the fathers' rights groups in America, surveying the internal dynamics, functions, and make-up of these groups. Combining statistical data and interviews, Crowley is able to create a thorough study that should prove invaluable to scholars in the fields of public policy, child custody law, and organizational behavior.

Defiant Dads not only examines the functions and structure of the fathers' rights groups, but also discusses the groups' efforts in affecting public policy. How have these groups fared in the public sphere and what implications might their efforts have on the social and economic well-being of children and mothers of divorce? Crowley's book details the father's frustrations with the current system, assesses the risk involved in implementing new policies, and poses potential directions to help resolve the present day dilemmas surrounding fathers' rights to custody, singles mother's well-being, and the best interests of children of divorce.

This is a timely and unique study that is a must for any public policy collection.

1-0 out of 5 stars Don't Bother Buying This Book
This book is a total sham. If I wanted to take in this much feminist garbage I'd call my husband's ex-wife; who has gone so low in the past as to DENY us visitation and threatened to calls the cops if we didn't give her money in ADDITION to the court ordered amount (which she always received on time). Yes you read that right!! If using your child for extortion isn't offensive to some of you then I don't know what is.

This book does NOTHING to make anyone aware of what fathers and their new families go through in REAL divorces. It figures she married the socialist Allan Colmes, need I say more?

5-0 out of 5 stars DEFIANT DADS, A DEFINING WORK
Dr. Jocelyn Elise Crowley has written a defining work on the subject of father's rights in this country. The academic precision with which she approaches this subject is dazzling. The depth of the research, coupled with its balanced presentation, resulted in an informative and thought-provoking book.

A staggering number of children are living with one parent. It is the desire to have both parents of one-parent households act in the best interest of these children that stands out as the goal that Dr. Crowley would like to see achieved.

As one would expect, fathers are shown in both positive and negative lights. Some fathers are not emotionally or financially able to positively impact their children's lives.Others, with the best intentions, are thwarted by vindictive mothers. However, the overriding message is that the father's rights groups can and do accomplish much of what they set out to do, and are in a unique position to accomplish a lot more.

Kudos to Dr. Crowley.

5-0 out of 5 stars custody tends to be economically based
This book is fair and comprehensive and, thankfully, free of feminist cant and propoganda. I learned much even though I know the material fairly well. My major insight was that custody has always been based on finding someonewho will support the child, indentured servant or divorced wife and protectthe State from having to pay. The change from father custody to mothercustody has forced the State to become increasingly effective at requiringthe parent with money to give the money to the other parent, allowingcustody to be given to the less economically viable parent.

3-0 out of 5 stars Excellent Research & Flawed Conclusions
Mason covers the history of legal custody with the exacting detail of a trained scholar. However, her conclusion that the "best interest of the child," is best served without regard for the best best interest of the parent will give an entire new generation of judiciary the opportunity to vacate parent's civil rights in favor of their children and the state.

Her idea of giving each child in a divorce their own legal representation will most certainly serve the best interests of attorneys everywhere, while leaving middle-class parents pennyless in their pursuit of justice.

For legal education and precedent this book rates a 10.For the long-term health of civilization, it deserves a 0. ... Read more

Product Description
How can international human rights law be used to help protect children at risk for sexual abuse? Should the definition of sexual abuse be allowed to differ among cultures? Should a country intervene in the internal workings of another with whom they disagree about approaches to the issue? What do notions of rights and law mean, and how could they be developed without placing more children at risk for abuse?

This book begins the process of addressing these and other issues as it considers how human rights law can help detail what could and should be done to protect children from sexual maltreatment. Roger Levesque places particular emphasis on the ways in which abusive activities in different countries and societies are linked with one another and the way diverse societal views of children place them at risk. Throughout, Levesque brings together several intersecting debates in social science and law, as he pragmatically considers human rights law as a tool for combatting child sexual maltreatment. ... Product Description
This book is the first to compare the primary child care legislation of a developed and a developing jurisdiction influenced by English juristic ideas. The empirical findings are indicative that there is more than one specific conceptualisation of children's rights; to ensure provision, protection and/or participation rights of the child. Children's rights have become a universal concept however; limited literature exists comparing how the concept is implemented in different jurisdictions. Further, whilst literature abounds on how children perceive their rights, less is known on the views of those with the responsibility for ensuring the welfare of children. This book fills such a gap, by providing an insight into how the abstract concept of children's rights is operationalized by child care professionals in two jurisdictions, Northern Ireland and Ghana. ...
