Product Description

Intellectual property law's influence extends to every aspect of human life. The markings on a can of Coca-cola, the rights in the books, music, pictures, drama, films and electronic information sources we all use, even the shape of our pen, architecture and the science behind the latest attempt on space exploration all form its subject matter. This popular text explains and examines the often complicated law which protects and preserves new ideas and outlines how intellectual property rights allow right owners to stop others taking their creations.

The changes in the new edition reflect this rapidly expanding field. This textbook includes:

  • amendments to major decisions from the House of Lords and the European Court of Justice
  • recent legislation such as the Patents Act 2004
  • the effect of developments in information technology on copyright and patent principles
  • recent case law including Kirin-Amgen Inc v Hoechst Marion Roussel Ltd and British Horseracing Board Ltd v William Hill Organization
  • the impact of UK, EC and EU competition laws on intellectual property rights
  • a new chapter devoted to protection for image
  • new coverage relating to domain names
  • an examination of the increasing attention to human rights in intellectual property law.

This thoughtful and thought-provoking text is essential reading for any student of intellectual property law. With further reading at the end of each chapter, it is the ideal introduction to a thorough understanding of intellectual property law.

Product Description
Intellectual property law in Australia has changed dramatically in the last decade and continues to change. Developments in technology, the rise of the internet, the globalisation of trade and the increasing importance of 'superbrands' or trade marks with global appeal have all impacted on the laws surrounding intellectual property. Furthermore, globalisation has resulted in greater pressure to expand the rights of intellectual property owners as they endeavour to capture the potential benefits of ownership in an increasingly affluent and integrated world economy. This book provides a detailed and scholarly insight into Australian intellectual property law. It aims to offer students and legal professionals a detailed discussion of the black-letter aspects of the law, with the primary emphasis on the legal principles and complexities within. ... Product Description
`Professor Ghidini has long since made himself a worldwide reputation as a leading scholar. He is a profound critic of intellectual property protection that follows rigid property logic, and favours the functionalist competition/innovation logic. Innovation, Competition and Consumer Welfare in Intellectual Property Law is truly enriching reading.'
- Hanns Ullrich, College of Europe, Bruges, Belgium

`We in the United States have much to learn not only from Gustavo Ghidini's careful analysis of modern trends in the European IP regime but also from his thoughtful development of the thesis that free competition should be understood as the overarching principle guiding both IP protection and what we call antitrust law.'
- Rudolph J.R. Peritz, New York Law School, US and author of Competition Policy in America

This authoritative book provides a comprehensive critical overview of the basic IP paradigms, such as patents, trademarks and copyrights. Their intersection with competition law and their impacts on the exercise of social welfare are analysed from an evolutionary perspective.

The analyses and proposals presented encompass the features and rationales of a legal field in constant evolution, and relate them to increasingly rapid technological, economic, social and geo-political developments. Gustavo Ghidini highlights the emerging trends that challenge the traditional `all-exclusionary' vision of IP law and its application. The author expertly combines holistic, evolutionary and constitutionally oriented approaches, with the search for a rebalancing of the IP rights holders' positions with citizens' and users' rights.

This book will appeal to academics, scholars and lawyers specializing in the realm of intellectual property, competition and comparative law. ... Read more

In part, it examines why intellectual property law with its subcategories of patents, copyright, designs and trade marks took the shape that it did over the course of the nineteenth century. In addition the authors deal with ways in which the law grants property status to intangibles and describe how the law came to create techniques that enabled it to recognize protectable intangibles, and the inescapable problems that have arisen from their use. ... Product Description
`Dutfield and Suthersanen have skillfully captured in one concise volume all the important things you need to know about international intellectual property law. The materials are accessible, timely, methodically presented and at times critical. The book's detailed, in-depth and comparative analyses provide helpful insights into the increasingly complex international intellectual property system. Global Intellectual Property Law is not only an effective textbook for students interested in the subject, but a desktop companion for policymakers and professionals who need a quick and up-to-date overview of global intellectual property issues.'
- Peter K. Yu, Drake University, US and Zhongnan University of Economics and Law, China

`Dutfield and Suthersanen have succeeded in writing an engaging treatise that offers a truly modern perspective on intellectual property today. With examples from every continent, from every level of jurisdiction (national, regional, international), their study covers all the traditional fundamentals of intellectual property law as well as the current critical interrogations that their development raises. It is a book with character.'
- Ysolde Gendreau, Université de Montréal, Canada

`Global Intellectual Property Law by Dutfield and Suthersanen provides a broad overview of the issues at stake concerning fair and effective ways to organize the information resources upon which the well-being of us all depends. The book highlights international and comparative perspectives on IP law and policy. Although primarily targeted at postgraduate level students, the book is enlightening also for practitioners, and a must-read for all policy makers and opinion leaders in the IP field.'
- Thomas Dreier, University of Karlsruhe, Germany

Globalization of trade means that intangible informational resources are now produced, bartered and consumed anywhere and everywhere defying jurisdictional borders. Intellectual property has moved into the mainstream of national economic and developmental planning; in the recent past it has also emerged as the central impetus in multilateral trade relations. The authors of this original and progressive textbook trace the evolving remits of intellectual property, which are rapidly expanding to embrace new subject matter and increase the scope of protection. This creates conflicts with current trade, development, cultural, ethical, human rights and economic mores.

This book reflects on intellectual property as it stands at the crossroads of these values. It considers the challenges presented by such developments as the commodification of persona, the commons, and life itself. Most significantly perhaps, the book examines the impact of intellectual property on the international stage, especially in respect of trade, development, economics and biological and cultural diversity. It is sure to become an invaluable reference work for scholars and students of intellectual property, international law, public policy, politics, government, human rights and development, as well as legal practitioners.

Product Description
`This book's innovative contribution is to view EU IP law as a subject in its own right, not just an extra to accounts of national law. The very up-to-date coverage strikes an excellent balance between detail and overview, while Dr Seville also discusses thoughtfully the wider international frameworks, policy issues and debates in which development of EU IP law is enmeshed. Dr Seville fully deserves the gratitude of IP lawyers and students for this outstandingly helpful study.'
- Hector Macqueen, Edinburgh Law School, UK

`The book is as timely as it is well-written and thorough. The contributions of the EU to most aspects of intellectual property law are increasingly dominant. This treatment places them apart from the national laws of member states, thus emphasising the common core that now they provide. Many will want to study this presentation.'
- William R. Cornish, University of Cambridge, UK

Intellectual property (IP) is a crucial contributor to economic growth and competitiveness within the EU. This book offers a compact and accessible account of EU intellectual property law and policy, covering copyright, patents, designs, trademarks and the enforcement of rights. The author also addresses aspects of the free movement of goods and services, competition law, customs measures and anti-counterfeiting efforts.

Setting EU intellectual property law in its wider international context, this work reveals the framework within which the national IP laws of member states operate. The book seeks to highlight the most important policy issues and arguments of relevance to the EU, both within the Union, and in its relations with the rest of the world.

With its detailed references, cross-referencing and suggestions for further readings, EU Intellectual Property Law and Policy is essential reading for postgraduate students and academic lawyers in IP and EU law. Practitioners seeking a broad account of the area will also appreciate this important contribution. ... Read more

4-0 out of 5 stars Important read for IP junkies
With China joining the WTO at the end of last year it has become more important for Westerners to understand this aspect of Chinese society. Under the WTO, China is obligated by the rules of the TRIPs Agreement (Trade Related aspects of Intellectual Property)amongst other traditional trade rules.
To join the world trading community, China has obligated itself to enforce intellectual property rights (Copyright, Trademark, and Patent protection)
This book traces the long Chinese history of these rights and gives an important insight into the cultural differences that exist and are ingrained in Chinese society compared to an almost reflexive understanding of these rights in the West.

`Here it comes: the book that I have been waiting for! This will surely be an inspiring source of knowledge in my Master Programme in European Intellectual Property Law at Stockholm University. While promoting intellectual property protection as an important means for innovations and cultural developments, a critical analysis and a flexible approach to the needs for free creative space and effective competition is crucial. As this book so well illustrates, this delicate balance is no either or.'
- Marianne Levin, Stockholm University, Sweden

This comprehensive Handbook brings together contributions from American, Canadian, European, and Japanese writers to better explore the interface between competition and intellectual property law. Issues range from the fundamental to the specific, each considered from the angle of cartels, dominant positions, and mergers. Topics covered include, among others, technology licensing, the doctrine of exhaustion, network industries, innovation, patents, and copyright.

Appropriate space is devoted to the latest developments in European and American antitrust law, such as the `more economic approach' and the question of anti-competitive abuses of intellectual property rights. Each original chapter reflects extensive comments by all other contributors, an approach which ensures a diversity of perspectives within a systematic framework.

These cutting edge articles will be of great interest to law professors and post graduate students of intellectual property and competition law, as well as those interested in innovation and competition theory, and legal practices in intellectual property and competition law. ... Read more
