Product Description
The interface between intellectual property rights and competition policy is one of the most important and difficult areas of EU commercial law. The exploitation of exclusive rights can conflict with competition law, which aims to preserve competition as the driving force in efficient markets. These conflicts have to be resolved against the background of a complicated relationship between EU law, national laws and international treaties relating to intellectual property. There have been major developments recently in this area, including the new Technology Transfer Block Exemption, the Commission's Guidelines on Technology Transfer, and cases such as IMSand Microsoftconcerning the circumstances in which exploitation of intellectual property rights is an abuse of a dominant position.

This book contains a detailed explanation of the application of EU competition law to all types of intellectual property, including recent developments, and the resulting regulatory framework for the exploitation and licensing of intellectual property rights. It has practical analysis of such issues as technology transfer and pools, research and development, and franchising and merchandising.

It derives from a section in the looseleaf Law of the EU (Vaughan & Robertson, eds), and is made available here for the benefit of those who do not subscribe to the looseleaf. ... Read more

5-0 out of 5 stars An American vision
Intellectual property is a complex issue, and most books on the subject deals mostly on the legal practice or economic aspects of the matter. This academic-intended volume has virtually all basic texts needed to understand the core problems of the subject, and is a precious help to serious students and researchers. A treatment of the International problems related to the matter and some further discussion of the crucial theme of public domain would be recommended in a future edition. But, alas, it is a precious work, and I have included it and the basic bibliography of my graduate IP courses in Brazil.

5-0 out of 5 stars Ars eligendi
The book edited by Profs. Merges and Ginsburg is, without being rethoric, simply an extraordinary reading, a powerful and very enjoyable tool that is to help all of us in addressing and discovering the most important literature on U.S. Intellectual Property in the best way. References on economic/market issues concerning copyright and digital technology are abundant and thought-provoking as well as the reported (and still open!) debate about the appropriateness of current patent, trademark and industrial design protection. I'm sure that everyone interested in improving his or her understanding on the complex world of IP may greatly benefit from the readings such a powerful guide provides.

Product Description
Derived from the renowned multi-volume International Encyclopaedia of Laws, this monograph provides a survey and analysis of the rules concerning intellectual property rights in China. It covers every type of intellectual property right in depth – copyright and neighbouring rights, patents, utility models, trademarks, trade names, industrial designs, plant variety protection, chip protection, trade secrets, and confidential information. Particular attention is paid throughout to recent developments and trends.

The analysis approaches each right in terms of its sources in law and in legislation, and proceeds to such legal issues as subject matter of protection, conditions of protection, ownership, transfer of rights, licences, scope of exclusive rights, limitations, exemptions, duration of protection, infringement, available remedies, and overlapping with other intellectual property rights.

The book provides a clear overview of intellectual property legislation and policy, and at the same time offers practical guidance on which sound preliminary decisions may be based. Lawyers representing parties with interests in China will welcome this very useful guide, and academics and researchers will appreciate its value in the study of comparative intellectual property law.

Product Description
International intellectual property law is a vast andburgeoning field that no single author can cover. This book collectsand organizes works by some of the best current authors in the field,supplementing their work with numerous essays and notes prepared bythe editors. A comprehensive Appendix provides the controllingprovisions of the major treaties in the field. The book's organization follows the theories underlying the protectionof international intellectual property rights. For example, theeditors have considered the historical and philosophical foundation ofcopyright protection in the context of the protection of culture andpersonality, while using examples drawn from patent protection toillustrate issues regarding compulsory licensing to ensure public useof certain forms of intellectual property. Numerous diverse examplesfrom intellectual property protection address the difficult, emergingproblem of `harmonization' -- the alignment of nationallegislation through unilateral effort and bilateral and multilateralunderstandings among nations. International Intellectual PropertyLaw also includes coverage of the protection of cultural patrimony,a closely related field sometimes excluded from works on internationalintellectual property. International intellectual property law issues offer no easysolutions. Differences in culture and economic development do notmiraculously disappear as technology and communications shrink theworld. The editors anticipate that the issues highlighted in this bookwill remain a source of contested legal accommodation as nationscontinue to struggle with the question of what norms, if any, shouldbe established and secured for the protection of intellectual propertyrights. The complexity of these issues and the authoritativeness andunique features of International Intellectual Property Law makeit a resource of lasting value. ... Read more

Product Description
For this comprehensive collection, the editor has brought together key readings on the subject of the law and economics of intellectual property rights - patents, copyrights and trademarks. It provides a judicious selection of the most important published research on this most crucial topic, drawing equally from the law review and economics literature. It thus brings together classic articles often referred to and cited, but rarely encountered in a single published source.The articles have been selected on the basis of three primary criteria: their continuing influence in legal and economic discussions; their longevity (important in a field where the volume of published work is very large and growing very quickly); and, their relevance to contemporary theoretical and policy debates. The chosen writings delve deeply into theory, empirics, and institutional detail, ranging from Edwin Mansfield's early, influential study on patents and imitation costs, to very recent work on the relationship between copyright law and the first amendment. This collection makes an indispensable desk reference for scholars of intellectual property rights. ... Read more

Product Description

The original text of the Constitution grants Congress the power to create a regime of intellectual property protection. The first amendment, however, prohibits Congress from enacting any law that abridges the freedoms of speech and of the press. While many have long noted the tension between these provisions, recent legal and cultural developments have transformed mere tension into conflict. No Law offers a new way to approach these debates.

In eloquent and passionate style, Lange and Powell argue that the First Amendment imposes absolute limits upon claims of exclusivity in intellectual property and expression, and strips Congress of the power to restrict personal thought and free expression in the name of intellectual property rights. Though the First Amendment does not repeal the Constitutional intellectual property clause in its entirety, copyright, patent, and trademark law cannot constitutionally license the private commodification of the public domain.

The authors claim that while the exclusive rights currently reflected in intellectual property are not in truth needed to encourage intellectual productivity, they develop a compelling solution for how Congress, even within the limits imposed by an absolute First Amendment, can still regulate incentives for intellectual creations. Those interested in the impact copyright doctrines have on freedom of expression in the U.S. and the theoretical and practical aspects of intellectual property law will want to take a closer look at this bracing, resonant work.

Product Description

Perhaps no Asian country currently attracts more interest from foreign inventors and investors than China. In many cases, however, this avid interest in foreign investment is not based on a reliable knowledge of China's legal framework and of protection of technology in particular. In a jurisdiction where the laws are complemented and interpreted by numerous guidelines and circulars issued by ministries or courts, such knowledge and awareness is all the more important.

Intellectual Property Law in China provides comprehensive coverage of all aspects of intellectual property protection in China, emphasising particularly those issues of most concern to foreign investors: protection of well-known marks, issues of technology transfer, and, most important of all, actual enforcement of IP rights. The book is written by two outstanding experts on IP in ChinaPeter Ganea, head of the Max Planck Institute's China department, and Thomas Pattloch, now a practicing attorney in Shanghai and previously involved with the EU-China IP programme. The book thus combines practical knowledge with academic standards.

The book contains the following chapters:

  • Patents and related rights such as utility models and designs;
  • Trade marks and related rights, including unfair competition, well-known marks, and domain names;
  • Copyright;
  • Technology transfer;
  • Enforcement; and,
  • Comments on the draft Anti-Trust Act.

    Intellectual Property Law in China is essential for all companies investing in China or considering such investment, as well as for private practitioners counseling their clients on potential strategies such as registration or technology transfer.
