Extractions: United States of America BEFORE THE FEDERAL SERVICE IMPASSES PANEL In the Matter of DEPARTMENT OF EDUCATION OFFICE FOR CIVIL RIGHTS KANSAS CITY, MISSOURI and ED LOCAL 3892, AMERICAN FEDERATION OF GOVERNMENT EMPLOYEES, AFL-CIO Case No. 01 FSIP 203 DECISION AND ORDER ED Local 3892, American Federation of Government Employees, AFL-CIO (Union) filed a request for assistance with the Federal Service Impasses Panel (Panel) to consider a negotiation impasse under the Federal Service Labor-Management Relations Statute (Statute), 5 U.S.C. § 7119, between it and the Department of Education, Office for Civil Rights (OCR), Kansas City, Missouri (Employer). Following an investigation of the request for assistance, arising from negotiations over an office move, the Panel determined that the dispute should be resolved through an informal conference with a Panel representative. The parties were advised that if no settlement was reached, the Panel representative would report to the Panel on the status of the dispute, including the parties final offers and her recommendations for resolving the issues. After considering the report, the Panel would take whatever action it deemed appropriate to resolve the impasse, including the issuance of a binding decision. Pursuant to the Panels determination, Supervisory General Attorney Ellen J. Kolansky met with the parties on November 15, 2001, at the Panels office in Washington, D.C. When the parties failed to settle their dispute, they each submitted their final offers, the Employer submitted a statement addressing the Panels jurisdiction, and both submitted summary statements of position; the Union responded to the Employers position on jurisdiction in its summary statement. Mrs. Kolansky has reported to the Panel, and it has now considered the entire record.

The three priorities are: As part of their work on the first priority, improving student achievement, KLFA distributed the national Alliance's publication, Every Child Reading: An Action Plan, to every pre-K through third grade teacher in Kansas, with funding from the Ewing Marion Kauffman Foundation and provided workshops throughout the state on how to improve reading achievement. They also created materials for local-level training, including a CD-Rom and example handouts based on the Alliance's Action Plan. In an effort to address the achievement gap in math, KLFA has recently been awarded another grant from the Kaufman Foundation to conduct a study with the State Dept. of Education during the 2002-03 school year to find the causes for the achievement gaps among Kansas' students. The findings will be used to determine actions KLFA organizations will undertake to ensure that every child becomes mathematically proficient. KLFA has made a significant effort to strengthen the professional development of educators by working with state leaders including: the Kansas State Board of Education and legislators to increase funding, and with the Kansas Department of Education in writing regulations. Recently KLFA, which includes leadership from the State Department of Education, developed a set of rubrics to assess the quality of professional development that was adopted by the State Board of Education.

Legislators should listen raptly, even if Ballesteros grows timid. They are considering a bill to give the 17-year-old and others like her a better chance at a college degree. The House has already passed a version of the bill. The bill would allow Ballesteros to pay in-state college tuition in Kansas, rather than the out-of-state rates that can be as much as three times higher. Evamaria, her parents and younger sister are from Chihuahua, Mexico. She would pay the higher tuition because she is considered a foreign student. But the family has lived in Olathe for five years. They are in the country legally. They pay taxes, live and work, just like a lot of families with graduating seniors.
