Yet, when it comes to the United States' relations with American Indian tribes, the shoe is on the other foot.After the its near decimation of the Indians, the federal government has humanely and wisely recognized the sovereignty of Indian tribes on U.S. territory.The tribes, of course, are not the only sovereign "substates" within the U.S.For example, the fifty several states share a similar status, as do U.S. territories.The several states, however, were present at the Constitutional Convention and were parties to the mutuality of concession that makes the states' limited surrender of sovereignty permissible.By contrast, the Indians were not at the Convention.The Supreme Court has therefore rightly recognized that parallels should not always be drawn between the sovereignty of the several states and that of tribes.Tribal sovereignty is special. But is this tribal sovereignty now especially fearful to the U.S. government, given the recent diminishing financial reliance of tribes on the government's purse strings?This query is precisely what budding scholar, David Kamper, astutely raises in the introduction to "Indian Gaming:Who Wins?"For so long, the marriage of sovereigns in this country rested on the comfort (from the government's perspective at any rate) that Indian tribes will not bite the hand that feeds them?With gaming and other revenue sources on the up and up, Mr. Kamper argues that the government no longer feels so comfortable in relation to the tribes.
