By Craig Anderson/Daily Journal Staff Writer In the first-time attempt to invoke the recently signed federal law limiting year 2000 lawsuits, a group of national retailers accused of unfair business practices for selling software that might not work properly next year has removed the class action complaint to federal court. "We think it will get a closer look [in federal court]," Phillips said. "It clearly falls under the [Y2K] act." The Y2K law, approved after intense lobbying by the software industry, mandates a 90-day cooling off period to give defendants an opportunity to correct any problems before litigation can be filed. Phillips said that clock should have started running Thursday, when the case was removed to Federal court. Jones said Staples' removal of the case to federal court is a bid for tactical advantage in the ongoing settlement discussions.

Federal agents will have access to the necessary tools to enforce our laws and there will be no interruptions in our law enforcement efforts due to computer malfunctions. "As Congressman Horn noted today, three of the Department's mission critical systems, one in the FBI, another in DEA, and a third in the Tax Division, have not been reported as Y2K compliant. All three are office-automation systems that provide basic word processing and administrative systems support and have been successfully deployed in individual offices at headquarters and in field offices. Each system has cleared Y2K testing and validation procedures, but until all the systems have been fully deployed to every office, the Department of Justice does not declare a system to be Y2K compliant. All three systems are expected to be fully deployed and implemented by mid-December. While many of us have heard about the "Y2K" problems, none are certain exactly what will take place and how we will be affected. NATURE OF Y2K PROBLEM A great deal of computer software was designed to recognize years by just the final two digits rather than all four. Many computer systems that use a two-digit dating system assume that the two digits of the year are 1 and 9. Without reprogramming, these systems will recognize not as 2000 but as 1900. These computer systems, that have not been reprogrammed, could stop functioning or could shut down beginning at 12:01 a.m. on 01/01/2000. Why did the computer industry originally use a two-digit dating system? Memory and space were initially very expensive. In an effort to save money, computer programmers used only two numbers in the date field to represent the year rather than the four. Continued sale of non-compliant Y2K products: Programmers who developed the two digit standard, forty to fifty years ago, claim that they did not anticipate that their work would last until the year 2000.

Without banks, water, sewers, communications, and electrical power, cities will become nightmares. Under such conditions, the Federal government would have to declare martial law. The question is: Could the Army carry out its assignments? It, too, is noncompliant. Its systems are vulnerable to y2k. There are indications that the U.S. government is preparing for martial law. Under the cover of the phrases "critical infrastructure protection" and "cyberterrorism," the government is setting up rapid deployment forces designed to provide order in American cities. The two politically convenient facts about about cyberterrorism are these: (1) the timing is not specific; (2) the target is not specific. This keeps panic from occurring. "It's the other guy's statisically remote problem." Or: "I'm prtobably OK; you're probably OK." This is why "cyberterrorism" serves as a code work for "Year 2000 breakdown." The problems with y2k are the reverse: (1) it is date-specific; (2) it hits everywhere at once. No cyberterrorist or hacker could dream of doing what y2k has been programmed to do. Plans to impose martial law have been in effect since late 1997. The training is the same, so the public will not be alarmed. The Army has created special emergency response divisions made up of National Guard units and Reserve units. But the plans seem to have begun with an Executive Order signed by President Clinton in July, 1996, which set up the Presidential Commission on Critical Infrastructure Protection (PCCIP).
