Extractions: The Independence Constitution signed at the Lancaster House Conference in 1979, together with 16 amendments, is the fundamental law which determines Zimbabwes governmental structure. A new constitution proposal was rejected by the electorate in the February 2000 referendum. The Constitution provides for three arms of government, namely the Executive, the Judiciary, and the Legislature. There is a Cabinet consisting of the President, two Vice-Presidents, and Ministers appointed by the President. Ministers are accountable to the President and are members of Parliament. The Executive The President is head of state and government, and commander-in-chief of the Defence Forces. He must be a Zimbabwean citizen by birth or descent, aged 40 or above, and resident in Zimbabwe. The President is elected for a six-year term by all the registered voters, and may be re-elected for any number of further terms. The constitution provides for two Vice-Presidents at a time, appointed by the President, and whose functions include assisting the President to discharge his executive responsibilities. Colin Cloete, the president of the Commercial Farmers' Union (CFU), which represents most of Zimbabwe's white farmers, said by the end of last week, charges had been withdrawn against at least 41 farmers. "So far six farmers in Beitbridge, 14 in Nyamandlovu, two in Mutare and 14 in Marondera had their cases withdrawn," said Cloete, whose case, together with that of four Chegutu farmers, has also been dismissed.

The government owes more than US$4.5 billion to several multilateral institutions and Western countries. These include the African Development Bank, the European Investment Bank, the World Bank, the United States of America, Britain, France Germany and Finland. The governments domestic debt stands at more than $123 billion. While in the past year the government had struggled to meet its debt obligations, with repayments to some creditors being halted last year, it had maintained payments to the IMF. Top foreign and local financial officials this week said Harare had now virtually frozen all debt servicing in yet another sign of its rapidly deteriorating economic and foreign currency crises. Defaulting on IMF debt is the last step that is taken only by the most financially desperate of governments.

They say it is possible to raise funds through other means than a levy announced by Finance Minister, Herbert Murerwa, when he presented the 2000 budget in parliament last October. They say the funds should be derived from direct government budget allocations and from cuts from defence spending. Funds can also come from a share of the proceeds of the sale of publicly listed companies and from a share of taxes on market and foreign exchange transactions. The AIDS levy three percent deducted on payable income has met strong opposition from various sectors not convinced the money would be spent for addressing the plight of people living with AIDS. With a raging war in the Democratic Republic of Congo (DRC), where Zimbabwe has deployed 11,000 troops, the groups and taxpayers dismissed the levy as another attempt by the cash- strapped government to fund the conflict which is costing the Harare administration more than one million U.S. dollars a month.

Life expectancy has dropped to less than 41 years, compared to 70 years before the epidemic. Given this context, the May 27th decision by the Zimbabwean government to declare a state of national emergency is more than welcome. Médecins Sans Frontières (MSF) fully supports this action, which will allow Zimbabweans to use generic antiretroviral drugs even if they are under patent in the country. "The government has decided to override patent protection on antiretrovirals and use generics - this means that the price of the first-line AIDS cocktails recommended by the World Health Organization will plummet from US$1,168 to 412 (*see footnote)," said Carmen Pérez Casas, pharmacist coordinator at the MSF Access Campaign. "Although prices are just one barrier to overcome to increase access to antiretrovirals, this measure will allow available resources to treat more than twice as many patients". Zimbabwe's announcement marks the first time that a government has gone beyond using the threat of compulsory licensing as a negotiating tool, and actually declared that it will override patents to increase access to needed medicines when the prices are too high as a result of patent protection.
