SECURITIES EXCHANGE ACT OF 1934
Rel. No. 46991 / December 13, 2002 Admin. Proc. File No. 3-10518
In the Matter of the Application of FRANK THOMAS DEVINE
c/o David A. Genelly, Esq.
401 South LaSalle Street, Suite 1302
Chicago, Illinois 60605C. For Review of Disciplinary Action Taken by the NATIONAL ASSOCIATION OF SECURITIES DEALERS, INC. ORDER DENYING MOTION FOR RECONSIDERATION On October 30, 2002, the Commission sustained disciplinary action by the National Association of Securities Dealers, Inc. ("NASD") against Frank Thomas Devine, who was formerly employed as an investment company and variable contracts products representative with U.S. Life Equity Sales Corp. ("U.S. Life Equity"), an NASD member firm. Devine now requests reconsideration of the sanctions imposed. The Commission found that Devine had engaged in private securities transactions without giving prior written notice to U.S. Life Equity in violation of NASD Conduct Rules 3040 and 2110. The Commission sustained the sanctions assessed by the NASD, fining Devine $34,825.42, suspending him for 90 days from association with any NASD member in any capacity, and requiringthat he requalify by examination as an investment company and variable contracts products representative. The NASD also assessed costs against him. Devine alleges that our opinion erred in concluding that the sanctions imposed by the NASD were neither excessive or oppressive. As he did initially, Devine asserts that the bulletin from U.S. Life Corp.'s insurance subsidiary, All American Life Insurance Company ("All American"), was ambiguous as to whether U.S. Life Corp.'s representatives were permitted to sell viatical settlement products to persons who were not All American customers. Our opinion noted that the NASD considered the bulletin to be a mitigating factor when it sanctioned Devine and that we did not see any reason to reduce his sanction further.

Big Hurt Baseball not quite ready for the big leagues.
Frank Thomas Big Hurt Baseball promises enhanced realism hi-res graphics, rendered stadiums, realistic sound effects including a play by play announcer and umpire calls, and lots and lots of stats. The selling point is that the well known Frank Thomas is a demanding player, especially when it comes to computerized baseball games. And according to Iguana/Acclaim "Whatever Frank wants... Frank gets." But after playing Big Hurt Baseball, I tend to think that either Frank Thomas isn't demanding enough or that he hasn't played enough of the competing games like HardBall 5 or Triple Play '97. At first sight, Big Hurt Baseball looks exciting. The intro screen and all the game menus have appealing 3D bevels. The 28 3D rendered playfields are charming. Stadium outfields have a realistic just-mowed look. Each stadium has a unique skyline with distinct lighting effects for day and night games. And behind each stadium are the tops of the city skyscrapers. Various camera angles and flyby animations enhance the game's 3D atmosphere. For example, when a ball is hit to the outfield, the camera will follow the ball to the outfield, and at the end of an inning the game shows the current score by panning the camera away from the pitcher and flying it up to the real-world scoreboard, wherever it may be in the current stadium.

Frank Thomas Papers
MS-653
Introduction The Frank Thomas Papers, although small, is a good representative collection of political campaigns and issues, pertaining largely to Wood County and Ohio, during the early part of the twentieth century. The collection includes correspondence, a number of printed materials, and photographs. The collection was donated to the Center for Archival Collections by Robert and Gibbie Harms, on September 11, 1992. There are no restrictions on the use of this collection and duplication is permitted for research purposes. Biographical Sketch Frank Thomas (1873-1950) was born in Hancock County. When Frank was eight, the family moved to Bowling Green. Because of his father's frail health, Frank left school to assist in supporting his family. He was a newsboy for both the Toledo Blade and the Toledo News-Bee, and was the first messenger for the Toledo and Indiana Railroad Company (later the New York Central line). He also worked in the glass factories in Bowling Green and finally in 1891 was hired by the Wood County Democrat in the print shop. Within two years he became foreman of the shop. In 1911, he and a fellow worker, David VanVoorhis, purchased the newspaper, and by 1924, Thomas had purchased his partner's share in the business. He ran the newspaper as editor and manger until selling it in 1928.

Frank Thomas's Season Ends
by Dana Gorman
If you are a believer in baseball karma, then the news that Frank Thomas will be out for the rest of the 2001 season with a triceps injury should not be a surprise. After much publicized preseason contract disputes and fights with the organization, the Chicago White Sox's All-Star first baseman was hoping to prove that he wasn't all about money. But now he will have to wait until next year to prove his point. This has been a tough week for Thomas, who is still recovering from the death of his father earlier in the week. "Sometimes, things in life can get worse," Thomas said. "This has been a really bad week, losing my father, who was my best friend, and then to come back and this happens. It's a character builder."
Thomas after his injury. 'Sometimes, things in life can get worse,' Thomas said. 'This has been a really bad week, losing my father, who was my best friend, and then to come back and this happens. It's a character builder.' The 32-year old Thomas will have surgery to reporn his torn triceps next week, an injury he sustained in a rare appearance at first base against the Mariners on April 27th. He went to dive for a ball, and injured himself in the process. He had played in 20 games before the injury, hitting 4 homeruns and collecting a modest 10 RBI's. His offseason troubles made many forget about what a tremendous 2000 season that Thomas had. He batted .328 with 43 homers and 143 RBI. The bad publicity Thomas received was because he skipped 6 days of voluntary training camp because of a dispute in one of the clauses of his contract.

The Structure of Scientific Revolutions
by Thomas S. Kuhn Outline and Study Guide
prepared by Professor Frank Pajares
Emory University
Chapter I - Introduction: A Role for History.
Kuhn begins by formulating some assumptions that lay the foundation for subsequent discussion and by briefly outlining the key contentions of the book.
  • A scientific community cannot practice its trade without some set of received beliefs (p. 4). These beliefs form the foundation of the "educational initiation that prepares and licenses the student for professional practice" (5). The nature of the "rigorous and rigid" preparation helps ensure that the received beliefs exert a "deep hold" on the student's mind. Normal science To this end, "normal science often suppresses fundamental novelties because they are necessarily subversive of its basic commitments" (5). Research is "a strenuous and devoted attempt to force nature into the conceptual boxes supplied by professional education" (5). A shift in professional commitments to shared assumptions takes place when an anomaly "subverts the existing tradition of scientific practice" (6). These shifts are what Kuhn describes as

HICAGO — The telephone rings. It does not chirp or beep, it rings — an actual clapper strikes brass bells and the 1940's Bakelite body shudders — like a voice from another time, like a wake-up call. Thomas Frank answers. He has been waiting, here in his home office in the Hyde Park neighborhood. On the other end of the line is an interviewer from a National Public Radio station at the University of Illinois Urbana-Champaign, ready to fill an hour with a phone-in discussion of Mr. Frank's new book, "One Market, Under God: Extreme Capitalism, Market Populism and the End of Economic Democracy" (Doubleday). In a sweeping, savage and witty indictment of American business, Mr. Frank, 35, slams the notion that the 1990's lived up to the promise of the new economy — a sensibility summed up by commercials for WorldCom that ask, "Is this a great time, or what?"

    Dana-Thomas House
Springfield's Dana-Thomas House is the best preserved and most complete of Frank Lloyd Wright's early "Prairie" houses. The structure has changed little since its contruction in 1902-04 for Springfield socialite and women's activist Susan Lawrence Dana. More than one hundred pieces of original Wright-designed white oak furniture are still in place along with two hundred fifty art glass doors, windows, and light panels. Two hundred original light fixtures and skylights illuminate the interior. Original sculptures in terra cotta by Richard W. Bock ornament the vestibule and reception hall, and the only George Niedecken mural in any Wright house graces the four dining room walls. The Dana-Thomas House is typical of the Prairie style, which is characterized on the exterior by low horizontal roofs, wide overhanging eaves, and rows of ribbon art glass windows.
