The theories of Alexis de Tocqueville have had a profound effect on the concepts of democracy, penology and crime and punishment. Tocqueville’s historical background deeply influenced his theories. His early experiences and travels to America were instrumental to the forming of his theories. Equality of conditions is a central theme throughout all of his theories. He argued equality is essential to democracy and it is the lack of quality that leads to crime. Critics of Tocqueville cite this reliance on equality as his major weakness. Despite these criticisms, Tocqueville’s theories remain popular 150 years after his death. HISTORICAL BACKGROUND: Alexis de Tocqueville was born in Paris on July 29, 1805. He was born into a noble family from Normandy, France shortly after the French Revolution. Most of his family had been executed during the “Reign of Terror” (Siedentop, 1994: 1). His parents were spared from the guillotine, but imprisoned for several months awaiting execution.

Over one hundred and sixty years since its publication, and Alexis de Tocqueville's Democracy in America remains one of the best books written on the nature of democratic man and the character of democratic society. Blessed with an extraordinary talent for perception, de Tocqueville expertly examined the heart of American democracy, and brilliantly documented the impact of our fundamental principles upon the American world view. A page doesn't go by in either the 1835 or 1840 volumes where de Tocqueville fails to yield splendid insights into the democratic condition. Throughout, he lists both the positive (innocent, optimistic, gregarious) and negative (moralistic, self-centered, racist) aspects of the American ethos with amazing aplomb. In his distinction between individualism and individuality, in his emphasis on the democratic necessity of (and affinity for) strong civic associations, and in his warning concerning the antidemocratic instincts of industry, de Tocqueville deserves to be read by every citizen of our republic. For further reading, M. de Tocqueville also utilized his formidable powers to scrutinize other nations, including his homeland.

About Alexis de Tocqueville

Alexis de Tocqueville was born in Paris on July 29, 1805. Tocqueville's father was a royalist prefect from Normandy who supported the Bourbon monarchy, his great-grandfather was a liberal aristocrat killed in the French Revolution, and his mother was a devout Roman Catholic who strongly advocated a return on the Old Regime. Tocqueville's father's appointments as prefect of different towns meant that he lived away from the family for much of Tocqueville's early life. In his father's absence, Abbe Lesueur was Tocqueville's tutor. At age 16 Tocquevile entered the College Royal in Metz to study philosophy. During this time Tocqueville began to have doubts about the role of the aristocracy in French government and suffered a deep religious crisis that would effect him for the rest of his life. After finishing at the College Royal at age 18, Tocqueville moved back to Paris where he studied law. In the meantime, Tocqueville's father's career had been steadily advancing until, in 1826, he became prefect of Versailles (the most influential prefecture in France) and in 1827 was made a peer by Charles X. At the same time, Tocqueville received a position as apprentice magistrate at the Versailles court of law. During this period Tocqueville began to have increasingly liberal sympathies as a result of his belief that the decline of the aristocracy was inevitable.

Pour cette raison sans doute, il se méfiera toute sa vie des intentions révolutionnaires sans pour autant verser dans un conservatisme à tout crin. De fait, cette méfiance ne l'empêchera pas d'être un libéral engagé, lui qui vivait justement à une époque où la France tentait maladroitement de réfréner la montée des revendications sociales mises de l'avant à la faveur de la Révolution française. Auparavant, le jeune Tocqueville aura toutefois pris soin de poursuivre ses études en droit avant d'être nommé juge auditeur en 1827, à Versailles. L'état de sa société suscite par ailleurs de profonds déchirement chez Tocqueville, le laissant écartelé entre les traditions familiales et ses sympathies naturelles à l'égard d'un système politique plus démocratique, à l'image de celui développé par les Américains depuis 1776. Et cette sympathie était d'autant plus importante que ses lectures de Châteaubriand l'avaient convaincu que la liberté américaine avait plus à voir avec la liberté des Lumières que celle des primitifs dépeinte par Rousseau. Un voyage d'étude de neuf mois aux États Unis, voyage qui devait permettre au juriste qu'il était d'étudier le système carcéral américain considéré par les philanthropes d'alors comme étant le plus évolué de l'époque, allait d'ailleurs lui permettre de vérifier de près les thèses de Châteaubriand. En fait, bien davantage un prétexte pour fuir momentanément son pays où son engagement politique lui vaut quelques inimitiés qu'un véritable voyage d'étude, il profite de son séjour pour cumuler une importante quantité de notes sur la vie politique américaine.

Tocqueville was born July 29, 1805 in Paris . His parents were Herve-Bonaventure Clerel de Tocqueville, a descendant of a noble Norman family, and Louise Le Peletier de Rosanbo, granddaughter of Malesherbes and sister-in-law of Chateaubriand. His older brothers were named Hippolyte and Edouard. He died April 16, 1859 in Cannes . Tocqueville is buried in the village of Tocqueville near Normandy.

by Mike Noble A was one of the greatest political thinkers since the advent of government. He was born in Paris on July 29, 1805. His family was one of the oldest Norman noble families in France. He was the great grandson of the famous statesman ChrŽtien de Malesherbes, and one of his ancestors fought in the Battle of Hastings. His father was a local Royalist prefect, and in 1827 was made a peer of Charles X. A a small man, proud and cold, who suffered from chronic illness and anxiety bouts, he was brought into government service by his father's promotion. As an apprentice magistrate he observed the constitutional confrontation taking place between the liberals and the conservatives, taking sides with the liberals most of the time. There he also observed Franois Guizot, who became one of Tocqueville's primary influences. Guizot observed that the "decline of aristocratic privilege was historically inevitable." Tocqueville became close friends with Gustave de Beaumont, practically a mirror image of himself. Together they traveled to America, and were later elected to the French legislature. In July of 1830 a revolution placed the "citizen king" Louis - Philippe of Orleans on the throne. Tocqueville took this as a sign that France was moving fast to complete social equality. He no longer compared France with the English constitutional monarchy, but with democratic America.
