Louisiana Commission on Human Rights Mission Statement The Louisiana Commission on Human Rights (LCHR) operates under the auspices of LSA 51:2231 et seq., amended and 23:301 et seq., as amended. LCHR handles complaints of employment discrimination based on race, color, religion , sex, disability, age, sickle cell trait, pregnancy, child birth and related medical conditions. Your employer must have a minimum of 20 employees to file a complaint under race, color, sex, national origin, religion and disability in employment discrimination. To file under the basis of age your employer must have 20 employees and you must be age 40 or over, sickle cell trait requires at least 20 employees and pregnancy, childbirth and related medical conditions requires more than 25 employees. The last alleged act involving discrimination must have occurred within the past 180 days. LCHR also provides protection against discrimination in public accommodations and banking and lending. C-95-3022 CRB In this federal court case which began several years ago, individual plaintiffs challenged Government Code section 21417 in the Public Employees’ Retirement Law (PERL) as allegedly violating provisions of the federal Age Discrimination In Employment Act (ADEA). While only a handful of local contracting public agencies have been named in the lawsuit to date, the ultimate conclusion of the case could potentially affect all local employers. Also, local employers will soon receive formal notices from the court regarding the case and their participation in it. The purpose of this circular letter is to summarize the status of the case and its potential effect on employers. GOVERNMENT CODE SECTION 21417 When Section 21417 applies to an industrial disability retirement allowance (IDR), it limits the amount of IDR retirement allowance to the amount that the member would have received had the member continued working until normal retirement age (for example, age 55 for most safety members). That amount may be less than the 50% of final compensation that IDR retirees would receive if the statute did not apply.

Department of Health and Human Services (DHHS) enforces Federal laws that prohibit discrimination by health care and human service providers that receive funds from the DHHS. Such laws include Title VI of the Civil Rights Act of 1964, Section 504 of the Rehabilitation Act of 1973, Title II of the Americans with Disabilities Act of 1990, the Age Discrimination Act of 1975, and the Community Service Assurance provisions of the Hill-Burton Act. MDCR Jurisdiction The Michigan Department of Civil Rights enforces these two state laws: The Elliott-Larsen Civil Rights Act #453, Public Acts of 1976, as amended The Persons with Disabilities Civil Rights Act #220, Public Acts 1976, as amended Because the Elliott-Larsen Civil Rights Act covers some of the same jurisdictions as Title VII of the US Civil Rights Act of 1964 and the Age Discrimination in Employment Act, the Michigan Department of Civil Rights is also authorized to take and investigate complaints under those acts through an agreement with the US Equal Employment Opportunity Commission (EEOC). MDCR also has a similar agreement with the US Department of Housing and Urban Development (HUD) to accept HUD housing complaints under the Fair Housing Act, Title VIII, US Civil Rights Act of 1968, as amended. 'Working after State Pension Age: Quantitative Analysis', published today by the Department for Work and Pensions, found that 76 per cent of men and 71 per cent of women who worked beyond State Pension Age described their health as either 'excellent' or 'very good', compared with only 50 per cent of non-workers. Pensions Minister Ian McCartney said: "I've have always championed the abolition of age discrimination in employment. Employers who write off older workers at State Pension Age, or refuse to consider more flexible work patterns, risk losing a valuable resource, which may well be snapped up by their competitors. "The Pensions Green Paper shows how determined we are to help more people carry on working until they are 65 and even beyond. At the moment a wealth of talent and experience in the workplace is lost as people stop working too early. The Green Paper proposes to crack down on discrimination and sharpen incentives to help older people remain in work."

War in Iraq has dominated the news in March. Concern about the possible effects of the war on the treatment of Arabs and Muslim people living in Australia were raised in the media following a number of reported incidents in Victoria, while the NSW government vowed to protect Arab and Muslim people against vilification resulting from the war. The Australian Council of Human Rights Agencies (ACHRA) responded by calling on action by the Federal Government to counter anti Arab and anti Muslim sentiment in Australia. ACHRA also issued a release expressing concern that proposed changes to the Commonwealth Human Rights and Equal Opportunity Commission would significantly reduce the body's independence. The release in New South Wales by the Anti Discrimination Board (ADB) of a report on racial bias in the media led to extensive coverage and debate in both the Sydney Morning Herald, the Daily Telegraph and in the electronic media. Other stories to receive significant media coverage were the continuing debate over paid maternity leave and the Federal Court decision that the Australian Netball Association had breached the Sex Discrimination Act in banning pregnant netball player Trudy Gardner from playing in the National Netball League.
