Misbranded or Adulterated Foods
Foods Act of 2000
INTENDED ACTION: Adopt above permanent new rules to implement the Alabama Safe Foods Act of 2000. SUBSTANCE OF PROPOSED ACTIONS: Rule 80-1-22-.31 establishes the date for the application of statutorily required food safety permits and requires display of the permit in a conspicuous place. Rule 80-1-22-.32 provides a mechanism to establish the criteria which will be the basis upon which the sale of out-of-date, Class "A" foods, misbranded, and adulterated food will constitute five classes of violations subject to civil penalties. Rule 80-1-22-.33 provides a statutorily required list of terms to be included and considered within the term "Open-Date Statements." Rule 80-1-22-.34 provides a statutorily allowed definition of the term "Potentially Hazardous Food." Rule 80-1-22-.35 provides a statutorily required list of "Potentially Hazardous Foods." Rule 80-1-22-.36 prohibits reprocessing of potentially hazardous food unless the original open-date statement is maintained.

There are 48,000 people in Alabama who call themselves farmers. And for generations those few families have dedicated their lives to creating a $4.7 billion business—Alabama's largest.
But today, agriculture reaches far beyond the farm gate. Alabama's agribusiness industries account for 476,000 jobs with annual earnings of more than $9 billion. That's 21 percent of the state's workforce. In fact, 85 percent of all jobs created by agriculture are not on the farm at all. They include farm equipment dealers, seed and feed suppliers, food processors, exporters and retailers.
Together, these industries account for more than $43 billion or 22 percent of the state's direct output—more than any other industry.

Record of Decision
Site Background: Cleanup Progress: Groundwater Cleanup Underway; Remedy Selected for Soils/Sediments; Remedial Design for Soils/Sediments has Begun. In 1991, EPA entered into a consent agreement with Elf Atochem North America Inc. to conduct a Remedial Investigation/Feasibility Study for this Site. In 1995, EPA finalized a Record of Decision for the groundwater at this Site (OU1). The remedial design for the groundwater was completed in 1996, and construction has been completed for the groundwater recovery/pumping system. As of January, 2002 over 115 million gallons of groundwater have been pumped from the shallow aquifer and sent to the local POTW. The final Record of Decision for this Site (OU2) was signed September 28, 1998, and selected bioremediation as the remedy for the contaminated soils and sediments. The Consent Decree for OU2 was signed in January, 2000. The remedial design for soils and sediments has begun, with the pilot study having been successfully completed, and is scheduled for completion in the spring of 2002. Remedial action for soils and sediments is scheduled to begin in summer 2002, with construction completion anticipated for fiscal year 2002.

The Natural Law Party envisions a time when American farmers will farm in full accord with the laws of nature, fully utilizing nature’s creativity to yield abundant, healthy food, while protecting the environment and ensuring a vigorous, diversified, sustainable agricultural economy.
The Problem
The future of agriculture depends on its sustainability that is, the ability of agricultural policies and practices to preserve and strengthen the farming economy, ecology, and community for future generations. The recently passed Federal Agricultural Improvement and Reform Act of 1996 (FAIR) has been heralded as a major change of direction for U.S. agriculture. But it has left many wondering whether crucial, fundamental changes have really been made in agricultural policy, and whether FAIR is fair especially for small family farms and for the environment. FAIR does not go far enough to ensure agricultural practices that are sustainable financially, environmentally, and socially.
  • Financially unsustainable
      Recent projections of increasing international demand for food, coupled with rapidly shrinking global food reserves, suggest that consumers will pay even more for food in the future and that poor countries will receive less U.S. food aid. Despite these realities, current U.S. farm programs restrict America’s agricultural production (for example, 36 million acres have been taken out of production) while encouraging competitor nations to plant more [1, 2].
