Syllabus
Held: 1. The State's interest in universal education is not totally free from a balancing process when it impinges on other fundamental rights, such as those specifically protected by the Free Exercise Clause of the First Amendment and the traditional interest of parents with respect to the religious upbringing of their children. Pp. 2. Respondents have amply supported their claim that enforcement of the compulsory formal education requirement after the eighth grade would gravely endanger if not destroy the free exercise of their religious beliefs. Pp. 4. The State's claim that it is empowered, as parens patriae, to extend the benefit of secondary education to children regardless of the wishes of their parents cannot be sustained against a free exercise claim of the nature revealed by this record, for the Amish have introduced convincing evidence that accommodating their religious objections by forgoing one or two additional years of compulsory education will not impair the physical or mental health of the child, or result in an inability to be self-supporting or to discharge the duties and responsibilities of citizenship, or in any other way materially detract from the welfare of society. For reference on the subject of religion and organ donation. This is a list taken from the "Religious Issues in Donation and Transplantation" in the UNOS Organ Transplantation Medical School Curricullum. The chapter was written by Fr. Robert Smith, Chaplaincy Director of the Institute for Medicine in Contemporary Society at SUNY Stony Brook. Its past time that other clerical leaders took the advocacy positions of the Luthern Church and Rabbi Tendler. I believe that the situation morally requires something more than just a neutral stance. Gypsies are included even though it is emphasized that they represent a cultural group rather than a religious one. Apparently, their position is so unusual that Fr. Smith felt he had to include it. Summary

In this case, the Wisconsin Supreme Court weighed the state's interest in educating children against the First Amendment guarantee of religious freedom. The Court held that a state law requiring children to attend school full time was unconstitutional because it infringed on the freedom of the Amish to practice their religion, reversing a Green County Circuit Court decision. In reaching this decision, the Court distinguished itself from courts around the country that had upheld compulsory education. The majority opinion was authored by Chief Justice E. Harold Hallows. Justice Connor T. Hansen concurred and was joined by Justices Horace W. Wilkie, Bruce F. Beilfuss and Robert W. Hansen. Justice Nathan S. Heffernan dissented.
The case was appealed to the U.S. Supreme Court, which affirmed the state Supreme Court's ruling in a 6-1 decision authored by Chief Justice Warren E. Burger. Justice William O. Douglas dissented in part from the majority. Justices William H. Rehnquist and Lewis F. Powell, Jr. did not take part in the case.
    In this case, the Wisconsin Supreme Court held that Amish parents could remove their children from public schools after the 8th grade as an exercise of their right to religious freedom. The Amish separate themselves from modern society and provide their children with their own system of education structured in accord with their beliefs. The appellants were the parents of three teenagers who had attended the New Glarus public schools. The parents were fined for refusing to enroll the children in the high school in the fall of 1968. This was in violation of the compulsory school law.

    The Illinois Amish Interpretive Center:

    This is the first museum in Illinois dedicated to the Amish culture. It traces the history of the Amish religion and provides a glimpse into the lives of the Illinois Amish. An eighteen-minute video on the Amish culture helps to separate fact from myth about their culture. One of the oldest known Amish suits and a rare 100-year-old buggy are on display, along with a view of the inside of a typical Amish home. A gift and book shop is located on site as well as restrooms. A visit to the Interpretive Center is an excellent way to start a visit to Illinois Amish Country. A guided tour of the Museum is available for an additional charge.
    Allow 1-2 hours.

The Amish are not a homogeneous group and are as different and varied as any group of people or culture. This fact sheet simply puts in context some facts professionals need to know in order to work with individuals who practice the Amish faith.
The Amish Faith
The Amish faith is a Christian religion that traces its origins back to the Swiss Anabaptists. Knowing the history of the Anabaptist movement helps to understand the Amish faith as it is practiced today. Soon after the Protestant reformation began, a group of people became impatient with the slow pace of both Catholic and Protestant reforms and instituted more radical reforms. Because of their refusal to follow state/church requirements, they were persecuted and martyred. Baptism was one of the most important issues that created controversy. This group, called the Anabaptists, practiced adult, not infant, baptism. In 1690 some Alsace Anabaptists felt the church was losing its original vision or zeal and, in a schism, broke off from the Swiss Anabaptist or Mennonites. Young Jacob Amman, who advocated strict religious discipline, led this group which became a separate faith. The Amish migrated to North America in the 1700s and 1800s. Amish settlements were small, isolated, and scattered. They held major doctrines in common, but as the years went on, their practices differed.

Eash Amish sect leader may be in prison for up to 15 years By NATE REENS
Staff writer A Holland man who led a dissident Amish sect on the city's south side will serve up to 15 years in prison for sexually assaulting a teen-age follower. Police say Wilbur Eash, 50, served as a spiritual advisor and life counselor for dozens of people who broke away from a mainstream Amish community in northern Indiana and settled in Holland in 1994. Last August, Eash was accused of violating a 14-year-old boy, the son of a woman who followed Eash to the area. He was originally charged with first-degree criminal sexual conduct for molesting the boy, but he later pleaded guilty to a less serious count punishable by a maximum of 15 years in prison. On Friday, Eash was ordered to a 20-month to 15-year imprisonment. Allegan prosecutors asked for the maximum sentence because Eash took advantage of his role of authority to coerce the teen into sex, a move police say wasn't new to Eash. Authorities say their investigation found at least two other instances of Eash abusing young boys.
