Cho and Desai Receive 2003 Justice in Action Awards Comedian Margaret Cho and Bhairavi Desai of the New York Taxi Workers Alliance were honored at the Asian American Legal Defense and Education Fund's Annual Lunar New Year Celebration on Thursday, February 13, 2003, at PIER SIXTY, Chelsea Piers, in New York City. Ms. Cho and Ms. Desai received the Justice in Action award for their work to advance the cause of racial and economic justice. The program included a lion dance and celebration of the Lunar New Year 4701, Year of the Ram. There was also a silent auction and raffle. AALDEF, founded in 1974, protects and promotes the civil rights of Asian Americans, and has played a pivotal role in shaping the legal rights of Asian Americans across the country. AALDEF is a founding member of the Public Interest Law Center in Lower Manhattan, which includes the NAACP Legal Defense and Educational Fund and Puerto Rican Legal Defense and Education Fund. More than 700 individuals attended AALDEF's Lunar New Year Celebration and Justice in Action Awards Ceremony. All proceeds from the Celebration benefit the Asian American Legal Defense and Education Fund's programs. AALDEF provides free legal advice clinics to Asian immigrants and the poor, litigates cases that will have broad impact on Asian Americans nationwide, conducts community education reaching tens of thousands, trains students for careers in public interest law, and shapes public policies to ensure the equal participation of Asian Americans. To ensure that the legal needs of Asian American communities are not overlooked in the aftermath of the September 11 tragedy, AALDEF launched the 9.11 Emergency Legal Response Project to combat hate violence and racial/ethnic profiling, and to help low-income Asian immigrants and families affected by the long-term impacts of the WTC disaster.

42. AALDEF's APA 2000 : Anti-Asian Violence
Some Asian American victims of hate crimes aren't comfortable with or capable of police, and an ignorance about hate crimes and other civil rights protections.
http://www.aaldef.org/violence.html
History has shown us that during times of national anxiety, Asian Americans and other immigrants are viewed as foreigners in their own land, and become targets for blame and hate. Bigotry and violence against Asian Americans continues to occur on a regular basis, but it often does not receive the sustained national attention it deserves. A few years ago, as the rest of the country celebrated America's Independence Day, a 21-year-old college student, Benjamin Smith, went on a three-day shooting rampage in Illinois and Indiana, killing one African American man and one Korean American man, and injuring nine other Jews, Asian Americans, and African Americans. This cross-cultural carnage is an important reminder that hate crimes need be taken seriously by both the Asian American community and the American public at large. After September 11, 2001, Americans who made no distinction between the terrorists who attacked the World Trade Center and people who looked like them started shooting, harassing, and violating the civil rights of South Asians, Filipino Americans, Latinos, and others who looked "Middle Eastern," as well as Arab Americans and Muslim Americans This 1982 incident bore frightening similarities to the anti-Chinese hysteria of the 1880's, when a nationwide recession led to the Exclusion Act of 1882. This 1882 Act barred immigration of Chinese laborers, denied citizenship to all resident Chinese, and prompted angry mobs to attack and destroy Chinese American communities across the West.

She passed away 10 days ago at age 82, just before the 20th anniversary of his murder. Vincent Chin, a 27-year-old Chinese American, died on June 23, 1982, at the hands of two disgruntled Detroit autoworkers who mistook him for Japanese. One held him down. The other bashed his skull with a Louisville Slugger baseball bat, not once but four times. They were never punished, despite two federal civil rights trials. A subsequent civil suit won a $1 million judgment against Ronald Ebens, who wielded the bat, but he made good his boast that Chin's mother would never see the money. At the time, I was working for the old Herald-Examiner in Los Angeles and even on the diverse West Coast, I could see tensions ratcheting up over Japan's seemingly invincible prosperity and America's economic decline in the early 1980s. I remember feeling revulsion and fear at the killing. Had I crossed their paths in Detroit, maybe Ebens and his stepson, Michael Nitz, would have hunted me down instead of Chin. Wrong place. Wrong time. Wrong looks.

Commission to Conduct Briefings
On Bias Against Asian Americans
FOR IMMEDIATE RELEASE
Monday, December 1, 1997
WASHINGTON The U.S. Commission on Civil Rights has scheduled briefings to examine the impact of racial scapegoating and stereotyping of Asian Pacific Americans in the campaign finance investigations, committed by members of Congress, the Democratic National Committee, the National Republican Senatorial Committee, and the news media. In September, an unprecedented petition The petition called on the U.S. Commission on Civil Rights to investigate the discriminatory impact on Asian Americans of actions by members of Congress, the Democratic and Republican National Committees, public officials, and the news media. On October 10, the U.S. Commission on Civil Rights voted unanimously to support their petition and schedule a briefings. After one year of numerous intensive investigations and media reports linking their community to campaign finance abuses, Asian Pacific Americans documented a pattern of gross generalizations, racial stereotypes, scapegoating and other practices that have had a chilling effect on their political participation and exercise of First Amendment rights. In an unusual move, a broad coalition of individuals and national Asian American groups submitted the documentation to the U.S. Civil Rights Commission for investigation.

ALBUQUERQUE, NM In separate legal briefs, the American Civil Liberties Union and the Asian Law Caucus said that Dr. Wen Ho Lee is entitled to any government evidence that he is the victim of racial profiling by officials. The ACLU brief , submitted today, says that the evidence of selective prosecution based on race in this case is so substantial that Dr. Lee's request for evidence must be granted. The Asian Law Caucus bolsters this argument with numerous examples of government discrimination against people of Asian descent. "It is unconstitutional for a decision to prosecute to be based on race," explained Robert Kim, staff attorney with the ACLU of Northern California, "and Dr. Lee is entitled to the evidence to prove his claim." Neither organization takes a position on Lee's guilt or innocence or whether Dr. Lee can prove his selective prosecution claim.

By Michelle Chang T he United States Commission on Civil Rights announced on October 23 that it will hold a briefing in December on a petition charging scapegoating of Asian American political donors. In its civil rights complaint with the U.S. Commission on Civil Rights, the coalition said that members of Congress, the Democratic National Committee and National Republic Senatorial Committee and others have contributed to a hostile racial environment for Asian Pacific Americans. "Five years ago, the United States Commission on Civil Rights issued a comprehensive report on Civil Rights Issues Facing Asian Americans in the 1990's," Chen said. "The Commission found that despite certain economic and educational accomplishments of some in the Asian Pacific American community, Asian Americans continue to face substantial barriers to full equality. "Specifically, the Commission found that anti-Asian sentiment, racial stereotyping, persistent perception of Americans of Asian descent as foreigners, Asia-bashing by public leaders, and unbalanced and insensitive media coverage not only impedes their political empowerment and socio economic progress but also contribute to a hostile and violent environment against Asian Americans," Chen added.

Washington, DC 20510 Dear Senators Daschle and Lott: We write to you as a nonpartisan coalition of organizations from across the country to urge you to adopt an amendment to the pending Homeland Security Act that would stop further development of a Defense Advanced Research Projects Agency (DARPA) system called "Total Information Awareness" (TIA). According to DARPA's own documents, TIA will collect and mine vast amounts of information on the American public, including telephone records, bank records, medical records, and educational and travel data. TIA also proposes to connect with a massive system of biometric identification. There are no systems of oversight or accountability contemplated in the TIA project. DARPA itself has resisted lawful requests for information about the program pursuant to the Freedom of Information Act. Newspapers across the country have blasted the Department of Defense surveillance system. The New York Times said today that "Congress should shut down the program pending a thorough investigation." Earlier the Washington Post wrote, "the defense secretary should appoint an outside committee to oversee it before it proceeds."
