The establishment of a system in France whereby foreign lawyers are able to engage in the legal services of theirown countrie's law
Japan has been requesting to the EU that France establish a system that would allow foreign lawyers to engage in the legal services of their own countries' law without having to undergo any special examinations, as is permitted in Japan under Japan's law regarding foreign lawyers. The European Commission has replied that the restriction in France is a part of the GATS schedule of the European Community and its Member States which has been accepted by Japan. Japan remains unconvinced, however, on this EU explanation, because the EU itself raises its request on deregulation regarding foreign lawyers in Japan in bilateral deregulation dialogues despite the fact that Japanese restrictions in question are part of the GATS schedule of Japan.
Japan considers that the EU comments and replies are made on behalf of Member States including France, and, therefore, Japan would like the Commission to make substansive explanation including how France has reacted to Japan's request on legal services.

1. Legal services
The establishment of a system in France whereby foreign lawyers are able to provide legal services with regard to their own country's laws (1. of Requests and Comments of March 2).
Japan has made a request to the EU that France establish a system that would allow foreign lawyers to engage in the provision of legal services pertaining to their own country's laws without their having to undergo any special examination, as is duly permitted in Japan under the Special Measures Law Concerning the Handling of Legal Business by Foreign Lawyers.
According to the Reaction from the European Union of June 30, 1998 (referred to as "the EU Reaction" hereafter), a qualified lawyer from a non-EU third country will be allowed to join the French bar, subject to passing an examination based on his/her knowledge of French law. This reply does not address Japan's request for exempting from the obligation of any special prior examination the foreign lawyers providing legal services pertaining to their own country's laws in France. Japan stands by its original request.

    POTATO WART DISEASE: FIRST LIFTING OF RESTRICTIONS

    Potato wart disease
    is caused by a soil borne fungus, whose spores can remain viable for many years. Previously this has meant that infected land must remain under restriction indefinitely. An EPPO (European and Mediterranean Plant Protection Organisation) protocol was introduced in 1999, to facilitate the lifting of restrictions which have been in place for at least 20 years and where intensive sampling and testing of the land has determined that the fungus is no longer present. A pilot exercise has been carried out to determine the effectiveness of the EPPO procedure and the first stage of this has been completed successfully. As a result, one participating grower has had restrictions lifted and can now grow potatoes without limitation and export to countries which require freedom from potato wart disease. The pilot exercise is continuing in 2003 to assess the suitability of the protocol in different situations (e.g. soil types, length of restrictions) and decisions on future work will be taken in light of these results. To guard against the spread of harmful pests and diseases, official controls apply to the import, movement and keeping of plants, plant pests and other material. Some plants and plant produce are prohibited from entering this country. Others are restricted and must be accompanied by a phytosanitary ("plant health") certificate issued by the exporting country. This is essentially a statement that the plants or plant produce to which it relates have been officially inspected in the country of origin (or country of despatch), comply with statutory requirements for entry into the EC, are free from quarantine pests and diseases, and are substantially free from other organisms. There are, however, concessions for travellers which allow small quantities of controlled plant material to be brought into Britain without certificates subject to certain conditions. Looking for something different for your indoor garden? Put a scene from the forest in your home. Creating tray landscapes allows for much more creativity than just putting a plant in a pot, says guest Daniel Avrin, and each landscape is completely unique. Here are some general tips and ideas:
  • The idea is to create a natural scene in miniature. Think of something you've seen: a favorite view, a nice photograph, a childhood memory.
  • The container you choose should complement the plants in motif, lines, shape and design. You can be creative with your container as long as it has good drainage. Use a seashell, gourds, even driftwood, if you like.
  • Remember proportions, says Avrin; choose small-leaf plant varieties for your landscape. Try terrarium plants, dwarf ferns, small palms and indoor bonsai plants. It helps to visualize what the plant is intended to mimica bush, a tree, grass or a shrub.

    The art of bonsai
    By Lynn Welp For Mid-Valley Sunday Bonsai is defined as the art of miniaturizing a tree or shrub to give it the appearance of a mature tree. "Any tree can be reduced and grown in a small size and proportion," says Bob Newton, a self-declared student of bonsai. "Except perhaps the native big leaf maple because you cannot reduce its leaf size." Although he has been president of the local Corvallis Bonsai Society for nine years, a member of Bonsai Clubs International since 1980, a member of the Pacific Northwest Bonsai Association since 1994 and a member and past charter secretary of the Benton County Council of Garden Clubs, Newton still considers himself a student of bonsai because, "You're always learning, aren't you?" Newton worked at Oregon State University in the School of Business Affairs for 26 years before retiring as its director, but his fascination with plants has endured since childhood.
