SUPREME-COURT LAW
Prime Minister Chretien and Pierre Trudeau wrote the Charter of Rights in 1982. They got the Queen to sign it no referendum, no discussion, no input from Canadians in general and extremely difficult to change. It allowed Supreme-Court-made law.
The prime minister appointed all Supreme Court justices for life, until they reached 75 or die. Canadians were not allowed to question these appointees about hidden prejudices or vested interests.
In 16 years the Supreme Court struck down 58 statutes 31 federal and 27 provincial according to their private interpretations of the Charter. This appointed-for-life Supreme Court neutered our elected parliaments by changing, canceling or remaking laws made in parliament. These were revolutionary changes homosexual marriages, kiddie porn, definition of spouse, Indians allowed to fish out of season etc. The Supreme Court not the federal government made federal policy. Therefore Canadians were denied democracy and were forced to accept these changes judicial dictatorship.

Canadians in the West know that their votes are almost meaningless in the present parliamentary set up. They can complain from dawn 'till dusk, seven days a week but nothing will change. The percentage of Canadians who even bother vote has steadily declined in recent years. The voters 40% of the 61% who bothered to vote decided and it's all over for another four years or until the prime minister decides.
Chretien will also decide when the next election will be called because Canadians do not have a set date for elections. And he may run again because Canadians to not have term limits like the Americans. That is why ex-President Clinton could not run for president again. Chretien has won three elections as prime minister; he may try for three more. What's to stop him? He has a disciplined Liberal majority at his disposal. But it's even worse than that.
Canadians as a whole do not elect him as prime minister; it's his fellow Liberals, the talking heads, trained seals and voting machine. There are no free votes in parliament. The Liberals vote as a block. It is not what their constituents want it is what Chretien wants. They owe him total loyalty or he may not sign their nomination papers at the next election or worse he might excommunicate them from the party as he did with Nunziata.

New Canadian Supreme Court Justice Reveals Pro-Homosexual Stance OTTAWA, Aug 12, 02 (LSN.ca/CWNews.com) - Newly appointed Canadian Supreme Court Justice Marie Deschamps has revealed she is in favor of special rights for homosexuals. The news comes as a serious blow to pro-family groups who note that the issue of homosexual marriage will undoubtedly reach the courts in the very near future. CBC reports that Deschamps said she's looking forward to dealing with the country's most important issues, including homosexuality. "This is a good example where society has evolved a lot," she said. "Ten years ago, many provinces did not have any law that would (have) recognized the equality of gays." Deschamps, a 49-year-old Quebec judge, is rumored to have been granted the prestigious appointment by Liberal Prime Minister Jean Chretien due to her husband's close ties to the Quebec Liberal party. The Toronto Star reports that Deschamp's husband Paul Gobeil was a cabinet minister in the government of Robert Bourassa and was also instrumental in Jean Charest's coronation as leader of the Quebec Liberal party in 1998. Currently Gobeil is the head of the Export Development Corporation, a federal crown agency. Canadian Alliance justice critic Vic Toews (Provencher) criticized the autocratic appointment of Supreme Court Justices by the Prime Minister. "I wish her (Deschamps) all the best in a difficult situation, but the danger of a closed process is that people will think she got the job because her husband is a prominent Liberal," he said. So far Chretien has appointed five judges to the Supreme Court.

Canadian Supreme Court Judges Blast Christianity OTTAWA, Nov, 14 (CWNews.com/LSN.ca) - In a court case that could lead to overt legal discrimination against Christians in Canada, two Supreme Court Justices blasted Christianity as discriminatory and intolerant. On Thursday, the Supreme Court heard arguments on the case of Trinity Western University in which the British Columbia College of Teachers (BCCT) refuses to approve the teacher education program at Trinity Western because the Christian school's code of conduct requires students and teachers to refrain from homosexual sex as well other sinful actions. Two lower court decisions have ordered the BCCT to accredit the university's program, but the Supreme Court suspended those decisions by granting a hearing. During the hearing, Justice Claire L'Heureux-Dube, a feminist activist, was quoted in the National Post as saying, "We have all this love stuff, but if Trinity's code stated that blacks were inferior to whites, or that Jews should be killed, would its teachers still be fit for public schools?" And when the universities defenders said evidence of discrimination must be found among teachers who have graduated from the program, Judge Dube said, "Evidence [of discrimination] is in the [Trinity] program. What kind of other evidence do you want?" Dube is a known homosexual activist, having spoken at homosexual conferences in favor of legal recognition of same-sex marriage.

by: Randall Palmer (OTTAWA) Canada's highest court has given lap dancing its seal of approval.
The Supreme Court of Canada ruled on Monday that certain nude lap dancers did not violate community standards, despite an earlier judgment against the practice which involves paying for individual dances at strip bars.
The court acquitted Therese Blais Pelletier, the co-owner of a strip bar, of keeping a bawdy house a place of sex for money despite the fact that erotic lap dances were being performed in an open cubicle for money.
"The dancers were required to follow the appellant's (Pelletier's) rule against touching clients, but clients were allowed to touch the dancers' buttocks and breasts," according to a statement presented by the Supreme Court.
The court heard the case on Monday and ordered an immediate 3-2 acquittal, with full reasons to follow months later.

The Supreme Court of Canada sits in an austere, gray stone building above the Ottawa River, just down a slight hill from Parliament. But for most of 1999, the controversy swirling around the nine justices, led by Chief Justice Antonio Lamer, might have led an observer unschooled in Ottawa geography to think that the jurists held the higher ground and were steamrolling their vision of the country over the people's elected representatives. In some 60 decisions the court underlined as never before its role as the guardian of Canadian rights and freedoms-and occasionally, according to critics, as the radical interpreter and even inventor of those rights. The Court dominated the national agenda with rulings that extended the definition of secondary picketing, restricted doctor-patient confidentiality and expanded the right to be tried in either official language across the country. It delved into the most intimate aspects of citizens' lives with decisions on divorce and gay rights, and for the first time in its 124-year history, sparked interracial violence with one of its most controversial decisions, on East Coast aboriginal fishing rights. However they applauded or decried specific decisions, legal experts were generally agreed that the Lamer court had launched a new era of juridical activism, inspired by the 1982 Charter of Individual Rights and Freedoms. Chief Justice Lamer himself agrees. "Our decisions hit harder because they hit wider," said Lamer, 66, a former Quebec criminal defense lawyer who has led the court since 1990. Lamer, who is taking early retirement in January, was unapologetic. From his point of view, the issue was not court activism but political passivity. "The kinds of problems we've been getting are issues that 25 years ago went to Members of Parliament" he told TIME. "It's not for me or any judge to decide which laws should be passed, but if legislatures choose not to legislate, where else can people go except the courts?"

    Justice Arbour served as the Chief Prosecutor of War Crimes before the International Criminal Tribunal for Rwanda and the former Yugoslavia in The Hague. While at this post, she indicted Serbian president Slobodan Milosevic, the first time a sitting head of state was indicted by an international tribunal. Justice Arbour held earlier appointments on the Supreme Court of Ontario and the Court of Appeal.

    Archbishop James Hayes, president of the Canadian conference of Catholic Bishops, issued the following statement on 28 January 1988 following the announcement of a Canadian Supreme Court decision on abortion laws. The Supreme Court decision striking down the abortion law is a dramatic challenge to all lay members of the Church and to all of us their pastors. The need for responsible political action was never more urgent. For God's law condemning abortion is not changed by the Supreme Court decision. In the process of writing a new law that protects human life from conception, lay Christians as voters and legislators have the first responsibility. The situation of "abortion on demand" that follows from the Court's decision must be corrected legislatively as soon as possible. This is our common task now, and the future of our human society depends on how soon and how well it is done. In the process of working for new legislation, all Christians must also apply themselves to the continuing pastoral work of evangelizing modern culture regarding the God-given values and rights of every human life, and the need to safeguard and respect that life in all circumstances. Abortion is the destruction of human life.
