2002-FEB-4: USA: Justice Scalia criticizes Roman Catholic Church: U.S. Supreme Court Justice Antonin Scalia, a Roman Catholic, criticized his church's anti-death penalty stance at two public meetings. He notes that although the present pope is opposed to capital punishment, that the church itself has traditionally supported executions. He said: " No authority that I know of denies the 2,000-year-old tradition of the church approving capital punishment. I don't see why there's been a change. " At a meeting In Chicago on JAN-25, Scalia said, " In my view, the choice for the judge who believes the death penalty to be immoral is resignation rather than simply ignoring duly enacted constitutional laws and sabotaging the death penalty. " On FEB-4 in Georgetown, he commented that " any Catholic jurist [with such concerns] ... would have to resign. You couldn't function as a judge.

Pro-life and Pro-Capital Punishment Contradiction in Terms? By Anthony Gonzales One of the main arguments used by the antireligious bigots against the "Radical Right" (those people who hold to the values of our ancestors) is that our position is inconsistent because we "claim" to be pro-life and at the same time support the death penalty. This liberal mantra has also been adopted by liberals in the Church who have attempted to take the teeth out of the pro-life movement by saying that we as Catholics must support the "Seamless Garment" concept that all human life is sacred no matter what the circumstances. They them- selves claim that it is inconsistent to be pro-capital punishment if you claim to be pro-life. Finally, to make matters worse for conservative Catholics, giving more ammunition to the liberals, is the position Pope John Paul II and Mother Teresa have taken in regards to the death penalty. In several instances they both have interceded with the governors of their respective states for criminals who were about to be executed. Scalia, a devout Roman Catholic, said Monday that after giving it seriousthought, he could not agree with the church's stand on the issue. It wasn't the first time Scalia has questioned the church's opposition to the death penalty. He took the same position late last month at a conference in Chicago, Illinois, and was asked about it again Monday at Georgetown University, a Catholic school in Washington. Under Pope John Paul II, the Catholic Church has been strongly anti-death penalty. The pope has personally appealed to leaders to commute death sentences. In 1999, he said capital punishment, abortion, euthanasia and assisted suicide are part of a "culture of death." Scalia told Georgetown students that the church has a much longer history of endorsing capital punishment. "No authority that I know of denies the 2,000-year-old tradition of the church approving capital punishment," he said. "I don't see why there's been a change."

    Recent USA state-killing rates: Through April 7, the rate of capital punishment in the US in 2003 will have been 22% less than this country's rate for 1999, which, with 98 killed, was the record-worst year since 1951. (This figure is the average of the 2 unrounded percentages below, and is shown graphically

    Through April 7, there will have been 22 "executions" in the US in 2003. This represents a rate of 83 per year, 16% less than the 98 killed in this country in 1999.
    Considering that, in recent years, US state killings have been chronically weighted early in the calendar year, another way of figuring the current rate is that through April 7, 1999, there had been 31 state murders in the US that year; so 22/31 times 98 equals 70 projected for 2002 (29% less than 1999).
    There were 85 executions in the US in 2000 (13% less than 1999), 66 in 2001 (33% less than 1999), and 71 in 2002 (28% less than 1999).

Nasim, a general business senior, said that from the club's perspective, the logic behind the death penalty is flawed. "Do two negatives make a positive?" he asked. Thomas Tscha, a business management sophomore and member of the club, said he is joining with other students to oppose the death penalty out of a need to voice his opinion. There are many people who feel exactly that way about the Federal Government, just ask Mr. McViegh, and some of the people from Waco, Texas. Also, I wonder how is it fair? And to whom? First, the deceased has a family, perhaps dependents, and these are left harmed and unhelped for the most part. There is no restitution by the killer. And the innocents who have lost a loved one must also bear their trauma and suffer its exacerbation through a trial and dealing with lawyers for God's sake. Then there are the dependents and family of the killer who have losses through no fault of their own. The victims pay, the society pays, the friends and family of the killer pays. The killer simply leaves this "veil of sorrow." So where is the equity in that arrangement?

    The Daily Illini Delbert Tibbs was released from death row 25 years ago when the Florida Supreme Court ruled there was not enough evidence in his trial to convict him of rape and murder. Anti-death penalty activists cited Tibbs' case, among others, at a conference Saturday at the University YMCA, 1001 S.
