55. Hb675
exercise general control and supervision over the public schools of the State CONSTITUTIONALBASIS FOR THIS AMENDMENT TO HB675 State of delaware Constitution
http://www.geocities.com/private_ed_de/hb675.html
JURISDICTION ALERT/HB 675 BILL NUMBER AND STATUS: HB 675 (Out of Committee) Introduced 06/22/2000 PRIMARY SPONSOR: Cloutier COSPONSORS: Sen. Sokola Reps. Smith, Buckworth, Capano, Carey, Cathcart, Caulk, D. Ennis, Ewing, Fallon, Lee, Lofink, Miro, Reynolds, Stone, Valihura, Wagner, Brady, DiLiberto, B. Ennis, Houghton, Keeley, Schroeder, Viola, West SYNOPSIS (Posted on LIS): This bill updates remaining references throughout the Delaware Code to the Department of Public Instruction and the Superintendent of Public Instruction, replacing them with the Department of Education and the Secretary of Education, respectively. It also corrects several references to the State Board of Education by replacing it with the Department of Education in those instances where the powers and duties have previously been transferred to the Department, preserving the State Board's approval authority where applicable. SUMMARY: The names of these government departments are no longer self-restrictive. THE NEED FOR SPEED ON THIS ISSUE: This might be our last chance to assert that the name change does not give or imply powers to the State that naturally belong to the People. WHAT YOU CAN DO RIGHT NOW: 1. Draft a letter and send it to the bill's sponsor and cosponsors. 2. Send a copy to the Education Committee Members ask for them to help us get an amendment to HB- 675, even though it is Out of Committee. BOTTOM LINE: All we need is a sentence that asserts that the power of the Department is to exercise general control and supervision over the public schools of the State only. (And I would emphasize that inclusion of "only" is critical to the meaning of the sentence.) STATUTORY BASIS FOR THIS AMENDMENT TO HB-675: Title 14, Part 1, Chapter 1, Subchapter II, Section 121 "General Powers of the Department of Education. The Department shall exercise general control and supervision over the public schools of the State" CONSTITUTIONAL BASIS FOR THIS AMENDMENT TO HB-675: State of Delaware Constitution, Article X, Section 1. "The General Assembly shall provide for the establishment and maintenance of a general and efficient system of free public schools" (The system of free public schools is re-asserted as separate from private education in the rest of the sentence) ".and may require by law that every child shall attend the public school, unless educated by other means." The Department of Education has regulatory power over the public schools only. January 29, 2002 MILK WHOLESALER AGREES TO REPAY SCHOOL OVERCHARGES Settlement Seen as Catalyst for Reforms of Contracts for School Lunch Programs Listen to Attorney General Eliot Spitzer's Comments WAV AIFF (177KB) (requires Quicktime
Attorney General Eliot Spitzer today announced a settlement with one of the state’s largest dairy products companies for overcharging public school districts on milk contracts.
The settlement, which follows a six-month investigation by Spitzer’s Public Integrity Unit, requires Crowley Foods of Binghamton to repay as much as $500,000 in overcharges to school districts across the state.
"This settlement is a win for the schools, which will be fully compensated for past overcharges," Spitzer said. "In addition, the settlement sends a clear message to school districts and their suppliers on the need for scrutiny of all contracting and billing practices."
The investigation also led Spitzer to propose a series of reforms. Specifically, the Attorney General has developed an "Integrity Rider" that he recommended be included in all future milk purchase contracts to help prevent fraud. In addition to simplifying the complex billing process that facilitated the overcharges, the integrity rider provides significant penalties for overcharges and requires unscrupulous vendors to pay for the cost of the audit that catches them.

Clayton Elementary is one of 80 public schools participating in the RIF Delaware Initiative , a five-year statewide program aimed at encouraging preschoolers and first graders to learn to love reading by providing them with new, free books of their own choosing; motivate them to read for fun; and encourage parents to become involved in their children’s literacy development. By the end of 2002, the program is expected to serve 70,000 Delaware children. The two components of the initiative are RIF’s highly successful reading motivation program called Running Start, which serves every first grader in the state’s public elementary schools, and RIF’s National Book Program , which places new, free books in the hands of every preschooler in the state’s Head Start, Even Start, Partners As Teachers and Early Childhood Assistance Programs. "We would like to see the RIF Delaware Initiative continue for many years. We’ve had a lot of success," said Irene Hrycushko, program coordinator for the Clayton Elementary RIF program.
