  • Eligibility Guidelines
    • Individual served must be a victim of Domestic Violence.
    • Victim must be either PBP enrolled tribal member or in a relation with a tribal member.
    • Abuser must be either PBP enrolled tribal member or in a relation with a tribal member
    • Direct services are limited to the residents of Jackson and Shawnee County.
    • Advocacy and referral services are offered to members or significant others outside the immediate service area.
    Determining Eligibility
    Victim services advocate is the primary contact for all referrals made by victims of Domestic violence. When the victim services advocate receives a referral, the following questions are asked and consequent actions taken.

Linton, Supreme Court of New Jersey, App. Div., No. A-6118-01T2 (2002) Officers observed an alleged failed drug transaction, after which, the suspected dealer returned to a nearby residence. The officers went to the residence, which - based on the refuse in the yard, the broken windows and broken lock, and the fact that no person had been seen there in a month - led them to believe the house was abandoned. Consequently, the officers entered the house. Inside, the officers discovered narcotics evidence and Linton, who was then arrested. The appeals court refused Linton’s request to suppress the evidence, concluding that there was no expectation of privacy in the residence, because, although Linto was in the house, it was otherwise abandoned, so Linton had no personal interest in it.     The Violence Against Women Prevention Act of 1998: A Tremendous Step Forward In Helping Battered Women and Preventing Abuse On Thursday, March 19, 78 members of the House of Representatives led by Representatives John Conyers, Jr. (D-MI), Connie Morella (R-MD) and Charles Schumer (D-NY) introduced the Violence Against Women Prevention Act of 1998. This bill is a tremendous step forward in the effort to help battered women, prevent abuse, and study the impact of programs and services designed to stop America's epidemic of domestic violence. For most of our history, domestic violence was virtually ignored by federal lawmakers. The 1994 passage of the Violence Against Women Act was a ground-breaking step forward. It marked the first time the federal government truly recognized that domestic violence is a costly and devastating epidemic that requires a multi-faceted and comprehensive government response. That law established the federal hotline that has already directed hundreds of thousands of battered women to the local programs and services that can help them protect themselves and their children. It created new protections for battered immigrant women who were previously forced by our immigration law to stay in battering relationships. And it encouraged law enforcement to take domestic violence seriously and to respond to it more effectively. Elements of the New Legislation The bill introduced in the House of Representatives this week takes the badly needed next steps. It includes provisions that would:

    Legislative Highlights of Recent Years
    The Domestic Violence Act created the Family Protection Services Board to develop standards for annual licensure and funding of domestic violence programs. This Act provided an additional fee for filing a divorce action and generated an increase in funding for licensed domestic violence programs.
    Revisions to the Prevention of Domestic Violence Act of 1979 broadened the definition of domestic violence; allowed advocates to be present at domestic violence hearings; lengthened the period of protective orders from 30 to up to 60 days; required magistrates to inform persons seeking a domestic violence protection order of the nearest residential or protective service available for abused persons; mandated the development of policies and procedures for law enforcement response to domestic violence calls.
    Revisions to the Prevention of Domestic Violence Act permitted service of protection orders on Sundays and legal holidays; required responding police officers to transport or facilitate transportation of victims to a safe place; enabled protective orders to be enforced across county lines; and established conditions of bond in domestic violence cases.

    BATTERER INTERVENTION PREVENTION PROGRAMS IN WEST VIRGINIA Establishing batterer intervention prevention programs is an effort to provide comprehensive programs addressing the impact of domestic violence on individuals and in communities. Batterer's programs are one piece of a coordinated community response involving law enforcement, prosecutors, courts, judges, communities of faith, schools, victim services, health care professionals, correctional facilities, etc. The primary purpose of programs for batterers is to maximize safety for victims of domestic violence and to hold perpetrators accountable for their violence and abusive choices.
    In West Virginia, programs for batterers are rooted in the theory that the cause of domestic violence is one person's arbitrary belief in the right to exert power over another person. This power is demonstrated through a pattern of coercive control used to intimidate and manipulate the victim into responding according to the batterer's immediate demands and desires. Perpetrators of domestic and family violence are deliberate in choosing their victims and in selecting their tactical means of control. Perpetrators learn to accept violence and abuse as a means of resolving inter-personal conflict with few if any negative consequences. Only recently in West Virginia (1992) was domestic violence identified as a crime that will no longer be tolerated or excused.
