    MEMORANDUM FOR ALL UNITED STATES ATTORNEYS FROM: THE ATTORNEY GENERAL SUBJECT: Drug-Induced Violent Crime Prosecutions
    The Drug-Induced Rape Prevention and Punishment Act of 1996 (Act), 21 U.S.C. Sec. 841(b)(7), provides criminal penalties of up to 20 years imprisonment for any person who distributes a controlled substance, such as Rohypnol, to a person with the intent to commit a crime of violence, including rape. The Act does not federalize any new conduct inasmuch as the distribution of a controlled substance is already a federal crime. It does, however, establish the basis for harsher penalties under federal law if the distribution facilitates a violent crime. In cases of drug-induced violence, the likely Sentencing Guidelines range for the actual drug distribution will generally be very low, since the drug quantity involved will generally be in the range of a single dosage unit. To avoid this problem, the Sentencing Commission has established that the range be based not on the drug guidelines, see I fully recognize that the vast majority of crimes which could be charged under the Act are, and will continue to be, prosecuted by state and local prosecutors. Nonetheless, I want to make certain that our state and local law enforcement partners are aware of the statute and know that they can call upon you in those cases where there is an appropriate federal interest in prosecution. There are, of course, many factors that govern whether federal prosecution is warranted in a particular case. Ultimately, these decisions should be made as part of your overall collaborative planning with your state and local law enforcement partners, to make certain that limited law enforcement resources are most effectively targeted at priority criminal justice problems.

This compares to 96 drug-related deaths for 1996. A number of indicators regarding cocaine are high and have shown increases since our 1998 report. Discussions with treatment providers, outreach counselors, and users indicate the popularity of intravenous use of crack. The number of deaths associated with heroin use declined slightly, from 38 in 1996 to 36 in 1997. These numbers have decreased by 43% from the high of 67 deaths in 1994. The number of Toronto newborns diagnosed with conditions indicative of prenatal drug exposure remains at a relative high. The total of 81 babies so diagnosed is the 3rd highest total in the 13 years monitored.

    The Attorney General's Criminal Bureau has four broad missions: investigate and prosecute violations of state criminal law, promote effective law enforcement and criminal justice, crime prevention, and provide assistance to crime victims. The Criminal Bureau's staff of experienced State Police detectives, investigators, and assistant attorneys general focus on investigating and prosecuting crimes that are not usually handled by the state's district attorneys. These crimes include organized crime, large-scale drug trafficking, political corruption and complex criminal conspiracies, crimes against the government, consumer fraud, economic crime, computer crime and environmental crime. The cases investigated and prosecuted by the Criminal Bureau are referred to it by crime victims and other citizens, police departments, government agencies and district attorneys offices. More than 1000 allegations of criminal conduct are referred to the Criminal Bureau each year. The Criminal Bureau promotes effective law enforcement through its Criminal Justice Policy Division. This division reviews crime data and trends, proposes legislation, participates in training programs for law enforcement officers and other criminal justice professionals, and maintains working relationships with many local, state and federal criminal justice agencies. Through these working relationships, Bureau members regularly convene or participate in multi-agency working groups dealing with criminal justice issues such as anti-terrorism planning, drug and alcohol abuse, sentencing reform, prisoner re-entry initiatives, domestic violence and child abuse.

    OTTAWA – In a recent month-long study, conducted in 26 communities across Canada, police reported that more than half (53%) of the people arrested for criminal offences were under the influence of alcohol or illicit drugs, or both, at the time the crimes were committed. Using a two-page questionnaire called an Arrestee Study Form (ASF), arresting officers recorded their assessment of drug and alcohol involvement in 2,765 arrests made between May 1 and May 30, 2000. The ASF encompassed all criminal offences, such as homicide, assault, property crimes, drug trafficking and impaired driving, but excluded dated arrests or arrests on bench warrants where the arresting officer did know the circumstances surrounding the crime. The study was carried out jointly by the Canadian Association of Chiefs of Police (CACP), the Royal Canadian Mounted Police (RCMP) and the Canadian Centre on Substance Abuse (CCSA) as part of a larger effort aimed at estimating the extent to which alcohol, cocaine, cannabis and heroin contribute to various kinds of crime. The multi-faceted estimation project, believed to be the first of its kind in the world, is being funded by the Office of the Solicitor General, the RCMP, the CACP, Correctional Service Canada, the National Crime Prevention Centre, Health Canada and the United Nations.

    (SACRAMENTO) – Attorney General Bill Lockyer today announced that he will appoint Paul Seave as Special Assistant Attorney General for Crime and Violence Prevention responsible for managing the Crime and Violence Prevention Center in the California Department of Justice.
    Seave will join the California Department of Justice next month after he steps down as United States Attorney for the Eastern District of California. Seave, an honors graduate of the University of Pennsylvania Law School, has served as a federal prosecutor for 16 years.
    "Paul Seave has been on the front lines prosecuting crime for nearly two decades and now will bring his extensive experience and knowledge to developing effective crime prevention and education strategies for law enforcement and the public in the state," Lockyer said. "With Paul on our team, we have the opportunity to push California further into the forefront in the crime prevention and education arena."
    Over the years, the Attorney General's Crime and Violence Prevention Center has been recognized as a valuable resource for state and local agencies working to prevent violence and protect communities from crime. Recent initiatives include an anti-drug abuse campaign focusing on methamphetamine and "Safe from the Start," a series of 10 regional forums in which law enforcement, child protection and other local agencies have been able to exchange best practices and new ideas for protecting children from violence and preventing crime.
