The Internet is used by over 100 million people and companies to communicate, educate themselves and buy and sell goods and services. In the years since it has been open to commercial ventures, data gathering and mining on the Internet has evolved as one of its most critical, criticized, and profitable areas. Government agencies and private companies can now gather information about the individuals who visit their websites in order to provide customized services that are targeted to each individual. But the compilation of information in the open architecture of the Internet has created concerns over the ability of the creators of these databases to restrict the uses of those facts by others. Uncertainty over the ownership of data impacts market incentives for the creation and use of databases in competitive markets.

July 9, the United States District Court for the Southern District of New Kessler, 97 Civ. 1140 (CBM) (S.D.N.Y., July 9, 1998). The court reportedly found no willful infringement due to confusion between the parties over what could be done with the photographs and, thus, awarded the minimum statutory award amount of $500 for each infringed work.
