The issue of grandparent rights has become more important as societal norms have changed and more grandchildren are being raised by their grandparents. Unfortunately, current law in most states does not recognize grandparent rights, even when the children are clearly emotionally bonded to the grandparents, and even when the grandparents are significantly better parents than the biological parents of the children. WASHINGTON (AP) As it nears a decision that could touch every American family, the Supreme Court is assessing grandparents' right to see their grandchildren even when the parents object.
After hearing arguments today, the justices must decide whether parents' constitutional right to raise children without government interference trumps a Washington state law that lets grandparents and others gain court-ordered visitation found to be in a child's best interest. The dispute carries the court into "a complex constitutional area in which the liberty interests of parents, children and grandparents often swirl in emotionally charged conflict," said David Hudson, a Nashville, Tenn., lawyer who has studied the Washington case. The nine justices six of them grandparents will take their initial vote in a closed-door meeting Friday. A final decision is expected by late June.

    Finally, since all things these days eventually revert back to Elian, we now have a timely glimpse of how the Supreme Court might rule if it is ever asked to chime in on the Gonzalez case.

    Don't worry, grandma and grandpa.
    You'll still get to see your beloved grandchildren. That is, unless you happen to get involved in a dispute with the children's parents which causes them to draw the line and halt your visits.
    And in that case, the law in Washington state probably wasn't going to help you much anyway.
    As for the rest of you, well, don't count on too many laws in too many states to help you get visitation rights to another family's children. You'll just have to get those rights by agreement with the family or through some extraordinary judicial intervention which happens once in a blue moon.
    That's about the simplest way I know to explain the effect of Monday's Supreme Court ruling invalidating a Washington state law which allowed anyone to ask a judge for visitation rights to a child. In a 6-3 opinion, the Court ruled that a parent's constitutional right to raise his or her child trumps a state law that is designed to challenge those rights, even if the state law might make some sense in some situations. Put another way, the Court was unwilling to recognize that biological grandparents might also have a constitutional right to have court-ordered access to their grandchildren.

Common bases for no-fault divorce are "irreconcilable differences," "irretrievable breakdown" or "incompatibility." The list of grounds for a fault-based divorce may include: adultery, physical cruelty, mental cruelty, attempted murder, desertion, habitual drunkenness, use of addictive drugs, insanity, impotency, and infection of one's spouse with venereal disease.

    Grandparents Rights to Visitation By Maury D. Beaulier, Esq. Grandparents often envision their golden years spent by happily caring for and treating their grandchildren. In recent years, as a symptom of our skyrocketing divorce rates, much litigation has occurred when grandparent's are prevented from seeing their grandchildren.  As a direct result, today all states have statutes authorizing a court to award visitation to a grandparent under certain circumstances In Minnesota, a district court has broad discretion to determine what is in the best interests of a child regarding visitation .  The authority of the Court to consider grandparents when making visitation decisions with regard to Grandparents is spelled out in Minnesota Statute § 257.022, subd. 2 (1994).  This statute specifically allows the district court to consider a request (by petition) for grandparent visitation if t he grandparents are the parents of a deceased parent of the child It states that: If a parent of an unmarried minor child is deceased, the parents and grandparents of the deceased parent may be granted reasonable visitation rights to the unmarried minor child during minority by the district court upon finding that visitation rights would be in the best interests of the child and would not interfere with the parent child relationship. The court shall consider the amount of personal contact between the parents or grandparents of the deceased parent and the child prior to the application. during or after proceedings for dissolution of the child's parents' marriage, child custody, legal separation, annulment, or paternity; or if the grandchild has resided with the grandparents or great-grandparents for a period of twelve months or more and is subsequently removed by the child's parents. Visitation must be found to be in the best interest of the child. M.S.A. §257.022.
