GRASSROOTS MOVEMENT
From The National Association of Mothers' Centers

MOTHERS is a grassroots initiative that seeks to improve caregivers' economic status by calling attention to their essential contribution to the economy and to society. The initiative was launched in 2002 by a group of mothers, writers, and women's advocates around the country. The founders include Ann Crittenden, author of The Price of Motherhood; Naomi Wolf, author of Misconceptions, Barbara Seaman, a nationally recognized women's health advocate, and the National Association of Mothers' Centers, a non-profit, non-partisan organization with some 3,000 members and 40 mothers' support centers throughout the U.S. MOTHERS will use its website ( www.mothersoughttohaveequalrights.com ) to mobilize grassroots actions on behalf of caregivers. The site will serve as a clearinghouse to inform supporters about other interested people in their area, to publicize initiatives taken by other grassroots mothers' groups around the country, to suggest coordinated local campaigns, and to enable supporters to quickly contact their state and national legislators on key issues. We are working to have mothers' work and contributions recognized.

Tammi it all depends on the state you live in to what rights grandparents have. Very few states have grandparent rights. And in most states a third party can not intervene unless there is probable cause. My parents are going through a custody battle with my sister and they where allowed to intervene BUT only because they have raised my niece since birth and she is now 7 years old. Women’s Equality Rights
Theoretically, women’s equality rights are guaranteed through many laws and policies:
  • Section 15 of the Canadian Charter of Rights and Freedoms guarantees that women will receive equal protection and equal benefit of the law. The purpose of the Charter is to ameliorate the position of groups who have suffered disadvantage.
    In 1995, the government adopted the Federal Plan for Gender Equality, and promised to do an analysis of the impact on women of all new laws and policies (a “gender-based analysis”).
    In 1995, the federal government endorsed the Beijing Platform for Action at the Fourth World Conference on Women organized by the United Nations. In June 2001 it promised to take further actions towards women’s equality and empowerment.
Mothers are women, and any change to family law on custody and access of children must take into consideration the actual conditions of women’s lives. The government must ensure that women will not be disadvantaged by family law reform, and that our equality rights will be protected.

As stated above, there are estimated to be more than 80,000 mothers among the women in prison and jail. They have approximately 200,000 children aged under 18. Surveysindicate that the great majority of imprisoned women with children under 18 lived with their children before they were imprisoned. All states have laws permitting the termination of parental rights of parents who are incarcerated. Women's prisons are often located in rural areas far from the cities in which the majority of inmates lived, making it difficult to maintain contact with their children and jeopardising the prospects of successful reunification. A national study found that more than half of the children of women prisoners did not visit their mothers while they were in prison. Over 60 percent of the children who did not visit lived more than 100 miles (160 kilometres) from the prison where their mother was incarcerated. Many of the children of incarcerated women are placed in foster care, "where the inability of imprisoned mothers to meet court-mandated family reunification requirements for contact and visitation with their children can result in termination of the mother's parental rights."

The roles and rights of mothers in our society is changing with the times. In the past, a rule called the "tender years doctrine" provided that there was a presumption used by the courts that young children should remain in the custody of their mothers. Today, the tender years doctrine has been abolished in Alaska. A statute provides that "neither parent, regardless of the question of a child's legitimacy, is entitled to preference in the awarding of custody." Despite this shift in approach, mothers in Alaska do have many rights. Once a child is born, the duty of a father to support his child begins. This is a duty that parents can not usually relinquish on their own. Fathers who owe child support can not normally relieve themselves of the obligation by filing bankruptcy. Courts generally do not allow parents to agree together that a father does not have to support his child. The rationale behind this view is that a child's need for support is more important that a mother's desire not to require support from a father. Mothers can ask an attorney to file a lawsuit for custody of a child and child support from a father. If a man denies that he is the father of a child or if it is unclear to the mother who the father is, a court can require that a paternity test be taken in order to establish the identity of a father. The Child Support Enforcement Division (CSED) can assist a mother in collecting support and establishing paternity.

Under the California Fair Employment and Housing Act (FEHA), employees are entitled to take leave on account of their own medical problems or those of a family members. This is referred to as Family Care Leave
Employees also have a right to family and medical leave under the Federal Family Medical Leave Act (FMLA) . Employees' rights under the California law are the same or better than under the Federal law.
Under California law employees have the right to take medical leave for themselves or to care for family members. To be eligible for leave, the following requirements must be met:
1) the employee must have been employed by that employer for over 12 months 2) the employee must have worked at least 1,250 hours in the last 12 months 3) the employer must have at least 50 employees within a 75 mile radius of the location where the employee who wants leave works
If these conditions are met, the employee is entitled to take up to a total of 12 workweeks off for family care or medical leave in any twelve month period. The employer does not have to pay the employee's salary during this time.
The "family members" that an employee may take leave to care for include parents, spouses, and children. Children under eighteen who work cannot take leave to care for their parents, and parents cannot take leave to care for children who are over eighteen.

(SHERWIN CRASTO /AP) When Gita Hariharan's son was a year old, she went to the bank to open an account to save for his education. Yet she was jolted to find that, without her husband's approval, she'd forfeit the funds to him if the couple ever broke up. Later, Mrs. Hariharan was shocked again when a federal bank would not let her independently buy Indian bonds for the boy. Legally, she was not considered a natural guardian of her child - so long as his father was alive. Under a set of traditional and largely unchallenged Hindu family laws, the husband is the sole guardian of his children. To this educated and cosmopolitan working mother, the contradictions of the existing law seemed too great. Hariharan went to court. "In this society you are made to feel you aren't really a woman unless you are a mother," says Hariharan, a novelist. "Yet then when it comes to the question of guardianship of your children, you are not recognized. It is absurd." However, in an important victory for mothers here, on Feb. 18 the country's highest court agreed with Hariharan. The Indian Supreme Court in New Delhi affirmed that moms have a similar status to dads under Indian law. The mother "would undoubtedly be the natural guardian," according to the Indian Constitution, wrote Indian Chief Justice A.S. Anand, in a ruling that affects all Indian women, well over half of the country's 990 million people.
