At the end of the day, a particular practice must be ousted only if after careful consideration it is found to be in fact a violation of the constitution, not on the assertion of someone who finds it unfamiliar or unusual, but on merit. There are encouraging signs that the courts are willing to grapple with the issues of customary practices that may not sit comfortably within a Western value system but nevertheless have to be accommodated according to the constitution. Thus, while it is more usual to use the constitutional notion of human dignity in defence of individual rights, it does not seem far-fetched to conceive of the notion of human dignity being central in a court's assessment of a practice like

By Mark Charalambous, February 17, 2001 As the father's rights movement gains momentum and some much-needed recognition, it's instructive to periodically articulate the fundamental problem: Gender-profiling in family law, which virtually ensures that children lose any chance of a meaningful post-divorce relationship with their fathers. Opponents of fathers rights continue to disguise their antipathy to it by hiding behind the "best interests of the child" mantra. The courts are not biased against fathers, they say, they merely follow the law, which mandates that custody decisions be made in the "best interest of the child." Moms usually get custody, they argue, because they are the primary caretaker or "nurturing parent" in the family. Ignoring for the moment that even when fathers are the primary caretakers they still somehow end up as non-custodial parents, this primary caretaker policy is a holdover from the "tender years doctrine," which is no longer coded in Massachusetts family law. Because of the trend towards making the law gender neutral, it has become necessary to replace gender-specific language with politically correct code words, like "best interests of the child," "nurturing parent," and "abusive parent"

The rights of parents to the care, custody and nurture of their children is of such character that it cannot be denied without violating those fundamental principles of liberty and justice which lie at the base of all our civil and political institutions, and such right is a fundamental right protected by this amendment (first) and Amendments 5, 9, and 14. Persuading women to seek legal help is often slow and emotional work. "Not all women agree to write an application," says Mrs. Abdullayeva. "Most of them are afraid and address us either orally or by phone." Most complaints, Abdullayeva says, involve frustrations over efforts to find employment or housing assistance. But "the most sore subject" usually involves violence women suffer at the hands of their husbands or mothers-in-law. Women tearfully tell center staff about their husbands’ drinking, drug addiction, violence or embezzlement. Abdullayeva has also heard claims of abandonment. "Unemployment has changed the character of family attitudes," she says. "Nowadays it is not unusual when men leave their wives and children and go to rich women. Earlier such cases caused sharp negative [reactions] in society."

In bizarre and illegal rulings, family court judges ignore or deliberately suppress evidence of male perpetrated family violence and child molest. Fathers who are batterers and sex offenders are routinely granted visitation and custody, while mothers and children trying to escape abuse are punished through financial sanctions, loss of custody, supervised visitation, jail and institutionalization. [1]
Very occasionally, men reporting abuse of their children have also been targeted for retaliation through family court. [2] However, the systematic mishandling of domestic violence and child molest cases as "custody disputes" is based in a financial corruption scheme that calls for diverting grant program funding through "high conflict" cases, in the guise of promoting "fatherhood" and "shared parenting" post-divorce. [3]
Rather than assisting men become responsible parents, "Responsible Fatherhood", "Access to Visitation Enforcement" (supervised visitation for noncustodial parents), "Child Support Enforcement" and similar federal programs perpetuate abuse of women and children through the legal system. [4] Abusive men striving to maintain control over their victims are provided an array of benefits, not only to get custody and get out of paying child support, but to terrorize the mothers of their children and society in general. [5] Government programs are not producing responsible fathers, but motherless children, in order to advance the agenda of the so-called "fathers' rights" movement.

by T rish W ilson E ven as fathers are disappearing from the lives of millions of women and children, they're turning up in newsletters, local activist groups, and cyberspace as members of an outspoken movement for "fathers' rights" whose declared purpose is to "fight back." Fight back against what? Against the power of women and children, of course. Although these groups' public pronouncements are full of high-minded sentiments a desire to help men to become better fathers, for instance and platitudes such as "Dads are more than a paycheck," members are not good fathers seeking support but rather angry men (and women who stand by them) seeking expanded male entitlement. Their private communications are diatribes against child support and in favor of controling women. Not even much lip service is paid to the father-child relationship. These days, fathers'-rights activists, like right-wing militia sympathizers, are particularly active on the Internet. Some cybergroups, like the Fathers' Manifesto, actively recruit members and spread misinformation there. The Manifesto is an umbrella organization founded by John Knight Men's Action Network (MAN), seeks to define the new male rights as "safeguards" and to devalue women's rights by referring to the "radical cultural philosophy that sees men as the enemy, regards the traditional family as a tool to oppress women and sees every male-female relationship as a power struggle."
