Guidance on Constitutionally Protected Prayer in Public Elementary and Secondary Schools February 7, 2003
Introduction Section 9524 of the Elementary and Secondary Education Act ("ESEA") of 1965, as amended by the No Child Left Behind Act of 2001, requires the Secretary to issue guidance on constitutionally protected prayer in public elementary and secondary schools. In addition, Section 9524 requires that, as a condition of receiving ESEA funds, a local educational agency ("LEA") must certify in writing to its State educational agency ("SEA") that it has no policy that prevents, or otherwise denies participation in, constitutionally protected prayer in public schools as set forth in this guidance. The Section 9524 Certification Process In order to receive funds under the ESEA, an LEA must certify in writing to its SEA that no policy of the LEA prevents, or otherwise denies participation in, constitutionally protected prayer in public elementary and secondary schools as set forth in this guidance. An LEA must provide this certification to the SEA by October 1, 2002, and by October 1 of each subsequent year during which the LEA participates in an ESEA program. However, as a transitional matter, given the timing of this guidance, the initial certification must be provided by an LEA to the SEA by March 15, 2003.

Holiday School Letter Dear Concerned Citizens, The American Center for Law and Justice wishes everyone a happy holiday season. Undoubtedly, students in school districts all over the country are celebrating the holidays in a variety of creative and entertaining ways. We are aware that some of these celebrations may be hindered by questions of what is permitted or prohibited by the United States Constitution. Consequently, the purpose of this letter is to assist local school district officials in addressing both what activities are permissible for schools to engage in, and to protect the rights of student participation in Christmas or other holiday observances in public schools. By way of introduction, the American Center for Law and Justice (ACLJ) is a not-for-profit public interest and educational group. Our organization exists to educate the public and the government about the right to freedom of speech, particularly in the context of the expression of religious sentiments. The Constitution permits much private religious activity in and about the public schools. Unfortunately, this aspect of constitutional law is not as well known as it should be. Some say that the Supreme Court has declared the public schools "religion-free zones" or that the law is so murky that school officials cannot know what is legally permissible. The former claim is simply wrong. And as to the latter, while there are some difficult issues, much has been settled. It is also unfortunately true that public school officials, due to their busy schedules, may not be as fully aware of this body of law as they could be. As a result, in some school districts some of these rights are not being observed. The organizations whose names appear below span the ideological, religious and political spectrum. They nevertheless share a commitment both to the freedom of religious practice and to the separation of church and state such freedom requires. In that spirit, we offer this statement of consensus on current law as an aid to parents, educators and students.

The theology of Santa
Santa, as taught to most children, has most of the attributes of God: He is virtually omnipresent . He can visit hundreds of millions of homes in one night. He is omniscient . He monitors each child; he is all-seeing and all-knowing; he knows when they are bad and good. Although not omnipotent, he does have great powers. He can manufacture gifts for hundreds of millions of children, and deliver them in one night each to the correct child. He is all-good and all-just . He judges which children have shown good behavior and rewards them appropriately. Bad children are bypassed or receive a lump of coal. He is eternal He rewards good and punishes bad behavior. However, there are negative aspects to Santa's behavior that can damage a child's self-esteem: In practice, children are not rewarded with gifts according to their behavior; they receive presents according to the amount of money that their parents are willing or able to spend on them at Christmas time. A child may receive little or nothing from Santa because his/her parents are poor. Unfortunately, the child has probably adsorbed from the media and their friends only bad children get nothing from Santa. He/she might begin to look upon themselves as a bad person. This may well damage their self esteem.

    Do scientific integrity and equity require that we teach a competing theory of human origins?

  • May a public school science teacher's right to teach evolution be restricted?
    No. The United States Supreme Court has determined that it is unconstitutional to restrict an educator's right to teach evolution. Epperson v. Arkansas , 393 U.S. 97 (1968). May a science teacher who teaches evolution also teach creationism? No. Educators may not teach, as fact, the theory that humankind was created by a divine being. In science classes, educators must present only scientific explanations for life on earth and scientific critiques of evolution. Furthermore, schools may not refuse to teach evolution in an effort to avoid offending religious individuals.     Religion in the Public Schools Teaching About Religious Holidays General Rule: Teachers must be careful not to cross the line between teaching about religious holidays (which is permitted) and celebrating religious holidays (which is not). Celebrating religious holidays in the form of religious worship or other practices is unconstitutional. Teaching about a holiday will be constitutional if it furthers a genuine secular program of education, is presented objectively, and does not have the effect of advancing or inhibiting religion. See Florey v. Sioux Falls School Dist. 49-5, 619 F.2d 1311 (8th Cir.), cert. denied , 449 U.S. 987 (1980). The U.S. Supreme Court has not specifically ruled on this subject.

    Golden Rule poster puts teacher on spot
    "Do unto others as you would have them do unto you." Who could dispute the truth of that Golden Rule, which is found in the scriptures of nearly every religion? Is it likely to warp the mind of a first grader? Patricia Matthews doesn't think so, and she's distressed that she may have to take a poster with the verse on it off the wall in her Austin Elementary School classroom because it has the Bible reference, "Luke 6:31." How about a big, yellow smiley face with this bit of wisdom: " Smile, God loves you." Yes, she's been ordered to remove that from her wall as well. An impending inspection by officials with the Texas Education Agency makes the speedy removal crucial, because religious instruction in public schools is prohibited. "Public schools may not provide religious instruction, but they may teach about religion, including the Bible or other scripture..." say the guidelines, which are based on Supreme Court decisions and state and federal education codes.

    Colorado comes face to face with capital punishment
    When the federal jury returned a death sentence for convicted Oklahoma City bomber Timothy McVeigh, the reaction outside Denver's federal courthouse by onlookers was mixed. There was not the jubilation that followed the guilty verdict 11 days earlier. It is very rare for a Colorado jury, albeit a federal jury, to impose the death penalty on a convicted murderer. Coloradans have always been very reserved when it comes to sentencing a murderer to death. The state hasn't had an execution since 1967 and has only five people on death row. Information from the Death Penalty Information Center in Washington D.C. shows that Colorado has the third lowest total in the nation among capital-punishment states. In contrast, California leads the nation with 476 death-row inmates. According to the Colorado Bureau of Investigation's (CBI) latest report, there were 176 homicides in Colorado in 1996. The CBI defines homicide as, "the willful (non-negligent) killing of one human being by another." Over the past 10 years there have been over 1,800 homicides in Colorado and yet there are only five death-row inmates. One of the five people on Colorado's death row, Gary Lee Davis, was convicted and sentenced to death for the 1986 rape and murder of Virginia May near Byers in Adams County. The 53-year-old Davis has been on death row for the past 11 years awaiting his execution by lethal injection. He recently confessed to the crime and told the victim's family that he was sorry.

    A Joint Statement Of Current Law
    The Constitution permits much private religious activity in and about the public schools. Unfortunately, this aspect of constitutional law is not as well known as it should be. Some say that the Supreme Court has declared the public schools "religion-free zones" or that the law is so murky that school officials cannot know what is legally permissible. The former claim is simply wrong. And as to the latter, while there are some difficult issues, much has been settled. It is also unfortunately true that public school officials, due to their busy schedules, may not be as fully aware of this body of law as they could be. As a result, in some school districts some of these rights are not being observed. The organizations whose names appear below span the ideological, religious and political spectrum. They nevertheless share a commitment both to the freedom of religious practice and to the separation of church and state such freedom requires. In that spirit, we offer this statement of consensus on current law as an aid to parents, educators and students. Many of the organizations listed below are actively involved in litigation about religion in the schools. On some of the issues discussed in this summary, some of the organizations have urged the courts to reach positions different than they did. Though there are signatories on both sides which have and will press for different constitutional treatments of some of the topics discussed below, they all agree that the following is an accurate statement of what the law currently is.
