Salaries over the hiring range must be reviewed and approved by the manager of Compensation, Office of Personnel Management. by Jay Alan Sekulow The holiday season is almost upon us. It won't be long until it's time for programs, parties and pageants.
Unfortunately, some of these celebrations may be hindered by questions of what is permitted-or prohibited-by the United States Constitution. Although court decisions permit holiday observances, some national organizations have been pressuring local school districts to censor religious expression during Christmas. This article will try to answer the most commonly-asked questions about the rights of students and teachers to participate in these observances.
Can students sing religious Christmas carols at school events or in holiday programs?
YES. As a matter of fact, no court has ever banned the singing of religious Christmas carols by public school choirs. A case that addressed this issue explicitly upheld singing religious Christmas carols in public schools. In Florey v. Sioux Falls School District, the United States Court of Appeals for the Eighth Circuit held that studying and performing religious songs, including Christmas carols, is constitutional if the purpose of the study and performances is the "advancement of the students' knowledge of society's cultural and religious heritage as well as the provision of an opportunity for students to perform a full range of music, poetry and drama that is likely to be of interest to the students and their audience."
The federal appeals court in Florey found that religious songs and symbols can be used in public schools if they are presented in a "prudent and objective manner and only as part of the cultural and religious heritage of the holiday."

The U.S. Department of Education on July 12, 1995 issued the following statement regarding the application of the First Amendment and the Equal Access Act to public schools. Student prayer and religious discussion: The Establishment Clause of the First Amendment does not prohibit purely private religious speech by students. Students therefore have the same right to engage in individual or group prayer and religious discussion during the school day as they do to engage in other comparable activity. For example, students may read their Bibles or other scriptures, say grace before meals, and pray before tests to the same extent they may engage in comparable non-disruptive activities. Local school authorities possess substantial discretion to impose rules of order and other pedagogical restrictions on student activities, but they may not structure or administer such rules to discriminate against religious activity or speech. Generally, students may pray in a nondisruptive manner when not engaged in school activities or instruction, and subject to the rules that normally pertain in the applicable setting. Specifically, students in informal settings, such as cafeterias and hallways, may pray and discuss their religious views with each other, subject to the same rules of order as apply to other student activities and speech. Students may also speak to, and attempt to persuade, their peers about religious topics just as they do with regard to political topics. School officials, however, should intercede to stop student speech that constitutes harassment aimed at a student or a group of students.

email: uge1067@arches.uga.edu Rosalind Swainson FACS Program Assistant Asthma has reached epidemic proportions in the United States affecting about 17 million people of all ages, and races, particularly children. The Environmental Protection Agency is joining with other Federal and non-profit organizations to sponsor asthma education events around the country during May – Asthma Awareness Month – to raise awareness about the indoor and outdoor pollutants that trigger asthma episodes, and how to avoid them as part of a comprehensive asthma management plan. Asthma is a long-term, inflammatory disease in which the airways of the lungs constrict causing wheezing, breathlessness, chest tightness, and coughing. Asthma can be life threatening. Today, an average of 1 in 13 school children have asthma. According to a U.S. Department of Health and Human Services report, between l980 and 1994, the percentage of pre-school aged children with asthma increased 160 percent, with an alarming 8,000 to 26,000 new asthma cases arising each year.

s I write this, my husband is in South Africa.The eight-hour time difference means that as I end my day, he’s beginning a new one. Writers live in much the same world. Though the air is cool outside and the trees have lost their leaves, it’s actually somewhere around late summer as far as submitting your writing.
L ead times vary for each publication, but an average lead time is nine months. Some have shorter lead times and some have lead times as long as 18 months. One short story I sold in January, 1998 to Power Station – “Better Than Pizza” – will come out in April, 2000. Their theme list is planned almost two years in advance. A story that is coming out in Angels on Earth in the November/ December issue – “In The Palm of His Hand” – required a photo shoot. My whole family and I, dressed in sweaters and coats, were in an hour-long photo shoot in July.

In 1998, Vice President Gore challenged the nation to make America Count. Beginning fall semester 1999, Michigan State University accepts the America Counts Challenge as part of the expanded Young Spartans Program/ America Reads program. America Counts tutors will be placed in Lansing Middle Schools afterschool program to tutor 11-14 year olds in mathematic skills. Michigan State University is Meeting the America Counts Challenge
America Counts is the national challenge to improve mathematics achievement for all of the nation's school children. Vice President Gore listed several new initiatives that he said will contribute to mobilizing a cadre of math tutors with a goal of helping all children master challenging math, including algebra and geometry, by the end of the 8th grade. Among them:
  • A federal work-study waiver will encourage colleges to sign up students to tutor in math . A similar waiver is already available for college students who tutor young students in reading under the America Reads initiative. The National Science Foundation will help develop training programs and materials to enhance the impact of the tutoring effort.

WASHINGTON Like most teachers, Supreme Court justices take a long summer vacation. And some justices, like some teachers, earn a little extra cash by teaching summer school.
As usual, the court finished this year's term by July and won't begin to hear cases again until October. The break allows for trips outside the capital and for busman's holidays spent lecturing law students in Italy or the Greek coast.
American law schools sponsor the programs, which typically offer salaries as well as travel, hotel and food expenses. Schools consider it a coup to land a Supreme Court lecturer, who gets headline billing and helps attract paying students.
Louis Del Duca, who directs overseas summer programs at Penn State's Dickinson School of Law, said justices and students benefit from the experience.
"It's the difference between learning from a printed text and having one mind exposed to another mind on the spot," said Del Duca, whose school has been host to about a half-dozen justices in recent summers. "There's no substitute for that."

RIN 2115-AE01 Operational Measures To Reduce Oil Spills From Existing Tank Vessels Without Double Hulls AGENCY: Coast Guard, DOT. ACTION: Supplemental notice of proposed rulemaking. SUMMARY: The Coast Guard proposes regulations that would require the owners, masters, or operators of tank vessels of 5,000 gross tons (GT) or more that do not have double hulls and that carry oil in bulk as cargo to comply with certain operational measures. The proposed regulations contain requirements for bridge resource management training, rest hour minimums, enhanced surveys, maneuvering performance capability requirements, and other measures aimed at reducing the likelihood of an oil discharge from these vessels. Additionally, the Coast Guard proposes to amend requirements for the carriage of onboard emergency lightering equipment. These proposed regulations represent the second step in the Coast Guard's three-step effort to establish structural and operational measures for tank vessels without double hulls as required by the Oil Pollution Act of 1990 (OPA 90).

Character Education Getting a Boost
Some schools that received federal funding to pilot character education programs are now going to their state legislatures or local communities to continue them. Included: Links to character education resources from Utah and New Jersey. Encouraging results from federally funded pilot character education programs have prompted some educators to request and receive state funding to continue the efforts. And when legislators did not approve money in some states, school districts have supported the efforts on their own. "There seems to be a great demand for [character education] in the local school districts," according to Kathleen Plato, program supervisor for character education for the Washington State Office of Public Instruction "The key is to have the community buy into it ask the community what character education is, and try to integrate it into the curriculum."
