Religious Expression in North Carolina Public Schools
The United States Constitution guarantees religious liberty through the First Amendment which says that the government "... shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof... " Both parts of this guarantee of religious libertythe Establishment Clause and the Free Exercise Clauseapply to public schools because public schools are entities of the government. Public schools are not required to be "religion-free zones." The Constitution, Congress, and the Courts permit a wide range of voluntary religious activity in and around public schools. An individual's right derived from the Free Exercise Clause to engage in religious activities in school or on school property must frequently be balanced with the Establishment Clause and the necessity of maintaining public schools for their intended educational purposes. The proper balance between these competing interests is the subject of constant judicial review. The following questions are frequently asked by school officials and others. The answers reflect the law as established by U.S. Supreme Court decisions and federal statutes.

The following information is intended to provide guidance as you plan and monitor the activities in
your classroom. It is not always possible to provide concrete answers to questions on this subject
and, therefore, considerable judgment is required of both principals and staff members as we
implement the concept of this policy. LEGAL BACKGROUND The First Amendment to the United States Constitution declares that Congress shall make no laws respecting an establishment of religion, or prohibiting the free exercise thereof. The First Amendment requires the strictest neutrality on the part of federal, state, and local governments in their dealings with and attitudes toward religion. Epperson v. The Constitution permits much private religious activity in and about the public schools. Unfortunately, this aspect of constitutional law is not as well known as it should be. Some say that the Supreme Court has declared the public schools "religion-free zones" or that the law is so murky that school officials cannot know what is legally permissible. The former claim is simply wrong. And as to the latter, while there are some difficult issues, much has been settled. It is also unfortunately true that public school officials, due to their busy schedules, may not be as fully aware of this body of law as they could be. As a result, in some school districts some of these rights are not being observed. The organizations whose names appear below span the ideological, religious and political spectrum. They nevertheless share a commitment both to the freedom of religious practice and to the separation of church and state such freedom requires. In that spirit, we offer this statement of consensus on current law as an aid to parents, educators and students. Many of the organizations listed below are actively involved in litigation about religion in the schools. On some of the issues discussed in this summary, some of the organizations have urged the courts to reach positions different than they did. Though there are signatories on both sides which have and will press for different constitutional treatments of some of the topics discussed below, they all agree that the following is an accurate statement of what the law currently is.

Ann Quattrone, mother of two, said the lack of day-care options is compounded by a scarcity of in-home providers. Some Yokota parents enroll their children in private Japanese preschools off base, but those can be three times more expensive than base programs, Bruner said Sunday. Her daughter attends a private preschool two days a week.

Earlier this year, a kindergartner named Kayla was told she couldn't pray with her friends during lunch. Her family filed suit against her New York school district, and a federal judge ordered the school to allow the girl to pray while the trial proceeds. This situation probably never would have arisen if school officials had been properly cognizant of a string of Supreme Court decisions in recent decades that have clarified students' rights and responsibilities under the law regarding religious exercise and free speech. Ignorance of these decisions has led to school policies, as in Kayla's case, that chill legal religious practice and that cold-shoulder the legitimate and legal teaching about religion in such subjects as social studies, literature, history, and geography. According to the Constitution, the American people are guaranteed the right to practice religion free from government intervention. But interpreting the First Amendment clause "Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof" has not been easy, particularly pertaining to public schools. Nonetheless, the High Court has said, generally speaking, that voluntary student expression and the study of religion are protected but proselytizing and school-sanctioned or teacher-led prayers are not.
