Florida Florida is presenting options to families with special needs children that run the gamut of Medicaid managed care arrangements - fully capitated HMOs, a PCCM, and a Title V/Medicaid managed care option. What's New? Children with special health care needs in Florida - SSI disabled children and children eligible for Title V services - have had the option of enrollingin Medicaid HMOs sincethe early 1980s. Since 1992, they have been requiredd to enroll in Medicaid managed care under the state's 1915(b) waiver. But they have three choices for enrollment:
  • In 1991, the state began a primary care case management (PCCM) program called MediPass, where providers (which can be a physician or a clinic) recieve a monthly administrative payment plus fee-for-service. In 1992, the state required most SSI recipients to enrollin MediPass.
  • In 1997, Recipients were given the option of enroling in either MediPass or an HMO. There are now 16 HMOs participating in the program. Capitation rates vary by eligibility category, age and geographic are but ar not adjusted to reflect the health statusof special needs children.
  • In 1996, the state Legislature directed that the state's Title V program establish a PCCM program as a component of the MediPass program. Originally called the Alternative Service Network, this option became available in 1997 and now is called the Children's Medical Services (CMS) Network. The state plans to capitate the program in summer 2000. (See box for details.)

New federal education rules will force Florida to do what it has never done: penalize public schools when special-education students fail to make acceptable gains on statewide tests.
As a result, the state could see a marked increase in the number of failing schools, particularly those teetering between flunking and passing.
The rules are part of President Bush's No Child Left Behind Act, which requires all students in gradesthree through eight to take tests designed by the states.

Highlandtown Elementary School in Southeast Baltimore would seem to be a classic candidate for aid under Title I, the flagship federal program to help disadvantaged students. The numbers are certainly there. About 70 percent of the school's students qualify for free school lunches, a standard benchmark for measuring poverty. But this coming year, the school won't get a dime from the $8.8 billion program. More than 100 Baltimore schools have even higher poverty levels. The district ran out of Title I money before it got to the 765-pupil school. Highlandtown is not alone. Across the country, one in five schools with a poverty rate between 50 percent and 75 percent does not receive Title I aid, according to the U.S. Department of Education, even though research suggests that it is such high concentrations that pose some of the greatest academic obstacles.

Course explores the special issues and methods involved in counseling minority, bilingual, disabled, low SES, and other special population groups. This course is designed to both (a) provide students with an overview of the issues related to providing counseling services in a multicultural, pluralistic society, and (b) to critically examine the current trends in counseling toward serving special needs populations. We will focus particularly upon various special needs, or high risk, populations such as: cultural and ethnic minorities, students with disabilities, bilingual children, exceptional children, and children from rural, migrant, homeless, and low SES families. This course is based upon the realization that the demographics of our nation are changing dramatically. School districts will have to adjust to a student body that is more diverse than ever before. Further, our schools are required to work with students experiencing a variety of physical, mental and socio-economic challenges which place them At-Risk for obtaining the psycho-social and academic competencies necessary for life success. Professional counselors, working in mental health settings, need to have a working knowledge of the issues, concerns, and perspectives of the various special needs populations and be able to appropriately develop both preventative and remedial counseling interventions to serve these groups.

FEDERAL LAWS AND REGULATIONS Rehabilitation Act of 1973 and the Rehabilitation Act of 1973 as Amended by Public Law 99-506 and Public Law 100-630 Some sections of interest in the Rehabilitation Act of Act 1973 and its amended portions to interpreters include: Title I
  • Section 101 decribes the provisions for a state plan in each of the states Section 101(9)(A) provides for individualized written rehabilitation programs for each eligible individual with a disability Section 101(15) provides for continuing statewide studies of the needs of persons with disabilities Section 101 (22) provides for the establishment and maintenance of information and referral programs (the staff of which shall include, to the maximum extent feasible, interpreters for the deaf)...to assure that individuals with handicaps...are afforded accurate vocational rehabilitation and appropriate referrals... During the K-12 years
  • Since 1986 the public school districts have been able to send children who present the greatest challenges in learning or behavior to private schools. The children and schools in this program are chosen by public school district officials, not by the parents. At present over 8000 Florida K-12 children are attending private schools at public expense in three different programs: for children with special needs, children at risk of dropping out, and children in the juvenile justice system. Over $45 million is paid for them.
  • Florida has now made available two types of tuition vouchers for K-12 students that follow them to government or non-government schools. These are the Opportunity Scholarships and the McKay Scholarships for Children with Disabilities. These are parental choice programs.
  • There are many supplementary programs available to help children during their K-12 school years. All of these federal, and some of the state, K-12 programs are based on the "child-benefit" principle. Ranging from hearing and vision screening for Kindergartners, to lunch for low-income children, to extensive assistance for children with disabilities, all these funded services are required to be provided to the eligible children whether they are attending public, private or parochial schools.
  • The amount of funds received by the districts is in some cases based on a count of the eligible children in both the public and private sectors. Many of the eligible children in non-government schools never receive the services for which the funding was received by the districts.
