The Abuse of Power in Florida Community Colleges
Part V "HE'S FIRED. WE'RE JUST WAITING FOR DUE PROCESS." In April, Alan Thornquest, Tom Ward and I had called the leadership of the United Faculty of Florida in Tallahassee asking for help. On the 27th, the UFF sent Tallahassee attorney Tom Brooks down to hear what we had to say. We met at Fat Boy's Restaurant in Cocoa. He took voluminous notes, told us to inventory our personnel files, and initial and date the pages. He said he'd tell our story to the decision makers at the UFF. In the middle of the afternoon on Thursday, May 14, 1992, I was sitting in the BCC Melbourne library reading professional journals. Provost Aitken and Director of Employee Relations Bob Craig came to my table and handed me a document. (I've since wondered if they would have been doing what they were doing if they could have known that both would soon suffer near-fatal heart attacks.) I glanced at the document, went to a pay phone and called Tom Brooks in Tallahassee. The official minutes of the board of trustees put it this way: Dr. King distributed a resolution to the Board members. Mr. Matheny stated this is a petition filed by the President of the College under Chapter 6A-140411(6) of the Board of Education Regulations to not renew a contract of a tenured professor. This petition requires a due process hearing wherein the College Board would sit as a fair and impartial quasi-judicial body to determine whether or not the charges referenced in this petition should be sustained. The affected instructor has twenty days to respond to the petition. Mr. Matheny stated the Board would not officially accept the petition until June 11, the regularly scheduled Board meeting. He stated the Board should not discuss the petition with any person who is part of the College community. Mr. Matheny stated he would serve as counsel and advisor for the Board. Mr. Matheny reported no action is required by the Board at this time.

In the complaint, the complainant alleged discrimination based on disability in the following manner:
  • The University has failed to provide the complainant with effective auxiliary aids or services to accommodate her disability because it has not provided her with electronic remote access to its libraries. In doing so, the University has denied her access to its libraries, which has been afforded to other members of the general public.
  • In reaching a determination with respect to the complaint allegation, OCR reviewed documentation submitted by the complainant and the University and information available at the University's on-line website. OCR also conducted interviews with University personnel and the complainant. As a result of our investigation, OCR has made the following determination.
