FR 11: Enact False Claims Legislation Texas should adopt a False Claims Act to discourage fraud against public programs. Background Several states have followed the federal government's lead in vigorously attacking fraud against public programs, using false claims acts modeled after federal law to recover funds stolen from state and local governments. In California, for example, the Office of Attorney General recently recovered $1.7 million from a vendor who used false documents to defraud the state in a computer purchase. States are learning that a potential for serious fraud exists wherever public funds are spent. California's attorney general, for example, is investigating fraud in a wide range of government programs; prison construction projects are particularly ripe for fraud. Construction vendors in California have been known to substitute inferior products and fail to provide promised equipment. Federal False Claims Act The importance of preventing fraud against public programs has been underscored by the wide-ranging authority granted the U.S. Attorney General (USAG) to investigate and litigate false claims involving government programs. The federal False Claims Act prohibits "knowing" acts involving false or fraudulent claims for government payments or approval; false records or statements used to collect these claims; conspiracies involving false claims; deliberate withholding of government property legally owed to a person; false receipts given for government property; purchases of property from an unauthorized government employee; and false records or statements used to avoid paying a government debt.

Massive revise of school code is law
Supporters say the new "system is "seamless'' while critics say it gives too much power to the governor.

published May 17, 2002 TAMPA It took three tries, two special sessions and 1,800 pages for lawmakers to update Florida's massive school code, which Gov. Jeb Bush signed into law Thursday in a ceremony at the University of South Florida. The Senate balked at passing the bill the first time because it had too little time to review it, and the second time the bill blew up over controversial language regarding guns and religion on campus. The third time both chambers agreed on a bill that gives universities more independence, ends social promotion and forbids school districts from building schools near environmentally contaminated sites. "We had a couple of fumbles on the two-yard line," Bush said. "That's evidence that the Legislature is not a perfect process. Democracy is not a perfect process."

It would be very convenient if all state and federal codes, statutes, and caselaw were available on the World Wide Web. This would give lay people easy access to the laws that they must follow and it would allow attorneys to do legal research without having to leave their office to go to a law library, or pay for expensive collections of casebooks. Unfortunately, economic realities dictate that we may never see all of the substantive law of all the states on the Web. Several states receive quite a bit of income by selling the exclusive rights to publish that state's caselaw. In addition, it is quite expensive to publish and maintain a web site, and money for such a project is not available in all states. Caselaw on the Web ideally would include decisions from at least the last 30 years, a sophistocated search engine for locating relevant law, case summaries, headnotes, etc. Providing all of these on a Web site would be very expensive. Given the above, it is impressive how much substantive law

Eminent Domain/Quiet Title Eminent Domain is the right to acquire property for a public purpose. It is an absolute right of government limited by Article 10, Section 6 of the Florida Constitution, which requires the payment of full compensation to the landowner. Condemnation lawsuits involve the County's acquiring of private property for public purposes.
Quiet Title actions involve the determination of conflicting claims to real property or removal of clouds on title to real property.
Inverse Condemnation
Inverse Condemnation is the use by a public entity of private property for a public purpose without that entity having acquired the property through voluntary negotiation or condemnation. This type of proceeding is initiated by a landowner who is demanding payment for the taking of property.
