Florida Attorney General holds presuit notice in medical malpractice case filed with Department of Health is public record The Health Law Section thanks Graham Nicol , General Counsel of the Florida Dental Association, for the following summary of Attorney General Opinion 99-43. Attorney General Opinion 99-43: Department of Health Presuit Notices are Public Records Attorney General Opinion 99-43, issued July 9, 1999, states that a presuit notice in a medical malpractice case filed with the Department of Health pursuant to section 766.106, Florida Statutes (1998 Supplement), under section 455.621, Florida Statutes, is a public record and may not be maintained as confidential and exempt under the provisions of section 455.621(10), Florida Statutes. Section 455.621(10), Fla. Stats., indicates that the "complaint and all information obtained pursuant to the investigation" by DOH are confidential and exempt from the public records law (Section 119.07(1), Fla. Stats.) until 10 days after probable cause has been found or until the subject of the investigation waives his or her privilege of confidentiality, whichever occurs first. But the advisory opinion concludes that the above-referenced statute does not protect presuit notices from public record requests because presuit notices are not specifically exempted. The advisory opinion also indicates that, while various other statutes create specific exemptions for presuit notices, they do so only in the context of civil or administrative litigation and provide no confidentiality in the context of public records requests.

For Release: June 20, 2002 State, Federal Law Enforcers Launch Sting on Business Opportunity, Work-at- H ome Scams 77 Operations Charged With Law Violations In a coordinated attack on business opportunity and work-at-home fraud, the Federal Trade Commission, the Department of Justice (DOJ) and 17 state law enforcement agencies have launched a law enforcement sting and consumer education campaign targeting hucksters who use deceptive earnings claims and paid "shills" to promote their scams or otherwise violate consumer protection laws. Seventy-seven operations have been caught in the sting. "Business opportunity scams and work-at-home schemes are frauds that can cost consumers their life savings, and destroy their dream of owning a successful small business," said J. Howard Beales, III, Director of the FTC's Bureau of Consumer Protection. "That's why we launched Project Busted Opportunity, a joint federal-state attack on business opportunity and work-at-home schemes." The operations ranged from envelope stuffing work-at-home schemes to snack and soda vending machine businesses. In some cases, like medical billing work-at-home schemes, the sellers overstate the demand for the services, according to the FTC. In others, like vending machine businesses, the operators allegedly misrepresent the amount of assistance they would provide to the franchisee. All of the operators targeted by the FTC were allegedly characterized by one key element: earnings claims that were unsubstantiated or deceptive.

It is the policy of the University of Florida that all employees will comply with Florida's public records law and state retention schedules for public records, including electronic mail (e-mail). Florida's Public Records Law: Florida's public records law, listed in Chapter 119 of the Florida Statutes, defines public records as: "All documents, papers, letters, maps, books, tapes, photographs, films, sound recordings, data processing software or other material, regardless of physical form, or characteristics, or means of transmission, made or received pursuant to law or ordinance or in connection with the transaction of official business by any agency." The Florida Supreme Court interprets this definition to encompass all materials made or received by an agency in connection with official business which are used to perpetuate, communicate or formalize knowledge. All of these materials, regardless of form, are open for public inspection unless the legislature has specifically exempted them from disclosure. One Florida court has held that "information stored in a computer is as much a public record as a written page in a book or a tabulation in a file stored in a filing cabinet."
