Germany Info Home: Information Services: Facts about Germany Government, constitution and legal system The Basic Law The bodies promulgating the constitution in 1948 were the parliaments of the states that had been formed in the Western occupation zones and the Parliamentary Council elected by the state parliaments. This Council, which was chaired by Konrad Adenauer, adopted the Basic Law on 8 May 1949. After ratification by the state parliaments, the Basic Law was promulgated by the Parliamentary Council on 23 May 1949.
The basic rights. These freedoms are accompanied by rights which guarantee equality. The Basic Law expresses the general principle that all people are equal before the law by providing that no one shall be prejudiced or favored because of their sex, birth, race, language, national or social origin, faith, religion or political opinions, nor may anyone be discriminated against on account of their disability. It expressly states that men and women have equal rights and that all Germans are equally eligible for any public office. No one may be discriminated against owing to a handicap they have.
The basic rights also deal with the protection and guarantee of social institutions such as marriage, family, and the church. Some basic rights are expressly formulated as entitlements to services and benefits, for example that every mother is entitled to the protection and care of the community.

That was when Arminius, a prince of a Germanic tribe called the Cherusci, vanquished three Roman legions in the Teutoburg Forest (southeast of modern-day Bielefeld). Arminius, about whom not much else is known, was regarded as the first German national hero, and a huge memorial to him was built near Detmold in the years 1838-75. The German western frontier was fixed relatively early and remained fairly stable. But the eastern frontier moved to and fro for hundreds of years. Around 900 it ran approximately along the Elbe and Saale rivers. In subsequent centuries German settlement extended far to the east. This expansion stopped only in the middle of the 14th century. The ethnic boundary then made between Germans und Slavs remained until World War II. High Middle Ages.

As Germany's flood waters reach historic peaks, the country's authorities are scrambling to cope with the economic effects of the crisis. Germany's finance ministry announced that it was considering a range of tax breaks for flood victims - a move that would see current government aid commitments of 385m euros (£246m; $378m) multiplied many times over. At the same time, the labour ministry said it was drafting in some 5,000 of the country's 4 million unemployed to help in affected areas, so far mainly in the east and south of the country. But economists predict that the German economy, a sluggish performer so far this year, could in fact be modestly boosted by the reconstruction effort. There is also speculation that the European Union may allow the country some leeway in the budget deficit limits agreed for the eurozone. 'Billions of euros' Estimates on the likely cost of the German floods are still vague.

GOVERNMENT AND POLITICAL CONDITIONS
The government is parliamentary and based on a democratic constitution that emphasizes the protection of individual liberty and division of powers in a federal structure. The chancellor (prime minister) heads the executive branch of the federal government. The duties of the president (chief of state) are largely ceremonial; power is exercised by the chancellor. Elected by and responsible to the Bundestag (lower and principal chamber of the Parliament), the chancellor cannot be removed from office during a 4-year term unless the Bundestag has agreed on a successor. The President is elected every 5 years on May 23 by the Federal Assembly, a body convoked only for this purpose, comprising the entire Bundestag (federal legislative lower house) and an equal number of state delegates. In the 1999 election, Johannes Rau of the Social Democratic Party was elected.
The Bundestag, also elected for a 4-year term, consists of at least twice the number of electoral districts328 in 1998, being reduced to 299in the country. (More deputies may be admitted when parties' directly elected seats exceed their proportional representation.) Elections for an all-German Bundestag were first held on December 2, 1990, and again on October 16, 1994 and September 27, 1998. A total of 669 deputies were seated after the 1998 national elections. The Bundesrat (upper chamber or Federal Council) consists of 69 members who are delegates of the 16 Laender (states). The legislature has powers of exclusive jurisdiction and concurrent jurisdiction with the Laender in areas specifically enumerated by the Basic Law. The Bundestag bears the major responsibility. The necessity for the Bundesrat to concur on legislation is limited to bills treating revenue shared by federal and state governments and those imposing responsibilities on the states.

Schroeder: Support, but no "adventures"
The lower house of the German parliament has voted overwhelmingly to support international military efforts to fight terrorism. Chancellor Gerhard Schroeder told parliament that the fight was not a war against a state or the Islamic world. Separately, the German Government approved measures that would allow authorities to outlaw religious groups that abuse their status to engage in criminal activities. That proposal must still be approved by parliament. The government did not name any specific organisations it wants to ban.
Eichel: Fighting money laundering
Finance Minister Hans Eichel said on Wednesday that the government planned to spend an additional DM3bn ($1.4bn) next year to fight terrorism. The funds - will which come from increased levies on tobacco and insurance - will go towards the intelligence agency and increased protection of airports and German embassies abroad.
