American federal authorities are turning their attention from terrorists to users of peer-to-peer networks, who could be jailed for up to five years The US Department of Justice is prepared to begin prosecuting peer-to-peer pirates, a top government official said on Tuesday. John Malcolm, a deputy assistant attorney general, said Americans should realise that swapping illicit copies of music and movies is a criminal offense that can result in lengthy prison terms. "A lot of people think these activities are legal, and they think they ought to be legal," Malcolm told an audience at the Progress and Freedom Foundation's annual technology and politics summit. In an interview, Malcolm would not say when prosecutions would begin. The response to the 11 September terrorist attacks temporarily diverted the department's resources and prevented its attorneys from focusing on this earlier, he said. A few weeks ago, some of the most senior members of Congress pressured the Justice Department to invoke a little-known law, the No Electronic Theft (NET) Act, against peer-to-peer users who swap files without permission.

The US justice department has opened an investigation into accounting practices at AOL Time Warner, delivering another blow to the world's largest media company. Federal prosecutors in Virginia, where the company's America Online internet business is based, are working alongside financial regulators to investigate claims that it inflated revenues during 2000 and 2001. The justice department has subpoena powers and the inquiry could lead to criminal charges. Shares in AOL were another 7% lower at $11.69 in midday trading. A year ago, the shares were trading at $44.50. Allegations have been levelled at the company, suggesting it used aggressive accounting to prop up its share price during the takeover of Time Warner. The securities and exchange commission began scrutinising the company last week following a report in the Washington Post. A statement from AOL confirmed that the company has been notified of an investigation by the justice department but it tried to play down the significance. "In the current environment, when anyone raises a question about ac counting, it's not surprising that the relevant government agencies will want to look into the facts," the statement said. "As we said last week we are cooperating 100% with the SEC, and we will cooperate with the justice department as well." The two-day report in the Post highlighted a series of unusual accounting methods employed by America Online. It alleged that, among other things, the company had booked revenue from advertising sold for online auctioneer eBay and renegotiated long-term contracts to recognise revenue more quickly.

Burks was appointed as secretary of the Justice Cabinet on April 25, 2002. Most recently he was the Commissioner of the Department of State Police. As secretary of the Kentucky Justice Cabinet, one of the largest agencies in state government, Secretary Burks takes an active role in overseeing the day-to-day operations of the departments and divisions within the cabinet. This includes the departments of corrections, state police, juvenile justice, and criminal justice training. Also part of the Justice Cabinet are the parole board, medical examiner’s office, criminal justice council and justice administrative services. A Kentucky native, Burks was born on March 17th, 1945, in Louisville. Following graduation from Shawnee High School in Louisville, Burks attended Lincoln University in Jefferson City, Mo., and graduated as the Distinguished Military Graduate in 1967. Commissioned as a 2nd lieutenant in the Army that same year, he continued his military career to retire as a colonel in 1993. Milestones in that career include Senior Battalion Advisor in Vietnam, 1969-70; instructor at the U.S. Military Academy at West Point, N.Y., 1975-1979; Chief of Police for Heidelburg, Germany, 1982-83; Executive Officer for Public Affairs, Pentagon, 1983-84; Commander of the Military Police Battalion at Fort McClellan, Ala., 1984-86; and Chief of Personnel for Military Police, Pentagon, 1988-90.

(CNN) The U.S. Department of Justice released guidelines Thursday for an independent review of the so-called "Carnivore" system to ensure that its Internet wire-tapping capabilities do not violate privacy rights. The guidelines were posted to the Justice Department's Web site Thursday night and outline the required technical qualifications of the U.S. university that will be chosen to study Carnivore as well as the timeframe to present the findings.

Image: Artville US Justice Department investigators want to know how academic scientists spend their time and the government's money. The department is making quiet inquiries at research institutions to determine how they've used their federal funding. Research executives would not say which schools the Department of Justice (DOJ) has approached, and department officials refuse to comment, as is their policy with matters under investigation. The inquiries could go nowhere, or they could herald a return to past cycles of scrutiny by the department, which has enforcement powers anywhere federal dollars are spent. "I don't really know what it is that they're after," says Robert Killoren, incoming president of the National Council of University Research Administrators (NCURA). "It's such a pity. When we talk about accountability for the way our federal funds are spent, we shouldn't be dealing with accountants necessarily. We should be dealing with people who understand scientific research." ON ALERT The DOJ can target any aspect of researchinvestigator time, goods, and materials and indirect costsif it believes the intent to do wrong is present, says James Sheehan, chief of the civil division for the US Attorney's office in Philadelphia. Willful blindness, where universities shield themselves from seeing their star scientists' wrongdoing, also counts. "What we prosecute is lies, intentional false statements," he says.
