ACCUSED'S RIGHTS There is little explicit acknowledgement in domestic law of the potential conflict between the rights of the accused and the position of witnesses. It is doubtless assumed that the latter, as part of the criminal justice process, are afforded adequate protection by the police pre- and post-trial, and by the bench (and possibly the Crown) during the trial. However where such protection is forthcoming it is at the discretion of one or more of those agencies. The lack of guidelines, whether in statutory form or as a code of practice, leads to a variable and necessarily uncertain level of protection which is unsatisfactory. In European Law all of the case law involves accused persons as applicants and the focus is on their rights under Article 6 generally and Article 6 (3) (d) in particular, which requires "equality of arms" between the prosecution and the defence in relation to the attendance and examination of witnesses. Witnesses are given no rights under Article 6 and neither are complainers, whether witnesses or not. Article 6 is concerned only with persons accused of crimes. However, as already indicated above, some attempts have been made in the case law to acknowledge the vulnerability of particular witnesses and their need for protection in particular kinds of crime. Case law illustrates the overriding general principle that the accused should have "the right of confrontation" but also that such right is subject to some modification in certain circumstances. Perry Attorney Steve Swann's Answer Dear Perry: You really have asked two questions. First, how do you cover your "loss of use" if you and the insurance company cannot agree on a "fair market value." The second question seems to be "how does the insurance compute fair market value?" Loss-of-use rules are established under state law. You will need to contact a local attorney familiar with insurance, personal injury, tort law, etc. I would guess (and this is only a guess) that if you can show the insurance company is being unreasonable, and you incur rental car expenses, you may be entitled to their refund. The more important question is "what" do you get back when a car is totaled. The standard is fair market value (FMV). Since insurance companies tend to "low-ball" claimants so as to pay out as little as possible, you may want to get an appraisal to determine the fair market value of the car. Photographs and witness comments are helpful to show the car is more valuable than what the National Automobile Dealers Association (NADA), Kelly Blue Book, or other books quote. The insurance company is not required to put you into a new car by paying off the existing loan and kicking in several thousand dollars to boot. Again the standard is FMV.
