You know, you don't have to run a country the way we run Australia. You could have a dictatorship where one person is in charge, and dictates things like, "Daniel, I hate your reports. You go to jail." In Australia we have three parts to our legal system. One is the Parliament and they're people that make laws for people. Two is the police, they're people and they try to make sure that laws aren't broken. Three is the court system. They decide whether laws were broken, and what the punishment should be. In Australia, because law is really the framework, you say we live under rule of law.

What is Forensic Social Work?
Forensic social work is the application of social work to questions and issues relating to law and legal systems. This specialty of our profession goes far beyond clinics and psychiatric hospitals for criminal defendants being evaluated and treated on issues of competency and responsibility. A broader definition includes social work practice which in any way is related to legal issues and litigation, both criminal and civil. Child custody issues, involving separation, divorce, neglect, termination of parental rights, the implications of child and spouse abuse, juvenile and adult justice services, corrections, and mandated treatment all fall under this definition.

Oregon's Legal System How are laws made?
Law is made by both the legislature and the courts. This occurs at both the state and federal levels. Law made by a judge in deciding cases is called common law. Decisions made by judges may be written and published in books and may be relied upon by lawyers and others in cases with similar facts. Judges or courts only have the power to make laws regarding cases presented before the court for a decision.
What happens after a law is passed?
Where legislatures have passed laws, courts must follow their laws unless the law violates the constitution. In many situations, when the law is unclear or does not adequately cover the facts of a case, the court will have to interpret the law.

  • Child abuse. The physical or mental injury, sexual abuse, exploitation, or negligent treatment of a child. The term "child abuse" does not include discipline administered by a parent or legal guardian to his or her child provided it is reasonable in manner and moderate in degree and otherwise does not constitute cruelty. (18 U.S.C. § 3509(a)(3))
  • Earliest opportunity. An opportunity that will not interfere with an investigation or hamper the responsible official in the performance of other law enforcement responsibilities.
  • Local child protective services agency (used in Article II. E.). That agency of the Federal Government, of a State, or of a local government that has the primary responsibility for child protection within a particular portion of the Federal lands, a particular Federally operated facility, or a particular Federally contracted facility in which children are cared for or reside.
  • Local law enforcement agency (used in Article II. E.). That Federal, State, or local law enforcement agency that has the primary responsibility for the investigation of an instance of alleged child abuse occurring within a particular portion of the Federal lands, a particular Federally operated facility, or a particular Federally contracted facility in which children are cared for or reside.

    A report of the ad hoc Committee on Legal and Ethical Issues in the Treatment of Interpersonal Violence Table of Contents Introduction Section IV: Collateral Issues Section I: Professional roles Section V: Forensic Psychology ... Section III: Treatment This introduction provides a brief review of the issues faced by psychologists working in the areas of interpersonal violence. The problem includes the perception of a harassing backlash against psychologists who have been involved in interpersonal violence cases and issues. In particular, some psychologists who work with child or elder maltreatment, spousal / partner battering, and adults who recall memories of childhood abuse have been targets or personal and organized harassment. The forms of harassment have included personal threats and picketing of offices, media campaigns, as well as ethic and licensing board complaints and lawsuits. Psychologists who find themselves subjected to a nuisance or unsubstantiated grievance may experience vulnerability, loneliness, PTSD symptoms, or professional and financial consequences. They often experience isolation and secondary traumatization. Our committee was particularly concerned with various organized efforts developed to help alleged perpetrators of interpersonal violence and others pursue board actions, ethics complaints and nuisance lawsuits against psychologists who have served as therapist, forensic evaluator, expert witness, or client advocate for victims of interpersonal violence. Templates to file such complaints have been developed by various groups. In addition, our committee was concerned about the negative perceptions portrayed in the media and among consumers about psychologists and psychotherapy. Such perceptions could have far reaching implications for policy and practice. For example, malpractice insurance carriers may attempt to deny converge to psychologists working with clients who have experienced various forms of interpersonal violence.

    The authority under which Independent Counsel Kenneth W. Starr is operating derives from the Independent Counsel statute, 28 U.S.C. Chapter 40 The Supreme Court upheld the constitutionality of the law in a 1988 case, Morrison v. Olson . The challenge, championed mostly by conservatives, argued that the law violates the constitutional separation of powers by infringing too much on the president's executive authority. A seven-justice majority found that even though the counsel is to some degree independent, the law gives the executive branch sufficient control to ensure that the president is able to perform his constitutionally assigned duties.
