Robyn Hobden, tenant The Newcastle District Housing Co-op is feuding with one of its tenant members, Robyn Hobden. Sandra Wilson, the Co-op chairperson, is representing the Co-op at the Residential Tribunal in its bid to evict Robyn. This bitter neighbourhood dispute has raged on for years with numerous appearances before the Tribunal and the occasional restraining order. The Co-op, as the landlord, is not eligible for any legal aid and they can no longer afford the services of a solicitor. With no legal experience Sandra is determined to end this long running battle over maintenance and repairs, rent arrears and alleged nuisance and annoyance. The tenant, Robyn Hobden, is represented by David Owens, a tenant's advocate. He is defending her right to stay in her house. The onus is on the Co-op to convince the Tribunal that the eviction should take place. The Co-ops's case falters from the very beginning when it becomes apparent that Sandra has filled in the wrong form! In addition, Sandra has served pertinent documents to their case to David Owens and the Tribunal only the previous day. Mr Owens objects and asks that the matter be dismissed. Agnes Borsody , the Tribunal member, gives Sandra the opportunity to outline the hardships to the landlord which would justify the tribunal making an order that would end Robyn Hobden's lease. Sandra paints a picture of Robyn as the "tenant from hell". However, much of the accusations against Robyn are hearsay or lack documentary proof much to the frustration of Ms Borsody who frequently interjects with Jerry Maguire-like incantations: "Yes, but show us the evidence!"

If you need an attorney, by all means, get one! I've never lost a civil case but I have persistant not smart opposition.
Just remember this: A lawyer is an officer of the court FIRST! If you are guilty, or have no case, a lawyer is ethically obligated to represent you as just that - guilty! Sure they'll still take you money and go through the motions, but you will LOSE! Lawyers are ethically sworn to represent the TRUTH. Don't kid yourself into believing that they are being paid to win or 'get you off'. It won't happen, unless your civil rights were clearly violated (and of coarse can prove it).. It's unlikely you can pay them enough to be worth the risk of being disbarred.

    Yes. If you can call and leave us a message, we will try to call you back, so we pay for the call. You could also write and tell us your issue, and we will phone you.
