Whether you call it "coaching" or "unbundling," there is a movement afoot, outside of the mainstream, which is redefining the way legal services are being bargained for and provided in family law. Traditional legal ethics required lawyers to take a case from start to finish, assume responsibility for all aspects, and charge their clients accordingly. But what if your case doesn't warrant it, or only one area is complex enough to require a lawyer's intervention? Many judges and bar associations take the position that you can't do part of it yourself. If you try to take an attorney to court just for the custody part of your case, the judge is likely to refuse to let him participate unless he handles all aspects, including those where you want to represent yourself. Worse, many bar associations are telling lawyers that they jeopardize their license to practice law if they agree to "unbundle" their legal services. This is downright stupid, but that's the rule in some states. Suppose you have a difficult custody case, but little property and few issues regarding support. Why should you have to pay an attorney to divide pots and pans when what you really need is help with custody or visitation? Suppose you don't have complicated issues, and want to represent yourself, but want to consult with someone who can tell you about your judge, or how the support is calculated, or give you pointers about evidence so you can put on your own hearing? It only makes sense that you should have the right to do that if you want, and if the attorney agrees.

Mediation is a voluntary method you can use to resolve disagreements with the assistance of a neutral, trained person. When you and your spouse have a family law problem, you can work together, with a mediator, to gather and exchange information, identify issues, create solutions, and create a complete agreement on all of these issues. Although most mediation involves marital separation or divorce, mediation is also used to create pre-marital agreements and domestic partner agreements.
Because family law has become increasingly complex, you may find that you cannot or do not want to represent yourself and need the help of a lawyer and/or therapist when you decide to separate or divorce. Financial and tax issues can be complicated and few non-lawyers are fully aware of all the issues that need to be considered. Emotional issues and communication problems can make direct, unassisted negotiations between you and your spouse very difficult. Yet, the traditional adversarial system is expensive, often public, sometimes slow, and can distance you and your spouse even further by the positional bargaining that is the basis of the traditional system, and by reducing your chances to talk directly with each other.

WHAT ARE THE TYPICAL STEPS IN A CRIMINAL PROCEEDING?
Misdemeanors and felony criminal proceedings are more complex. As with a petty crime proceeding, you may have an attorney appear with you throughout the proceeding, or waive your right to counsel and represent yourself. For most felony proceedings, the following steps typically occur (note: these steps do not apply to juvenile proceedings):
A crime is committed, it is reported, an investigation conducted and an arrest made (these may all occur in rapid sequence if the offense is committed in the presence of a law enforcement officer)
Booking - an administrative procedure which records the defendant's name, the crime charged, and other relevant information about the defendant (telephone number and address, photograph, fingerprints, etc.)
Arraignment - when the defendant appears in court and enters a plea (guilty or not guilty, or sometimes "nolo contendere" [no contest]). The defendant is presented with a written accusation dealing the facts of the crime and his/her involvement in the crime. The written accusation may be presented by a grand jury, a prosecutor or a police officer. If the defendant enters a not guilty plea, a date for trial is set.
Bail or Detention - bail is either set or the defendant is required to be "detained" (kept in jail until the trial). Bail could range from being "released on your own recognizance" (in other words, you are on your honor to appear at the next hearing), to many thousands of dollars. When a higher amount of bail is set, a bail bondsman is often called to provide the bail payment in exchange for a fee and a lien against property (as collateral) of the defendant. If bail is posted, the defendant is released but must show up at the next hearing (or bail will be forfeited).

What Do I Have To Show To Get A Divorce? Arizona is a “no fault state”. In other words, you do not need to state any specific reason why you want a divorce. Nor does your spouse have to agree to a divorce. How Long Will It Take To Get A Divorce? Once the divorce petition and other documents have been served on the other party, you need only wait 64 days if you and your spouse agree on all issues. This can be done through a “default hearing”, or you can obtain a “consent decree” without ever having to go to court. When one skeptic questioned how I could know the law without being a lawyer, I pointed out that legal information is fully available to the public in this country, and I put together this list of persons, places, and things which I have encountered in my various legal wanderings:

Clients Managing Their Own Cases
THE PROBLEM
Years ago, the idea that someone would represent themself in a divorce case was simply unheard of. Today increasing numbers of people are deciding to manage their own cases and represent themselves in court. The decision to "go it alone" seems to be related to two factors:
  • the high cost of legal representation ($150/hour plus)
  • the desire to take control over one's own affairs
Considering that one's fate often rests with a judge who knows nothing about the client and his or her family (except for what is contained in court documents), many people feel that all things being equal, they will opt to present their own case to the court. During the past few years, I have seen a number of clients achieve considerable success on their own in divorce court even against some well known lawyers. Clients who tend to do well in court, have two things in common:
  • they have a good case
  • they are well prepared and knowledgeable about the legal aspects of divorce and the court process
The latter point is extremely important because your case can be made or broken on the basis of your understanding of procedure. More importantly, if you want to be on an equal playing field with a lawyer who knows the "tricks of the trade", you better inform yourself.
