(Drug Court) Community Outreach Court Calls GENERAL INFORMATION: The Family Law Facilitator is an attorney who can help you to represent yourself in limited family law matters. You can get help with an existing case or in starting a case. You can get help if you are the petitioner or the respondent. If you work with the Family Law Facilitator, you are responsible for processing your own case. The Facilitator can help you to select the proper legal forms and to complete them, serve them and get them filed with the clerk's office. If you need to go to court to present your case to a judge or commissioner, however, you will present your case alone. In some situations, an interpreter may be available to help with translation in court. The Family Law Facilitator is not your attorney. There is no attorney-client relationship between you and the Family Law Facilitator. The facilitator can equally help you and the other party (for example, your former spouse, the parent of your child, etc.). Anyone is welcome to ask for help from the facilitator. If you want help with your case strategy, you should consult with your own attorney for that kind of legal advice.

The following services and programs are available for referral by the Circuit Court for Kent County:
  • Alternative Dispute Resolution Scheduling Conferences If a party is represented, the attorney will initiate the request for the Court to Order a Scheduling Conference. When parties are pro se (or unrepresented), a “Request for a Hearing or Proceeding” (Dom Rel 59) is used to initiate the scheduling of a scheduling conference. In both cases, the attorneys and/or the parties will be notified by the Court as to when, where and before whom they are ordered to appear for their scheduling conference. Please read the instructions thoroughly. Scheduling Conferences allow the court to check and verify the status of a case. At the conference, services are ordered (mediation, custody evaluations, home studies, etc.), referrals are made, deadlines are set and further hearings are scheduled. Some issues and cases are settled at scheduling conferences. Settlement Conference Scheduling conferences provide the forum for the Court to schedule a settlement conference.

Many individuals have started to contact our office regarding actions pending in another state. Unfortunately, each state has their own rules about collection of child support, and you may need to speak to an attorney licensed in that state. An attorney licensed only in California, or New York, or Florida, can only answer questions regarding the law in the state they are licensed, and unfortunately, there is no simple answer since each state is free to make up their own rules for enforcement. Also, part of the requirements of the bar in each individual state is a rule that an attorney licensed in one state shall not give legal advise regarding the laws of another state unless they are licensed in that state. An attorney can be sanctioned by their own bar for failure to follow these ethical rules. So, if your matter is pending in some other state, take advantage of the research we have done. Contact one of the attorney referral services listed below, or nationwide organizations listed. Do not contact us, because you will most likely get a response that reiterates the bar rules of the state of California. The following is a list of resources we have found on the web for further information, and it is not intended to be exhaustive, nor does the listing serve as an endorsement of their views or reliability of the legal information included. How to Appeal a Small Claims Case
The legal skinny on whether and when you can appeal your small claims case. Many states allow either party to appeal within a certain period of time, usually between 10 and 30 days. In some states, appeals must be based solely on the contention that the judge made a legal mistake, and not on the facts of the case. Other states have their own unique rules. In California, for example, a defendant may appeal to the Superior Court within 30 days and receive a new trial. Except in very limited circumstances, a plaintiff may not appeal at all.
