By Francisco Avalos and Elisa Donnadieu Francisco Avalos is Foreign and International Law Librarian at the University of Arizona College of Law Library. He obtained his undergraduate degree from the University of Arizona in 1971 and his Master of Library Science in 1976. He is the author of several books and articles dealing with the legal system and history of Mexico. He has served as past President and Secretary of AALL FCIL- SIS and has made several presentations on the Mexican legal system at national conferences and conventions. He has been a special consultant to the National Law Center for Inter-American Free Trade for the last ten years. Elisa Donnadieu is a 1997 graduate of the University of Arizona, College of Law. She has worked with the Pima County Public Defender’s office since 1998 and continues to do so on a part-time basis. Interpretations
The Board has considered the question of whether a foreign bank's California office that may accept deposits from certain foreign sources ( e.g., a United States citizen residing abroad) is a branch or an agency for the purposes of the grandfather provisions of section 5 of the International Banking Act of 1978 ( 12 U.S.C. 3103 (b)). The question has arisen as a result of the definitions in the International Banking Act of "branch" and "agency," and the limited deposit-taking capabilities of certain California offices of foreign banks.
The International Banking Act defines "agency" as "any office * * * at which deposits may not be accepted from citizens or residents of the United States," and defines "branch" as "any office * * * of a foreign bank * * * at which deposits are received." ( 12 U.S.C. 3101 (1) and (3)). Offices of foreign banks in California prior to the International Banking Act were generally prohibited from accepting deposits by the requirement of State law that such offices obtain Federal deposit insurance (Cal. Fin. Code 1756); until the passage of the
International Banking Act an office of a foreign bank could not obtain such insurance. California law, however, permits offices of foreign banks, with the approval of the Banking Department, to accept deposits from any person that resides, is domiciled, and maintains its principal place of business in a foreign country (Cal. Fin. Code 1756.2). Thus, under a literal reading of the definitions of "branch" and "agency" contained in the International Banking Act, a foreign bank's California office that accepts deposits from certain foreign sources (e.g., a U.S. citizen residing abroad), is a branch rather than an agency.

The President of the United States:
Legislative Powers Most people view the President as the most powerful and influential person in the United States government. While he does wield a great deal of political might, his effect on the law-making process is limited. Only Congress can write legislation; the President may only recommend it. If he does so, then a member of Congress may introduce the bill for consideration. Whereas only Congress may create legislation, it is difficult for them to pass a bill without the President’s approval. When Congress passes a bill, they send it to the White House. The President then has three options: sign the bill into law, veto the bill, or do nothing. When the President signs a bill into law, it immediately goes into effect. At this point, only the Supreme Court can remove the law from the books by declaring it unconstitutional. When the President vetoes a bill, it does not go into effect. The President vetoes a bill by returning it to Congress unsigned. In most cases, he will also send them an explanation of why he rejected the legislation. Congress can override a presidential veto, but to do so, two-thirds of each chamber must vote in favor of the bill. However, an override does not occur very often.

The Bridge for Market Entry into Vietnam
The first Law on FDI in Vietnam was promulgated by Vietnam’s National Assembly (Parliament) in December 1987. After being amended twice, the law was rescinded and replaced by a new Law on FDI that was passed in November 1996. The new law was amended again in May 2000 with a view to further improving foreign direct investment environment. The Law and its amendments and supplements are further detailed and guided in government Decree No 24/2000/ND-CP issued on 31 July 2000. Apart from the above-mentioned law and decree, FDI in Vietnam is also governed by other relevant Vietnamese laws and regulations. In addition, foreign investors may be allowed to apply foreign laws to deal with the areas and/or issues which have not been covered by Vietnamese laws provided that such application does not run counter to the basic principles of Vietnamese laws. As set forth earlier, the FDI sector is recognized in Vietnam’s Constitution as an important integral part of the country’s economy. The Law on Foreign Direct Investment in Vietnam guarantees that investors will receive “fair and equitable treatment.” The capital and other lawful assets of foreign investors will not be requisitioned or expropriated by administrative measures or without their voluntary consent. Enterprises with foreign capital shall not be nationalized. The investor’s industrial property rights and legitimate interests in technology transfers are also protected. Foreign investors’ legitimate interests are protected from detrimental legislative changes. In the event that there are changes in the law of Vietnam that adversely affect the interests of enterprises with foreign capital or parties to business cooperation contracts, those interests stated in their investment or business licenses continue to apply or will be dealt with satisfactorily by the Vietnamese authority through measures such as:

General Information Sheet History: In 1973, the Ohio General Assembly created the Ohio Ethics Commission as part of the Ethics Law. The law, effective January 1, 1974, created new ethical standards for public officials and employees by: requiring personal financial disclosure; creating new restrictions upon unethical conduct with criminal sanctions; and, establishing uniform review of ethics issues by state-wide commissions of the three branches of government. Authority: The Ohio Ethics Commission administers the Ohio Ethics Law and related statutes for all public officials and employees at the state and local levels of government, except for state legislators and their employees, and judges and their employees. For legislators and their employees, the law is administered by the Joint Legislative Ethics Committee. For judges and their employees, the law is administered by the Board of Commissioners on Grievances and Discipline of the Ohio Supreme Court. Members: The Ethics Commission is a bipartisan commission comprised of six members who are appointed by the Governor and confirmed by the Ohio Senate.
