admiralty: an overview
Admiralty law or maritime law is the distinct body of law (both substantive and procedural) governing navigation and shipping. Topics associated with this field in legal reference works may include: shipping; navigation; waters; commerce; seamen; towage; wharves, piers, and docks; insurance; maritime liens; canals; and recreation. Piracy (ship hijacking) is also an aspect of admiralty. The courts and Congress seek to create a uniform body of admiralty law both nationally and internationally in order to facilitate commerce. The federal courts derive their exclusive jurisdiction over this field from the Judiciary Act of 1789 and from . Congress regulates admiralty partially through the Commerce Clause. American admiralty law formerly applied only to American tidal waters. It now extends to any waters navigable within the United States for interstate or foreign commerce. In such waters admiralty jurisdiction includes maritime matters not involving interstate commerce, including recreational boating. Admiralty law in the United States developed from the British admiralty courts present in most of the American colonies. These courts functioned separately from courts of law and equity. With the Judiciary Act, though, Congress placed admiralty under the jurisdiction of the federal district courts. Although admiralty shares much in common with the civil law, it is separate from it. Common law does not act as binding precedent on admiralty courts, but it and other law may be used when no law on point is available.

The Common Law: an English legacy
The common law evolved in England over many centuries and operates through the doctrine of precedent and the development of legal principles through cases and judgments. As a system of law the common law can be contrasted with other legal systems though out the world such as the civil law system in Europe which requires the precise exposition of its laws in statutory codes. New Zealand, as a colony, inherited the common law system from Britain and the English Law Acts of 1854, 1858 and 1908 confirmed New Zealand as a common law country.
The Common Law: a glance at English legal history
The common law developed from a central justice system common to all of England, in contrast with local or provincial laws which might be unique to the region in which they applied. Mainly administered by the monarch and the Royal Courts the common law system developed gradually, assisted by the implementation of law reporting which allowed judgments of the Courts to be used for reference purposes. This reporting of Court decisions allowed the principles and rules which emerged in the course of one case to be applied in an analogous situation lending certainty and consistency to the application of the law throughout England.

OREC HOME NEWS Attorney General Opinion 02-9 February 21, 2002 This office has received your request for an official Attorney General Opinion asking, in effect, the following question: Can a single-party broker, who has a brokerage agreement with a buyer, comply with the buyer’s request to keep the buyer’s identity confidential and present a seller an offer in which the buyer’s name does not appear? For purposes of responding to your question, it is assumed the buyer has not engaged any third party to act as the buyer’s agent in the transaction which is the subject of your question. “Every contract results from an offer and acceptance.” Garrison v. Bechtel Corp., 889 P.2d 273, 281 ( Okla. 1995). Under Oklahoma ’s statute of frauds, an offer and acceptance for the sale of real property must be in writing and “subscribed by the party to be charged, or by his agent.” 15 O.S. 2001, § 136. Consequently, Section 136 requires an offer to purchase real property to be signed by the buyer or his agent. Oklahoma law requires an offer to purchase real property to be signed by the buyer or the buyer’s agent; in this case, the buyer does not want to personally sign the offer, lest the buyer’s identity be revealed. The question is whether a single-party broker can act as the buyer’s agent in making an offer, so the buyer can keep his or her identity concealed.

Equal pay for work of equal value is not a new idea. The United Nations Convention on the 'Elimination of All Forms of Discrimination Against Women' addresses this issue, as does the International Labour Organization Convention 100 on Equal Remuneration. Canada ratified Convention 100 in 1972 and currently there are laws addressing equal pay in every jurisdiction in Canada. What do we mean by Pay Equity? There are three important, but different ideas we're talking about when we say Pay Equity. They are:
  • Equal Pay for Equal Work – address the more overt form of discrimination in wages on the basis of gender. It involves direct comparison of jobs occupied by the opposite genders where the job is the same or basically the same.
  • Equal Pay for Work of Equal Value – provides for reducing the wage gap by comparing jobs of a different nature that are considered "male" or "female" jobs.
  • Pay Equity Laws – refers to legislated programs that aim to achieve equity in pay in an organized manner.
