Miseducating the Young on Freedom January 2 - 8, 2002 n 1950, Republican senator Margaret Chase Smith of Maine was the first member of Congress to publicly confront Senator Joseph McCarthy's charges that those who disagreed with his version of patriotism were—as Attorney General John Ashcroft now says of his critics—giving "ammunition to America's enemies." At the time, Margaret Chase Smith was the only woman in the Senate. She led six other senators in presenting a Declaration of Conscience to the rest of her colleagues—urging them to protect individual liberties from the likes of McCarthy. It took four more years for the Senate to censure Joe McCarthy. What Senator Smith said on that day ought to be studied not only by the president and the attorney general of the United States but also by certain editorial writers at the New York Daily News and the New York Post who have attacked members of Community School District 3 for defying the Board of Education's edict that the Pledge of Allegiance must be recited daily in every classroom in our public schools.

OTHER STATE ISSUES At this time, ANA is currently following these issues at the state level. MAINE OBESITY LEGISLATION LD 471 LD 471 would establish a commission to study the causes of obesity and determine ways to decrease the cost of health care and increase public health. The commission must address (among other subjects) strategies for restricting advertising to students in its final report, which would be due to the legislature by December 1, 2003. This legislation was included in a legislative package announced February 14, 2003 which includes other legislation banning the sale of certain snack foods in Maine schools, and requiring chain restaurants to post caloric information on menu boards, menus and on individual wrappers and boxes. LD 505 This bill, introduced by state Representative Peter Mills (R) would place an excise tax on soft drinks. Fifty percent of the revenue from the tax would be directed to "school administrative units that adopt policies that prohibit the advertising and sale of soft drinks and candy on school property." The bill broadly defines soft drinks to include soda water, fruit or vegetable drinks containing 10 percent or less natural fruit or vegetable juice, and coffee or tea bottled as liquid. A number of states are currently considering legislation that would require studies of the obesity problem in general.

U.S. Continuing Education Requirements

Excerpted from the Federation of Chiropractic Licensing Boards’ current Official Directory This information was compiled from the current FCLB Official Directory and based on information about CE requirements as provided to the FCLB by each individual state’s licensing board. Contact the state licensing boards for details. The Federation of Chiropractic Licensing Boards does not interpret state law, nor is it responsible for errors or omissions in information provided by the member boards. The FCLB has not taken an official position on whether CE should be required nor the minimum number of recommended hours. In a recent survey, FCLB found doctors of chiropractic are required to have a certain number of hours of continuing education in order to qualify for licensure renewal in most US jurisdictions. Currently, New Jersey does not have continuing education requirements and New York requires only a one-time two hour course in reporting child abuse. All 49 other US jurisdictions require CE (including District of Columbia). The average number of hours across the reporting jurisdictions which require CE is 17.5 hours per year, with a low of 10 hours and high of 50 hours per year (the two states which require 50 hours are Kansas and Illinois, where the boards regulate both DC's and MD's). By far the most common CE requirement is 12 hours per year, with 23 chiropractic boards requiring this number.

SUPREME COURT: PRIVATE SCHOOLING FOR "CONFINEMENT" DOES NOT QUALIFY FOR DISTRICT FUNDING
WASHINGTON, February 26, 2002 The U.S. Supreme Court for a second and likely final time Feb. 19 declined to review an Illinois case challenging whether a school district is required to pay for private schooling that is deemed primarily to confine rather than educate a child with special needs. The mother of Dale M, a teenager in Illinois' Bradley-Bourbonnais School District, asked the school district to pay for her son's placement at Elan, a private school in Maine, after he was released from juvenile detention for repeated burglary and drug offenses in the local community. Though the Illinois state hearing officer initially granted her petition, ordering the school district to pay his costs at Elan, it was overturned by a state review officer, then traveled up the chain of state and federal appellate courts to the Supreme Court.
