Defending Boy Scouts in Massachusetts Public Schools By Amy Contrada February 5, 2001 The Boy Scouts of America have recently come under attack in Massachusetts because of a massive campaign against them. Although the legal issues are simple, many school administrators and school committee members appear to be “confused” perhaps on purpose. Two separate laws are involved. State Law - Do civil rights laws of our state (which decree that homosexuals are a “protected class”) require that the Boy Scouts be expelled from the schools? The simple answer is that the Massachusetts laws do not require that the Scouts be expelled from the schools. (Under the federal civil rights law, homosexuals are not even included as a “protected class” like blacks and women. Therefore they have no special rights under federal law. However, both Senators Kennedy and Kerry are active in attempts that would give them special status under federal law as well as state law. But they have no such status at the present.) I've read it in many different good sources). The German system was extremely successful in achieving its goal in Germany and was therefore copied by other countries, including the U.S. The great American tycoons and Robber Barons were big supporters of the German system in America since they wanted literate but obedient factory workers. Students, teachers, administrators and lawmakers have struggled with possible solutions but are continually stumped by the multitude of diverse ideas and issues. It is clear that an alternative to our long-standing educational system is a must, but what kind of changes do we need in order to raise our school's educational standards while keeping them free for everyone? In 1999, the U.S. Department of Education awarded more than $95 million in federal grants to help fund public charter schools. A charter school is a public school that operates under a contract from a public agency. Parents and teachers create them in an effort to provide alternative to our current educational system, while remaining a part of the public school system. Charter schools are public schools that recieve state funds but are free from many of the restrictions placed on traditional public schools. These restrictions range from school lunches to light fictures to what color paint is used in hallways. Without having to adhere to these restrictions, charter schools are able to concentrate more on their students and less on bureaucratic noise. The simple idea behind charter schools is that all students do not learn at the same speed or even in the same way. Charter schools boast a child-based learning system that incorporates alternative curriculums with individual attention. Class size is quite small in comparison to most public schools with perhaps only 12 students to a classroom instead of the traditional 32.

Volume 15, No. 2 - Winter 2000 / 2001 Winter 2000 / 2001 Civil Rights and Testing A Louisiana parents' group has filed a civil rights complaint with the U.S. Department of Education, asking for an investigation into the "misuse and abuse of standardized tests" in the state's new high-stakes testing system. This fall, Louisiana began holding back 4th and 8th grade students who fail the state's new standardized tests. As many as 18,000 students in the two grades were retained. "Not one of the other 50 states has implemented such a scheme for grade school children," notes the complaint by the parents' group, Parents for Educational Justice. "There is good reason [for this]- it has proven to be an educational disaster for children in minority and poor schools." Susan Bowers, acting assistant deputy secretary, said the Office of Civil Rights has received four complaints - involving North Carolina, Texas, Ohio and Nevada - prior to the one from the Louisiana parents. These were resolved by adding summer school and accelerated programs geared toward the tests. "What we have never done is require the state to stop using the tests," Ms. Bowers said. Parents for Educational Justice tried unsuccessfully in federal court last spring to prevent the state from using the test to determine a students' academic fate.

Over 84,000 public schools are contained in the CCD Universe File, of which almost 79,000-49,000 regular elementary schools, 14,000 regular middle schools, and 15,801 regular secondary/combined schools in the 50 states and the District of Columbia-meet the eligibility criteria for this study. Excluded from the sampling frame were special education, vocational, and alternative/other schools, schools in the territories, and schools with a high grade lower than one or ungraded. Respondent and Response Rates In April 1997 questionnaires were mailed to 1,415 school principals. The principal was asked either to complete the questionnaire or to have it completed by the school disciplinarian who was most knowledgeable about discipline issues at the school. Telephone followup of nonrespondents was initiated in late April, and data collection was completed in July 1997. Eleven schools were found to be out of the scope of the study (no longer in existence), and a total of 1,234 schools completed the survey. Thus, the final raw response rate was 88 percent (1,234 schools divided by the 1,404 eligible schools in the sample). The weighted overall response rate was 89 percent. Weighted item nonresponse rates ranged from percent to 0.9 percent. Because the item nonresponse was so low, imputation for item nonresponse was not implemented.
