Mediation Mediation is the use of a neutral third person to assist two or more parties to reach agreements on issues which may be or could become disputes. Typically, in the area of family law the agreements focus on giving or changing structure to relationships. People intending to marry or to live together may look to plan for their future by defining each person's rights and responsibilities. Those moving apart wish to divide property and debts, provide support for the other or their children, and create guidelines for parenting. During the meetings typically lasting from one to two hours, the mediator, usually an attorney, acts as an advisor rather than a representative of the parties. It is the mediator's responsibility: first, to provide and enforce rules for the conduct of the mediation; next, to educate the parties on applicable laws and regulations; to facilitate equitable solutions and compromises; and to draft formal agreements. Attorneys may be consulted during the process by either of the parties between sessions or at the conclusion to review the written agreement. Mediation offers several distinct advantages. First, it often is the most relaxed and least expensive approach to settlement. Often the time required to reach a settlement is greatly reduced and practical concerns such as scheduling are more easily accomplished.

Michael Cogen, J.D., Ph.D. Michael Cogen is a member of the state bar of California. He has participated in the American Bar Association, and the bar associations of Marin, San Francisco, Sonoma, and Contra Costa Counties. Mr. Cogen has been a member of the family law, ADR, mediation and collaborative law sections of various bar associations and is a member of the Academy of Family Mediators. He is a licensed real estate broker and has provided income tax counseling in real estate acquisitions and exchanges. Mr. Cogen holds a doctorate in social-clinical psychology with an emphasis in dispute resolution and family dynamics. Mr. Cogen has served as a Special Master in family law matters
involving custody and property issues. He has conducted research on the manner in which a professional's underlying attitudes effect his or her choice of resolving clients problems. Currently, he is studying the effects of prolonged stress upon employee productivity. MEDIATION
On December 18, 1995 the Tennesse Supreme Court instituted the following rule in an effort to assist parties in their litigation and reduce the need for court resources. The rule has been amended this year to improve procedures and require mediator qualifications. Until recently few judges have used this procedure for domestic cases, however, it is becoming more popular as it seems to protect parents and their children by requiring the parties to peacefully resolve issues without a formal court proceeding where the parties try to show the court how bad the other party is. As you might expect, new laws are being passed by the legislature to limit this useful procedure and restrict parental rights to the detriment of their children. These laws follow. Model Local Land Use Mediation Law This model local land use mediation law: u Contains a declaration of policy that identifies the purpose of mediation and preserves the decision-making authority of municipal boards, agencies, and officers. u Provides for the costs of mediation to be shared by the participants in the mediation and the municipality. u Lists the minimum qualifications required for mediators and excludes the municipality itself from being a “party in interest.” u Identifies mediation as a voluntary process, vests the local review board with authority to suspend time limits on land use reviews, and outlines procedures for suspending those time limits. u Recognizes the need for confidentiality in mediation proceedings. u Mandates compliance with accepted mediation practices. u Encourages parties to give fact-based reasons for supporting the agreement and to place those reasons on the public record.

Located in Pasadena, California , I offer expert arbitration and mediation services specializing in environmental and health and safety disputes. I have more than 28 years of legal experience , 19 of which focused on environmental and health and safety law. In addition to practicing law, I was an environmental administrative law judge and have been retained as an expert witness. After leaving big firm practice in downtown Los Angeles, I started my own business in 2001 in order to include arbitration and mediation in my practice. The American Bar Association recently conducted a survey that found that environmental lawyers and business professionals agree that arbitration and mediation can be very effective in resolving environmental disputes. These tools are particularly useful in environmental cases because of the complexity of the cases, the technical issues involved and the number of parties usually participating. The survey also noted that it is difficult to find well-qualified environmental neutrals. This lack of qualified neutrals is one of the reasons I expanded my practice to include arbitration and mediation. I provide the necessary experience, legal and practical background to assist parties in reaching cost-effective, creative, fair and workable solutions to their environmental disputes which often involve governmental agencies. In addition to my formal arbitration and mediation education, I bring seven years as an administrative law judge to bear on dispute resolution. I served as Chairman of the South Coast Air Quality Management District ("SCAQMD") Hearing Board determining permit appeals, requests for variances, cease and desist orders and other administrative issues at a time when many air quality rules were being adopted and required interpretation. SCAQMD is the regional air quality district for the counties of Los Angeles, Orange, Riverside and San Bernardino.
