Download brochure (pdf) The Workshops Intellectual property professionals from many different jurisdictions have, during the past eight years, participated in the Workshops for Mediators in Intellectual Property Disputes organized by the WIPO Arbitration and Mediation Center. These Workshops are designed for lawyers, business executives, patent and trademark attorneys and others wishing to familiarize themselves with the mediation process and to receive training as mediators. In 2003, two identical WIPO Workshops for Mediators in Intellectual Property Disputes will be offered. Each Workshop will be held over two days, the first on Thursday, June 26 and Friday, June 27 and the second on Monday, June 30 and Tuesday, July 1, 2003. Mediation Mediation is an extension of direct negotiations between the parties to a dispute, conducted with the aid of a neutral intermediary, the mediator. It is the preferred mode of dispute resolution in many of the most important markets of Asia, as well as an increasingly popular method of dispute settlement in the United States of America and in Europe.

The marriage is ending and now both spouses and their children, if any face an uncertain future. Although focusing on what lies ahead may be difficult during this time of upheaval, it is important to think about how your present actions towards your spouse might affect your children’s lives after the marriage. Choosing to do "battle" in the courtroom may lead to bitter feelings between you and your spouse and may likely deplete your bank account. Not only are you scarred, but your children suffer also. Luckily, there is a cooperative alternative to the battle of litigation. Divorce mediation is the process in which a couple works together to find viable and satisfactory solutions to their issues with the help of an impartial third party called a mediator. In mediation, each spouse is given the opportunity to explain his or her issues and feelings without interruption. When the spouses are finished, the mediator clarifies their stories by respectively asking open-ended questions and engaging in reflective listening. The mediator does not assign blame, judge who is right or wrong, or take sides. Once everyone has a firm grasp of the issues involved, the mediation enters into the problem-solving stage. At this point, the spouses brainstorm possible solutions and eventually reach an agreement they can live with. As a final step, an agreement can be drawn formalizing the terms.

I. Introduction
The purpose of this bibliography is to provide tools and information about the possibility of mediation for those involved in a guardianship dispute. Guardians are often appointed for older persons when illness or other disability requires such intervention. Guardianship is considered the most serious and drastic of all the options available to someone needing to care for a disabled elderly person. it is considered extreme because it results in a substantial loss of freedom for the individual. In order to allow guardianship of an individual, the court requires evidence of incompetence in handling personal and financial affairs. This "incompetence" can be caused by the elderly person's mental illness, mental retardation, or inability to communicate wished due to a physical or medical problem. Once the court determines incompetence, the court appoints a guardian, who has the rights of decision-making for the incapacitated person. Guardianship law and practice, while varying from state to state, has generally been criticized as procedurally inadequate, substantively archaic, demeaning to the elderly, and operating in a manner that permits widespread abuse.

Mediation is a negotiation process led by an agreed-upon neutral, called a "mediator". The mediator uses his or her experience to point out the strengths and weaknesses in each party's case, to ask questions and sometimes make private recommendations about the underlying merits of each side's perceived case, and to communicate settlement offers and counteroffers to the other side at appropriate times. All settlement discussions in the mediation process are deemed to be confidential , and cannot be used subsequently in court proceedings unless the information has already been known by the parties.

    Before You Sue Think hard before you rush off to the court clerk's office to file a lawsuit. The idea of victory may tempt you, but as you probably know, lawsuits can be expensive, time-consuming and emotionally draining. It's far better to resolve your disputes out of court. One way to do this is through mediation, discussed below. And there are other ways to settle disputes without suing, including demanding payment before you go to court or attempting informal negotiation. But if all else fails and a lawsuit seems inevitable, you'll want to be sure you have a good case and prepare yourself well before you forge ahead.     IS MEDIATION CONFIDENTIAL?
    Yes, but the degree of confidentiality varies from state to state. If you are involved in a lawsuit, offers you may make to settle the case in mediation are not admissible in court, under general principles of evidence law. Other things that are said in mediation may not be protected.
    A lawyer can draw up a mediation agreement which, when signed by both sides, prohibits disclosure of what was said in the mediation. Some mediators require the parties to sign a confidentiality agreement before they begin the mediation. Under California law, from the time you contact a mediator to ask about mediation until the mediation is over, everything said is confidential. That means that nothing written specifically for the mediation, or said during the mediation, is subject to discovery (being revealed) in any non-criminal proceeding. Furthermore, the mediator cannot be called to testify about what went on in the mediation in any later non-criminal proceeding. This means you can have complete confidence that what you tell the mediator in private will not be revealed.
