Child Custody in Mississippi

There are 2 types of child custody under Mississippi law:
Physical Custody : The right to have the child reside with or be under the care and one of the parents.
Legal Custody : The decision-making rights, responsibilities and authority relating to the health, education and welfare of the child.
Within the framework of those two types of custody, the custody of a child may be awarded as follows, according to the best interests of the child: (a) physical and legal custody to both parents jointly; (b) physical custody to both parents jointly and legal custody to either parent; (c) legal custody to both parents jointly and physical custody to either parent; (d) physical and legal custody to either parent.
When determining how custody of children should be allocated, the most important consideration is the best interests and welfare of the child. The following additional factors are also considered:
1. Age, health, sex of the child.

Who Are We?
The Parent Educator connection (PEC), sponsored by the Iowa Department of Education, Bureau of Special Education, began in 1984 to provide parents and educators with opportunities to work together in positive ways to improve educational programs for children/youth with special needs. The PEC operates through the Area Education Agencies and is part of a statewide network. We consist of Parent Educator Facilitators (parents of children with special needs), an Educator Representative (special education division staff member), and an area-wide steering committee (parents and educators. Our Mission
is to promote positive partnerships through meaningful communication between families and educators to enhance the value of each partner, thus allowing all children and young adults to attain their greatest potential.
What Can We Do For Parents and Educators?
Provide support for families and educators through personal or phone contact. Link families and educators with needed services and resources.

Parents Oppose Cellucci Proposal for Certificates
Sharon, MA- January 16, 2001-
The Massachusetts Special Education Parent Advisory Council (MASSPAC) today announced its strong opposition to Governor A. Paul Cellucci's proposal to grant certificates rather than diplomas to special needs students who fail the MCAS test. MASSPAC is a non-profit, volunteer organization representing parents of children with disabilities across 300 school districts. Sue Senator, MASSPAC Director of Assessments and Research, said: "Although the governor shows some sensitivity around the problem of special needs children and the difficulties they face in passing the MCAS exam, there are serious flaws in the certificate proposal." The organization is concerned about the plan for several reasons including: Federal law (IDEA - the Individuals with Disabilities Education Act) requires school districts to maintain the same level of accountability for ALL students. Since a certificate of completion is a lesser standard than a diploma, the governor's proposal allows the state to be less accountable for the quality of education provided to one segment of students - those with disabilities, violating the intent of federal law. Special needs children who are given a certificate will be excluded from any higher education institution that requires a diploma for admission.
