According to one recent estimate, worldwide money laundering activity amounts to roughly $1 trillion a year. These illicit funds allow criminals to finance a range of additional criminal activities. Moreover, money laundering abets corruption, distorts economic decision-making, aggravates social ills, and threatens the integrity of financial institutions. Money launderers now have access to the speed and ease of modern electronic finance. Given the staggering volume of this crime, broad international cooperation between law enforcement and regulatory agencies is essential in order to identify the source of illegal proceeds, trace the funds to specific criminal activities, and confiscate criminals' financial assets. This issue of Economic Perspectives gives some idea of the scope of the problem as well as the way agencies of the U.S. government are cooperating with each other, the private sector, and foreign governments to contain this scourge.

What is money laundering?
How big is the problem and why is it important?

The USA PATRIOT Act, signed by President Bush last year, is designed to detect, deter, and punish terrorists in the United States and abroad. The Act imposes new anti-money laundering requirements on brokerage firms and financial institutions. By April 24, 2002, all brokerage firms were required to have new, comprehensive anti-money laundering programs.
To help you understand these efforts, we want to provide you with some information about money laundering and our steps to implement the USA PATRIOT Act. Money laundering is the process of disguising illegally obtained money so that the funds appear to come from legitimate sources or activities. Money laundering occurs in connection with a wide variety of crimes, including illegal arms sales, drug trafficking, robbery, fraud, racketeering, and terrorism. The use of the U.S. financial system by criminals to facilitate terrorism or other crimes could well taint our financial markets. According to the U.S. State Department, one recent estimate puts the amount of worldwide money laundering activity at $1 trillion a year.

    Money laundering is a process in which assets obtained or generated by criminal activity are moved or concealed to obscure the link between the crime and the assets. Terrorist activities are sometimes funded from the proceeds generated by illegal activities, and perpetrators must find ways to launder the funds in order to use them without drawing the attention of authorities. Detecting and tracing such funds can be extremely difficult, and even the best anti-money laundering measures are not always effective. The Financial Action Task Force (FATF) is the organization with primary responsibility for developing a world-wide anti-money laundering framework, in close cooperation with relevant international organizations. The IMF has long been involved in international efforts to combat money laundering, and over the last year it has intensified its activities significantly and extended them to combating the financing of terrorism.

    Asset Forfeiture and Money Laundering Section
    The Asset Forfeiture and Money Laundering Section provides centralized management for the Department's asset forfeiture program to ensure its integrity and maximize its law enforcement potential, while also providing managerial direction to the Department's components in prosecuting money laundering. The Section initiates, coordinates, and reviews legislative and policy proposals impacting on the asset forfeiture program and money laundering enforcement agencies. The Section works with the entire spectrum of law enforcement and regulatory agencies using an interagency, interdisciplinary and international approach. The Section is mandated to: coordinate multi-district investigations and prosecutions; provide guidance, legal advice and assistance with respect to asset forfeiture and money laundering investigations and prosecutions; develop regulatory and legislative initiatives; ensure the uniform application of forfeiture and money laundering statutes; litigate complex, sensitive and multi-district cases; and provide litigation assistance to U.S. Attorneys' Offices and Criminal Division components.

    USA Patriot Act Increases Anti-Money Laundering Responsibilities for all Financial Institutions
    All covered financial institutions will be required to establish an Anti-Money Laundering (AML) compliance program. The program is to consist, at a minimum, of the following:
    • a designated compliance officer,
    • appropriate policies and procedures,
    • training programs for employees, and
    • an independent audit function to test procedures.
    This provision is effective April 24, 2002, which is when Treasury regulations to implement the compliance program requirement are due. The statute also authorized the Treasury, as part of its implementing regulations, to exempt certain entities from the AML compliance program requirement. Therefore, all financial institutions, unless exempted by regulation, must have an AML compliance program in place on that date.     On November 20, 2001, the U.S. Treasury Department issued interim guidance on how banking institutions should comply with two provisions of Title III of the USA Patriot Act. Those two provisions became effective on December 25, 2001.
