s part of the changes implemented by HJR 10 and HB 592, employment law mediation began at the start of Fiscal Year 2000. The process is intended to consolidate diverse claims, including issues such as wage and hour, independent contractor status, and uninsured employer, before a mediator in hopes of eliminating redundant proceedings, decreasing time to settlement, and reducing the number of cases that proceed to the formal hearing level. At the end of FY 00, mediation had resolved 70% of assigned cases, with seven cases pending. The average time for completion of the mediation process was 24 days. (back to top of page) Workers ’ Compensation Assessment T he 1997 Legislature changed the assessment methodology used to fund the workers' compensation regulatory functions of the department to a fixed percentage of compensation and medical benefits paid by insurers in the previous calendar year. Based on more current projections of the amount of benefits paid, the 1999 Legislature increased the fixed percentage from 2.6% to 3% of compensation and medical benefits paid. The new assessment method went into effect in FY 00 and FY 01.

Loans
There are several types of loan programs for which you may be eligible to borrow. Eligibility will be determined by your school’s financial aid office, based on the information provided on the FAFSA. Below is a brief outline of each loan program:
  • Federal Family Educational Loan Program (FFELP) : The FFLEP loans consist of the Federal Stafford Subsidized Loan, the Federal Stafford Unsubsidized Loan and the Federal Parent PLUS Loan. These loans are originated from lending institutions (banks) and guaranteed by Guaranty agencies. Borrowers are eligible for FFELP loans based upon the information provided on the FAFSA and the educational costs at the school. Federal Perkins Loan Program : A Perkins loan is a low interest (5%) loan for both undergraduate and graduate students with exceptional financial need. Federal Perkins loans are made through a school’s financial aid office. Your school is your lender and the loan is made with government funds. Repayment begins nine months after you graduate, leave school, or drop below half time status. This is called a grace period. At the end of your grace period repayment will begin. You have ten years to repay the loan excluding periods of deferment or forbearance during which time payments can be suspended. For more information on Perkins loans contact your schools financial aid office. William D Ford Direct Lending Program : This loan program consists of the Direct Stafford Subsidized Loan, Direct Stafford Unsubsidized Loan, and the Direct Parent PLUS Loans. These loans differ from the FFELP loans because the lender for the Direct loans is the Federal Government and the school financial aid office administers the loans rather than a guaranty agency. Eligibility for Direct Loans is determined by the information provided on the FAFSA and educational costs at the school that you are attending.

    Program Description OVERVIEW The Montana and High Plains Region Troops-to-Teachers Program, a regional consortium servicing Montana, Idaho, North Dakota, South Dakota and Wyoming, is designed to assist qualified military personnel make the transition from the armed services to service in the classrooms of our schools. The program helps connect individuals with information, institutions and the people that can help participants navigate then meet state certification requirements and ultimately find a teaching position. As of January 2002, over 4,000 Troops-to-Teachers participants have been hired nationally in the public schools through the program. The Troops-to-Teachers (TTT) program was initially established in 1994 to address force restructuring in the military by assisting retiring and separating active duty military personnel transition to new careers in public education. The military drawdown is over and the program has been redefined to address the actual and projected nationwide teacher shortage. According to “Who Will Teach Montana’s Children”, a report published in February 2001 for the Certification Standards and Practices Advisory Council (CSPAC) of the Montana Board of Public Education, Montana will need to hire roughly 909 new teachers each year for the several years. The report also indicates that only about 265 of those annual vacancies can be expected to be filled by recent graduates from the eight institutions within the state offering teacher education programs. In short, many of Montana’s schools can expect to have a difficult time filling their available positions. Other states in the high plains region are experiencing similar situations. Nationally, the situation is quite similar with U.S. Department of Education figures indicating that 2.2 million additional teachers will need to be hired nationally, over the next decade, to keep pace with teacher retirements and the growth in student populations.

    State Highlights MONTANA - INDUSTRY EPSCoR PARTNERSHIP: The Meridian Oil Company has participated as an industrial partner in the Montana DOE/EPSCoR Petroleum Reservoir Characterization research cluster by making available the Rabbit Hills Oil Field in north-central Montana. Meridian Oil has also provided company data and results to the Montana University research team. The Rabbit Hills field has proven to be an ideal choice because it is relatively small(480 acres) and is a new field with modern well-log suites, a large percentage of cored wells, moderate structural complexity, and is an analog to several Montana fields. MONTANA - EPSCoR-STATE COLLABORATIONS: The Montana DOE/EPSCoR Petroleum Reservoir Characterization research team in conjunction with the Montana Bureau of Mines and Geology participate in the imaging of the reservoir using seismic methods. These seismic images are reviewed and analyzed in the context of detailed geologic models. MONTANA - ALTERNATIVE ENERGY SOURCES: Cooperation between the Montana DOE/EPSCoR Wind Energy researchers, the Montana Power Company, and the State Department of Environmental Quality has resulted in the set up of the Rice Ridge Renewable Energy Park. This park has enabled the testing of wind turbine blades under severe environmental conditions.

    The sample of public schools for the FRSS Principal/School Disciplinarian Survey on School Violence was selected from the 1993-94 NCES Common Core of Data (CCD) Public School Universe File. Over 84,000 public schools are contained in the CCD Universe File, of which almost 79,000-49,000 regular elementary schools, 14,000 regular middle schools, and 15,801 regular secondary/combined schools in the 50 states and the District of Columbia-meet the eligibility criteria for this study. Excluded from the sampling frame were special education, vocational, and alternative/other schools, schools in the territories, and schools with a high grade lower than one or ungraded.
    Respondent and Response Rates
    In April 1997 questionnaires were mailed to 1,415 school principals. The principal was asked either to complete the questionnaire or to have it completed by the school disciplinarian who was most knowledgeable about discipline issues at the school. Telephone followup of nonrespondents was initiated in late April, and data collection was completed in July 1997. Eleven schools were found to be out of the scope of the study (no longer in existence), and a total of 1,234 schools completed the survey. Thus, the final raw response rate was 88 percent (1,234 schools divided by the 1,404 eligible schools in the sample). The weighted overall response rate was 89 percent. Weighted item nonresponse rates ranged from percent to 0.9 percent. Because the item nonresponse was so low, imputation for item nonresponse was not implemented.

ORDER ON APPEAL This case was initiated by the Montana Schools Group Workers' Compensation Risk Retention Program (MSG) to contest the amount it was assessed under section 39-71-201, MCA, for the 1992 fiscal year. It paid the full amount of the assessment $162,477.61 under protest and requested a contested case hearing before the Department of Labor and Industry (Department). A hearing was held. MSG's challenge was rejected and this appeal followed. Montana Schools Group Workers' Compensation Risk Retention Program Insurance coverage for workers' compensation injuries is provided through three different statutory plans. Plan 1, which is found in Title 39, part 71, chapter 21, permits employers to self-insure provided certain conditions are met. Self-insured employers are referred to as Plan employers.
